TT The Trial of the Porter-Gardner Murder Case. As we promised in our last issue, we lay before oar readers the following ac count of this trial, in which such adocp interest has been manifested, through out this community. This case was the moat important on tho docket for tho ppecial term which began on tho 20th February last. During the first part oriWTree*-, *h? minor cases, where the defendants wero in j iil, were dis posed of, and Friday was appointed for the trial of Irvin J. Porter foY tho murder oTIsaac Gardner. The counsel iu tho case were E B. Scabrook Esq., Solici tor and Malcolm I. Browning Esq., for tho prosecution, and Messrs Knowlton and Bull for tho prisoner. Upon the opening of the Court on Friday morn ing, tho trial of this case was immediate ly commenced. The case was opened for the prosecu tion by Malcolm I. Browning Esq., iu o brief addrcsB, after which the testimony for the State was introduced. The tes timony on tho part of the prosecution showed that the two men, Irviu J. Porter and Isaac Gardner were together with Daniel A. Porter and Henry Sal ley at tnt> Dean Swamp Mill, ou the 26th day of October, that there was some cause of misunderstanding prr-?;0usly ex isting between the deceased and the prisoner, that Isaac Gardner came up to X-hore Ti'vin porter was aitti?i<? on the mill, and spukc to him; that, sitting doyvu, the two men talked together ap parently ip a frieudly manner, that Isaac Garducr rose up aud asked Porter to go the further cud of the Mill; that they went and sat down again on some scantling, aud talked together; that both had their knives out whittling, but were apparently frieudly ; that wheu next noticed by Daniel A. They seized Porter, and afterwards left him aud went to Isaac Gardner, whom they conveyed to his home, where he lived until the next morning, and died. During th time between the difficulty and his death, Isaac Gardner told to fccvcral witnesses how the .occurrence look place. Aud it was upon this his dyiwg declaratiou that the counsel for the State chiefly relied. Porter escaped, snd remained perdu until t?wo weeks after the occurrence, when bo eemc to his uncle and usked to ? be brought to Orangeburg, where he gave himself up and ?.ras committed to jail, as the readers of the Actes arc in formed * The testimony on the purt of the State being concluded, Augustus B. Knowlton Ewp, opened the defence, in a clear and curncst address, after which the counsel proceeded with the testimony ior the defoncc. This was, briefly, that Porter was eiok and disahlud by recent fever and accident; that he was at thu ?liyie uu ?bk .cope with Gardner"; thai, from the position of the two men and of tho mill, Porter, being attacked by Gardner, was in danger of being pusb^i-o'Ver the ?nil' into tho mill-stream, wheu he would certainly have been killed ; that he cut Gardner to save his own life, which was assailed and in imminent danger. Also, the defence introt uced evidence to prove threats on tho part ot Gardner ngninst Fortcr. The clicitation of the testimony oc cupied oho whole of Friday, during the Whole of which day, the Court-Housc was crowded, aud the deepest interest was manifested. At about ti o'clock P. M. the Court adjourned until uinc o'clock Saturday morning, Saturday. Tho next morning, the Court-Douse was again crowded, to hear the argu ment of counsel, aud the result of the trial. The argument for the prosecu tion was opened by K. B. Scabrook Esq., who ipokc for about twenty minutes in hfc fluent, and pleading style of oratory. Eloquently, dramatically, did the Ooua Jfel portray the scene, dwf Uinjj upod the UIC8 I probublitics of the case, arising from tU*i circumstances nod frour the purtie* en gaged, being corroborated by the decla ration.? of tho deceased, in the full np preciation of his situation, about to step into the presence of the Supreme Judge, to render his iinai uecuuut. As. the counsel dwelt upon this thought, he be came beautifully aud touchiugly elo quent ; and as he paiutcd tho atrooity of the deed, and tho terrible nature of tho circumstauces of tho doath with "blood? blood?blood" upou the earth, thothres hold, tho vory altar of homo, the e| of his oratory wus marked. Mr. Scabrook was followed by gustus B. Knowlton Esq., for the, fence. The friends of Mr Knovj had been wafting patiently to heat speech in this) case. From its inj tancc they expected a great effort, were they disappointed. Earnestly4 in his terse and manly style, did into his argument for tho defence 1 Knowlton's stylo is analytical, lot and terse, rather than rhetorical, though his clear and laconio st; presenting his points of strength, isj quently embellished with a classi. nomcntation ; still there is a strength absence of overstrained sentiment, e] in his appeals, which compel the uvt of the rcqsou while they touch the h; of his hearers. For over two hours he elaborate and bring out all the poi in the defence of his client ; to whom had clearly devoted himself head a| heart; ever and anon touching with 1] firm, strong stylo the instincts of symj thy, whose chords vibrated under grasp of his master hand. The speech had certainly p| duced a marked effect upon the jury, upon the entire audience. Malcolm I. Browning Esq., folio in reply, and closed tho argument fj the prosecution. Mr. Browning's sty] of oratory is well-known to the poop of our County. Already has he mac his mnrk as a gifted speaker. ? In hi argument in this ease he has fully sm tained his rep rotation, as an effect iv und eloquent speaker. For about a hour and a half he poured forth iu ring! ing tones his torrent of eloquence, whicl thrilled the assembled listeners, am kopt them spelj-buund in rapt and hush ed attention. Replying with the cucry of forensic debate to the ablo nrgumeul for the defence, and presenting th strength of the prosecution in wordj painting of striking beauty nud effee and concluding with an eloquent demauj for justice and a beautiful allusion t the widowed wife orphan boy. and desofl late home of tho murdered Gardner, hi produced a profound sensation, upon th, large nud attentive audi'-nre. After a brief and clear eh arge fromjj Judge Graham, the jury returned toM their room. They remained in consul * tation for several hours, when they re turned and their verdict was published. It was, "Guilty of manslaughter." The sentence of the Court, two ,years in the pnuitenttary, was pronounced the same day, it being tho last day of ti c term. We arc informed that the jury, upon retiring, stood throe for "not guilty," the rest-for .the verdict as brought in. Before the dolond.vit was sentonoed, Mr. Knowl ton ninred in arrest of judgment, on t ho ground that the indictment, when for mally pvesentod by tho graud jury, pur ported to have been found by tho ju rori of "Chailcston," and that tho word ?:Urnngoburg" had bcon afterward sub stituted for Charleston.
