AN ACT to regulate the Agcnoiea of Insu rance Companies not incorporated in the State of South Carolina. Sect kin 1, He it enacted by the Senate and House of Representatires of the State of South Caroltha, now met and pitting in General Assembly and by the authority of the same. That it shall not be lawful, after tho first day of April, one thousand eight hundred and sixty-nine, for any agent or any Insurance company in the United States, or any foreign State, incorpo rated by the laws of this State, to lake risks or transact any business of insurance tu this State without first obtaining license from the Comptroller General, which license shall ex pire on the 8lsi day of March of each year. 8bo. 2. ffhrfb before the Comptroller General shall Issue such Jicenso to any agent of any insurance company not incorporated in South Carolina, there shall be filed in his c-flicc a certified copy of the charter of the company from which the said agent or at torney has received his appointment, and also a certified copy of tho Tute or resolution of the Trustees or Director of said company appoii iing him such agent, accompanied by awarraul ot appointment under the official seal of the company, and signed "by tho President and Secretary. Such wnrrant of appointment shall continue valid and irrevo cable until another agent or*"- attorney" fins ^ceh substituted %<?th*t aAi-11 - %ny linhitiu-'rrmrr.ris out * landing tkcre shall bo within the State an agent or attorney as aforcstid, und shall contain a conseut ex pressed, authorising process of law to be saved on said agent or attorney for all lia bilities of every nature incurred iu this State by said company, and that such service made on such agent or attorney in the manner re quired by the laws of this State shall be deemed legal and biuding**en the company or companies, in all cases whatsoever, and that cvory judgment so recovered shall bo con clusive evidence of the indebtedness of tho company; and in addition to said warrant of appointment, there shall be filed and pub lished a statement, made under oath of its President or Secretary, showing its assets and liabilities, and distinctly showing the amount of capital stock, and how the same has been paid, and of what the assets of the eouipany consists, the amount of losses due and unpaid, and all other claims against the company, or other indeptednesa, whether due or not due at the time ef the filing of the statement above, and shall further show : 1st. That said companies have fulfilled the provisions of their respective charters, aud of the extensions and amendments thereto, in every particular, and whether there has been any change of charters since last statement. 2d. The amount of policies outstauding as near as can be ascertained. 8d. The character of the risks, and the rule governing companies and their agents in taking the same, both as to locality and amount, 4th. Tho particular character of the as sets, specifying 'lie amount of cash and pub lic, bank, manufacturing or other stocks and bonds, or other securities, held by tho com panies, with tho evidence that they are held by them, the rule of investment in real es tate, securities, and the general localities of real estate secured to oompanies. 6th. The amount received from premiums, and n bei her sufficient to pay losses, &c. 6th. Whether there have been any chan ges in agencies during the preceding six Sec. 3. That every agent or attorney ob* taining such license shall bIbo cause such li cense tn be published in *om? newspaper, to bo designated by the Comptroller General, having circulation in the county in which he resides. Tho company shall also furnish the Comptroller General, through their agent, an annual statement of the affairs of the com puny, as provided in the second Section of this Act, and it shall be the duty of the agent or agents to publish the same. Skc 4. That if the Comptroller shall be some satisfied that any company is insolvent or unsafe, it shall be his duty to refuse li cense to its agent or agents, and to ?vilhdraw any license that has been already issued. Sbo. 5. That any person who shall deliver any policy of insurance, or collect any pre mium of insurance or transact any business cf insurance in this State, for any company iu the United 8tates, or foreign State, aot incorporated by the laws of this State, with out having first obtained license as by this Act required, or after his license has been withdrawn, or who shall in any way violate the provisions of this Act, shall be fined for every such ofTeuce not less than one hundred dollurs, nor more than five hundred dollars, at the discretion of the Judge: Provided, further, That nothing contained in this Sec tion shall release any company or companies upon any policy issued or delivered by it or Sxo. 6. That for every license issued by the Comptroller General under this Act. he shall bu paid by the company taking out such license the sum of fivo dollars for his own use. 8kc. 7. Section 