Section 1, Heil enacted by the Sennto aud House of Representatives of the State of South Carolina, now mot and sitting in General Assembly and by the authority of the' same, That it shall not be lawful, after the first day of April, ono thousand eight hundred and sixty-nine, for any agent or any lusurauce company in the United States, or any foreign Stato, incorpo rated by tho laws of this .Stale, to lake risks or transact any business of insurance in this State without first obtaining license from the Comptroller General, which license shall ex pire on the 81st day of March of each yeur. Sr.c. 2. Th.ttu beforo the Comptroller General shall issue such license to any agent of any insurance company not incorporated in South Carolina, there shall bo filed in his office a certified copy of the charier of the company from which the said agent or at torney has received his appointment, and also a certified copy of the vote or resolution of the Trustnoaor Dir^efOT of said nnn>i>?ny appointing him such agent, accompanied by a warrant ot appointment under the official seal of the company, and signed by the President and Secretary, e uch warrant of appointment shall continue valid and irrevo cable until another ngent or attorney has been substituted so that at all times while any liability remains outstanding there shall be within the State an ugent or attorney ns aforesaid, and shall contain a consent ex pressed, authorizing process of law to be saved on said ngent or attorney for all lia bilities of evory nature incurred in this State by said company, and that such service made on such agent or attorney in the manner re quired by the laws of this State shall bu deemed legal and binding en the company or companies, in all coses whatsoever, and that every judgment an recovered shall bo con clusive evidenco of the indebtedness of the company; and in addition to said warrant o"" appointment, there shall be filed and pub ?inLvdu oinleiueui, made under oath of its President or Secretary, showing its assets and liabilities, and distinctly sbowiug the amount of capital stock, and how the satno has been paid, and of what Ike assets of the company cousistp, the amount of losses due and unpaid, and all other claims uguinst the company, or other indepteducsa, whether due or not due at the time ef the filing of the statement above, and shall further show: 1st. The amount received front premiums, and whether sufficient to pay losses, &o. tlth. Whether there have been any chan ges in agencies during the preceding six months. Sec. 3. That every ngent or attorney ob taining such license shall also cause such li cense to be published in some newspaper, to bo designated by the Comptroller General, having circulation in the county in which he resides. The company shall also furnish the Comptroller General, through their agent, an annual statement of the affairs of the com pany, as provided in the second Section of this Act, and it shall be the duty oflhc ngent or agents to publish the same. Sec. 4. That if tho Comptroller shall be some satisfied that any company is insolvent or unsafe, it shall be Iiis duty to refuse li cense to its ngent or agents, und to withdraw any license that has been already issued. That any perton who shall deliver any policy of insurance, or collect any pre mium of insurance or transact any business of insurance in this State, for any company in the United States, or foreign State, not incorporated l>y the laws of this State, with out having first obtained license as l>y this Act required, or after his license has been withdrawn, or who shall in any way violate the provisions of this Act, shall be fined for every such ollVnce not less than one hundred dollars, nor more than five hundred dollars, at the discretion of the Judge: Provided, further.
