As we promised in our last issue, we lay before our readers the following ac count of this trial, in which such a deep interest has been manifested, through out this community. This case was the most important on tho docket for the speoial term which began on tho 20th February last. During the first part 'oTCno week, tho tuioor cases, where the defendants were in j dl, were dis posed of, and Friday was Appointed for tho trial of Irvin J. Porter for tho murder Of Isaac Gardner. Tho counsel iu tho case were E B. Scabrook Esq., Solici tor and Malcolm I. Browning Esq., for the prosecution, and Messrs Knowlton and Bull for the prisoner. Upon the opening of the Court on Friday morn ing, the trial of this case was immediate ly commenced. The case was opened for tue prosecu tion by Malcolm I. Browning '^sq., in a brief address, after which the testimony for the State was introduced. The tes timony on tho part of the prosecution showed that the two men, Irviu J. Porter and Isaac Gardner were together with Daniel A. Porter and Henry Sullcy at the Dean Swamp Mill, ou the 26th day of October, *l,at there was eodic cause of misunderstanding prt-?If,Qsly ex isting between the deceased ant] the prisoner, that franc Gardner came up to whore Trvin Porter was sitting on the mill, and spoke to him; that, sitting down, the two men talked together ap parently in u frieudly manner, thai Isaac Garducrrr.se up and asked Porter to go the further cud of the Mill; that they went and sat down again on some scantling, and talked together j that both had their knives out whittling, but were apparently friendly ; that when next noticed by Daniel A. Porter and Henri j Salley, they were scuffling ; that Daniel y?^ter->ru4*?t;nry-?tHe> went fcTTheJT to part them, and found that Gardner was badly cut. They seized Porter, and afterwards left him aud went to Isaac Gardner, whom they conveyed to his home, where he lived until the next morning, and died. During lh time between the difficulty and his death. Isaac Gardner told to several witnesses how the occurrence took place. And it was upon this his dying declaration that the counsel lor the State chiefly relied. Porter csenped, Mid remained junta .until Uro weeks after the occurrence, when be come to his uncle and usked to * bo brought to Orangeburg, where he gave him&clf up and was committed to jail, as the renders of the Acte? are in formed .J The testimony ou the part of the ?tafc being concluded, Augustus B. Knowlton Esq., opened the defence, in u clear aud earnest address, after w hich, the counsel proceeded with the testimony for tho defence. This was, briefly, that Porter was sick and disablud by recent fever and accident; tiff be wa? ' the tj&? vi able to cope with Gurduer"; that, from the position of the two men tind of the mill, Porter, being attacked by Gardner, was in danger of being push-* <rver the mitt into the mill-stream, wheu he would cortaiuly have been killed ; that he cut Gardner to save his own life, which was assailed and in imminent dr tger. Also, the defence iutro( uced evidence tn prove threats on tho part o! Gardner ngninst Porter. T/ho clicttation of the testimony cc ?cupiod the whole of Friday, during the w'holc of which day, the Court-House was crowded, and the deepest interest was manifested. At about ti o'clock P. M. the Court adjourned until nine o'clock Saturday morning, Saturday. Tho next morning, the Court4Iousc .was again crowded, to hear the argu ment of counsel, aud the result of the itial. The argument for the prosecu tion was opened by E. B. Scabrook Esq., wo? spoke for about twenty minutes in bta fluent, and plcnding style of oratory Eloquently, dramatically, did the c<?un j*l portray the tcene, dwcUirnj uporf the ' <uica 1 probubltties of tho case, arutiug frouj tho circutnstauces aud from the parties en gaged, being corroborated by the decla rations of tho deceased, in the full ap preciation of his situation, about to step into tho presence of the Supreme Judge, to render his ?nal account. As the counsel dwelt upon this thought, he bc eumo beautifully and touchiugly' elo quent ; aud as he puiutcd the atrocity of tho deed, and tho terrible nature of tho circumstances of the death with "blood? blood?blood" upou the earth, tho thres hold, tho vory n'.tar of home, thee of his oratory was marked. Mr. Scabrook was followed by gustus B. Knowlton Esq., for the fence. The frio?ds of Mr Know had been uniting patiently to heat speech in this case. From its in tnncc they expected a great effort were they disappointed. Earnestly in his terse and manly style, did into bis argument for the defence. Knowlton's style is analytical, log and terse, rather than rhetorical though his clear and laconic style presenting his poiuts of strength, is queutly embellished with a classi, /\ oomcntation; still there is a strength absence of overstrained sentiment, c in his appeals, which compel the as of the reason while they touch the hd of his hearers. For over two hours he elaborate and bring out all the poi in the defence of his client j to whom had cloavly devoted himself head a heart; ever and anon touching with 1 firm, strong style theiustinctsof sytn thy, whose ehords vibrated under t grasp of his master hand. Too much in est was felt in the result., u nd in too est uud masterly a style did Mr. Ivnuwl treat the subjoct and present his cd iur any lagging ot attention during lengthened argumeut. The crowd anxious aud curious listened witht any relaxation of interest during his e '.ire speech, and at its close no one he tated to fool that the counsel had do his duty to his client, in whose dclcn he so heartfully and ably h..d stood at labored j and atnplo justice to tho i portaut and interesting subj set. At t conclusion of Mr. Knowlton.'s able arg ly, not only in the grateful 1 osbtu ot ti prisoner but iu the hearts of all l| friends. Tho speech had certainly p (lueed a marked effect upon the jury, upon the entire audience. Maleolm I. Browning Esq., folh.i in reply, ayd closed the argument fJ the prosecution. Mr. Browning's sty] of oratory is well-known to the p<'"p| of our Couuty. Already has he mad] his mark ns a gifted speaker. In h argument in this ease he has fully su: tain cd his rcprctation, as an effectiv and eloquent speaker. For about a hour and a half he poun d forth in rinu tog tones his torrcut of eloquence, whicl thrilled the nssemblcd listcucrs, am kopt them spcll-bouud in rapt and hush ed attention. Replying with the energy of forensic debate to the uble nrguiucu for the defence, and presenting th strength of the prosecution in word| painting of striking beauty and effee and concluding with :'.n eloquent demanJ for justice and a beautiful allusion t| the widowed wife orphan b >y, an ! des late home of tho murdered Gardner, hi ptoduccd a profound aeusatiou, upon ii( large and attentive audience. They remained iu consul tation for several hours, when they re turned and their verdict was published. It was, "Guilty of manslaughter." The sentence of the Court, two years in tho penitentiary. was pronounced the same day, it being the last day of tho tonn. We arc informed that the jury, upon retiring, stood three for "not guilty," the re?t for the verdict ".s brought i:j. Before the defendant was sentcnoed, Mr. Knowl ton moved in arrest of judgment, on the grouud that the indict incut, when for mally presented by the grand jury, pur potted to have been found by the y.i run of''Chailcston," and that the word ??Ornngeburg" had beeu afterward sub stituted for Charleston The bur are almost unanimously of the opinion that tho whole proceeding will bo set aside upon this ground. { ? Next in order was the ease of one "Towy" who, overpowered by the iuflu cute of a potent draught, rode his steed headlessly through the streets, regardless of the lives and limbs of podest rains. He was soon escorted by our accommodating Police before tho judgment bar. and upou depositing #5, was pormitted to leave these corporate limits uuni dusted. Tho Town Council of Urangeburg would publicly express their thanks to tho County Commissioners of Urange burg County, for the gratuitous offer of the old jnl building for t'ue uses of the Town as a Gu^rd.