1. Re it enacted by the Senate and House of Representatives of the State of Soutli Carolina, now met and sitting in Gen eral Assembly, and by the authority of the same: No Company or Association which is now organised, or which may be hereaf ter organised in this State^to carry on the business of insurance of anVkind or kinds, shall proceed further witb-'ffusiness (as the oase may be) until they havo deposited with the Comptroller General of this State bonds or stocks of* this State equal to the sum of fifty thousand dollars par value for eaoh Life Insurance Company or Association, and twenty thousand dollars par value for each other Insurance Company or Association. Tho Comptroller General shall hold such bonds or stocks as security for policy holders in the Cqmpany or Association; but, so long as nny Company or Association so depositing shall continue solvent, the Comptroller Gen eral may permit such Company to collect and receive the interest* on such bonds or stocks so deposited. Sec. 2. Whenever any Company or Asso ciation is, or shall become fully organiied, and the said Company or Ass ciation have deposited with the Comptroller General the requisite amount of Stato bonds or stocks, it shall become his duty to furnish the Corpora tion or Association with a certificate of .such deposit, tPhich certificate or duplicate thereof certified by the Comptroller General, may he used mi and be evidence for and against the Corporation. ? |j . Sxc. 3, It shall not be lawful f %r any per son or persons. Corporation of Corporations, Association or Associations to act within this State as agent, or otherwise, in receiving or procuring applications for insurance of any kind or kinds, or in any manner to aid in transacting the business of insurance of any kind or kinds for any Company or Associa tion incorporated by, or organized under the laws of this or any other State Government, or any foreign Government, until such Com pany or Association have deposited with the jjmptrollcr General of this State, for the benefit of the policy holders of such Com pany or Association, citizens or residents of tho United Stoles, bonds or stocks of this Stato equal to tho ?um of fifty thousand dol lars par value for each Life Insurance Com pany or Association, and twenty thousand dollars par value for each other .Insurance Company or Association; out, so long as any Comjmny or Association so depositing shall contim.c ?JlvptifAine jCf'tuptroller Uencral _*Hb ,rwriiiH-BU?.'COliipulM-?r Association to collect and receive the interest on such bonds or stocks so deposited, and have appointed an Attorney in this State on whom process of law can be served ; and said Attorney shall have filed with the Comptroller General a certified copy of the charter of said Com pany or Association, and also a certified copy of the vote or resolutions of the Trustees or Directors of tueh Company or Association ap I pointing him the Attorney of such Company, ! which appointment shull ctntinuc until another Attorney be substituted ; which shall be done upon the death, removal or in I capacity to act of such Attorney, or may be i done by such Company or Association at %ny time. When the foregoing requirements, and such other requirements as now are, or ! may hereafter bo required by law, shall be complied with the Comptroller General shall give a certificate to that effect, and also state the ncme of the Attomcj*, which certificate, when filed in the Couuty Clerk's Office of the County where the agency is to be located, shall be the authority to commence business. Skc. 4. Every violation of this Act shall subject tho Company or Association, or agcul or agents, violating, jointly and severally, to a penalty of five hundred dollars for each violation, which shall bn sued for and recov ered in a joint or several civil action, in the name of the State of South Carolina, by the Solicitor of the Circuit iu which the Com pany or Association, or agent or agents so violating, shall be situated; one-half of such penalty when recovered shall be paid into the County Treasury of such County, and the other half to tho informer of sueh viola tion ; aud. in case of the non-payment of such penulty, the person or persons so offend ing shall be liable to imprisonment for a pe riod not exceeding one year in the discre tion of ihe Court having cognizance thereof. Sko. 5. The Comptroller General shall safoly and separately keep the bonds or stocks of each Company or Association, and shall return the identical bonds or stocks re ceived ; and during the usual office hours, shall keep the bonds <?? ?i? <V? ?? j?* * examination of the representative of any Com pany or Association having made a deposit, as required by this Act ; and the .Mate shall be responsible for tho return of all said bonds or stocks dy the Comptroller General. Skc. 6. All Acts ami parts of Acts incon sistent or conflicting with this Act are here by repealed. Sec. 7. This act shall take effect sixty days after its passage.
