The'1 Lexington correspondent of the Columbia Phoenix gives the following ac count of the trial and acquittal of Dr. P. S. Lewie: Monday having bcon assigned for the trial of Dr. F. 8. Lewie, (our represen tative in the^Stato Legislature,) for the homicide of J. Elliott Drafts in May last, (for the seduction of his wife,) and it being a very exciting trial, caused every body to turu out. At an early hour the courthouse was crowded almost to suffo cation. The jury was composed of eleven whites and one colored. The case was opened By Solicitor Talley. After the examination of the witnesses on the part of the State, the prisoner offering no evidence. Colonel Simoon Fuir opened tho argument for the defence. He con tended that the testimony, about which there was no dispute, all being no the side of the prosecution, made a case of exousablc homicide. The prisoner was rightfully where he was to satisfy him self of the deceased's intention of crimi nal intercourse with (prisoner's) wife; and although thu provocation was grout yet the danger was so urgent that the killing should be ascribed to the necessi ty, and not the provocation, when made a case of self-defence The prisoner had been warned of deceased's throat's against his life if he interfered with his (deceased's) intercourse with prisoner's wife. Tue prisoner had every reason to apprehend, from the mauuer of his ap proach, as well as from threats, that de ceased designed to take prisoner's life if he could. The prisoner held, when tho deceased fired that no alternative was left but to protect his own life by taking that of his adversary. The effurt ou the part of the prosecution to excuse the conduct of the deceased, by showing that the prisoner had a difficulty with his wife some months ago, is adding insult to in jury. The man who could coolly calcu late on the chance of seduction, where the wife was under the displeasure of her husband, was a cold-hearted jmurderer? more than tho beast of prey, who only dovoured the body of his victim ; where as the seducer makes life more dreadful than death itself, and should be shot down as a wild beast of prey. The question, whether it was excusuble homi cide in self-defence, was a question of fact for the jury, and the prisoner bad no fears of the result. lie was followed by Mr. Tulley, on tho part of the State, who declared that the ground taken by the prosecution was, that under tho law any provocation, bowever enormous, could only reduce an admitted killing to manslaughter; and iVaA if the evidence proved that there Was time between the provocation and killing lor "cooling," or if there was sat isfactory proof of previous arrangement and preparation for the killing, it was murder. Mr. Tallej was replied to by Colonel Honry A. Meetzc, in a brief but able argument. Thbribi.k Supotjxo Affair in JSd$JWii,d?One Man Killed a?d Anoxuau JJaj/i<y Wounded.?The Augusta GJtmnicie, of the 6th publishes the following account of a terrible affair oacurrud in Edgcficld on the day us i 41 As our readers are all aware of the nature of the offuir out of which the difficulty between the Addison family and Mr. D. Cresawell arose we will not allude to it in this connection, but merely gWe the history of the recent tragedy as given to us by our informant On last Wednesday afternoon Mr. D. Crosswell and an older brother, Mr. Charles Cress well, left this city in a buggy to return to their homes, near 96, South Carolina. Late on the evening ofthat day the two brothers reached Edgefiold Court House and stopped for the night ut the village tavern. On yesterday morning, between 8 and 9 o'clock, tho Orcsswells again started on their journey, taking in the buggy with them a eixteen shooting Winchester rifle aa if anticipating trou ble. They had not been gone long when some oue came into the town and said the two nun had beeu murdered. A party immediately went out to ascertain if the rumor was correct. A mile and a half from Edgefiold, on the rosd to 96, tho bodies of the Cross wells were found. Tho older, Charles Crcsswell, was per fectly dead?tho body being almost rid dled with buckshot. 1). Crcsswell was seriously if not fatally wounded. One hand was pierced by two halls ; the other hand by uno; the chin was also struck; one bull entered the side, another the stomach. The latter is reported to have said that two men concouled by the way side had fired simultaneously -is they saw the buggy?afterward muking their es cape. He identified oue of the party as George Addison, Jr., a brother of the youug lady of the affuir. The wouudod Crcsswell is now an inmate of a private house in Edgeficld. No arrests have yet been made. We arc indebted to State Constable Hubbard for the following account of the a flair, furnished by one of his depu ties : Au affair of a very serious nature took place one mile and a half from this place, on the 9(i road, to day (August 5.) At about 10 o'clock, as two brothers?Char He and D. Creswell?were returning home in their buggy from this village, they were'shot by two men?supposed to be George and James Addison?who had conocalcd themselves in a plum-tree thicket, beside the road. Charlie Cres well was killed almost immediately?as ho expired within a few minutes after their reaching Dr. Parker's house, situa ted about 200 yards above where the shooting ? ceurred. D. Creswell is sup posed to be mortally wounded. Imme diately upon receiving intelligence of the shooting, three of us mounted und went out to endearor to arrest the guilty pur tics, hut thoy had gone. A relative of the suspected parties came to the Sheriff and myself, and told us that they were at his house, and would come and give themsolvcs up as soon as tho coroner's inquest was over, which was theu being held." A Hideous Reminiscence of the Cholera.?The death of R?chling sug gests a strange incident in which he was an actor. In 1854, when he was build ing the Niagara suspension bridge, a ter rible epidemic of cholera broke out among his laborers. Mr. Korb ling had an idea that he could cure cholera by a modification of the hydropathic treat ment. There were pleuty of patients, and he began in tho morning with a lit tle child, and before night had five capes in one shanty. At midnight they were all d> ad, and Mr. R?chling disconsolate ly abandoned tho practice of medicine, though he was about as successful as any of the doctors. Everybody wl*? was Binitten on that sultry Saturday died. There was nothing strange in the affair, except the heroism of the muu in his de sire to alleviate human misery. The further history of that shanty is really remarkable. Mr. Kuebling cheerfully assumed tho expense of the interment; but there was a peculiar horror of that place, and in the wretched panic that prevailed, he could induce no person to approach it. Ho theu offered fifty dol lars to any one who would throw the bodies off the bridge iuto the Niagara. No one would do it. His next move was to iuform the authorities that if on Mon day morning tho bodies were etiU there be would set fire to the shanty, and dis pose of unwelcome charge by crema tion. The thueat was of no avail, and ho kopt his word. Rut a hemlock, shanty furnishes little fuel ; the bodies were only scorched, and his funeral was still upon his hands. Ho finally paid two bravadoes from Lockport to bury thorn where they lay. Thoy were howl ing drunk, and full of blasphemies. Ruth wont hack to Lockport aud died the next niglit. That closed the tragedy. With all his tu; Mr, Rocbl:ng, as a doctor or undertaker, was not a success. Neicnrk (A. ?/?) Advertize?. A Mrs, Cooper,living near Big Creek, Sebastian County, Ark., a few days since gavo birth to triplets, all boys, the biggost of whom weighs, or did weigh a few days ago, when our informant, .lobn Sengel, saw the family, only two pounds. The other two axe still smaller, especially the second! horn. They are, however, per fectly built andi developed, roujtdtaced blue eyed, their limbs- not' larger thau a man's little finger, and present, as they lie all in a row on their mother's bod, a most striking and beautifully touching appearance.
