The" Lexington correspondent of the Columbia Phoenix gives tho following ac count of the trial aud acquittal of Dr. F. 8. Lewie: Monday having boon assigned for the trial of Dr. P. 8. Lewie, (our represen tative iu the State Legislature,) lor the homicide of J. Elliott Drafts in May last, (for the seduction of his wife,) and it being a very exciting trial, caused every body to turn out. At un early hour the courthouse was crowded almost to suffo cation. The jury was composed of eleven whites and one colored. The case was opened By Solicitor Talley. After the examination of the witnesses on the part of the State, the prisoner offering no evidence. Colonel Simoon Fair opened the argument for the defence. He con tended that the testimony, about which there was no dispute, all being no the side of the prosecution, made u ease of exousahle homicide. The prisoner was rightfully where he was to satisfy him self of the deceased's intention of crimi nal intercourse with (prisoner's) wife; and although the provocation was greut jet the danger was so urgent that the killing should be ascribed to the necessi ty, and not tho provocation, when made a case of self-defence The prisoner had been warned of deceased's threat's against his life if he interfered with his (deceased's i intercourse with prisoner's wife. Tue prisoner had every reason to apprehend, from the manner of his ap proach, as well as from threats, that de ceased designed to take prisoner's life if lie could. The prisouer held, when tho deceased fired that no alternative was left bet to protect his own life by taking that of his adversary. The effort on the part of the prosecution to excuse the conduct of the deceased, by showing f hat the prisoner had a difficulty with bis wife some months ago, is adding insult to in jury. The man who could coolly calcu late on the chance of seduotioo, where the wife was under the displeasure of her husband, was a cold-hearted jniurderer? more than tho beast of prey, who only devoured the body of his victim ; where as'the seducer makes life more dreadful than death itself, and should be shot down as a wild beast of prey. The question, whether it was excusable homi cide in self-defence, was a question of fact for the jury, and the prisoner had no fears of the result. He was followed by Mr. Talley, on tho fori of the State, who declared that the ground taken by the prosecution was, that under the law any provocation, however enormous, could only reduce an admitted killing to manslaughter; and feV&t if the evidence proved that there w*a time between the provocation and killing for "cooling," or if there was sat isfactory proof of previous arrangement and preparation for the killing, it was murder. /Jk #^ 9lt mA Mr. Talley was replied to by Colonel ftenry A. C'hrmiiie, of the 6th publishes tt?e following account of a terrible affair which oocurrod in Edgefield on the day pTWiousi ?*As our rea?er? ura all aware of the nature of the affair out of which the difficulty between tho Addison family and Mr. D. Cresswell arose wo will p.ut allude to it iu this connection, but merely, give the history of the recent tragedy as given to us by our informant. On last Wednesday afternoon Mr. I). Cresswell abd an older brother, Mr. Charles Cress well, left this city in a buggy to return to their homes, near 96, Pouth Carolina. Late on the evening ofthat day the two brothers reached Edgefiold Court Houso aud stopped for the uight at the villuge tavern. On yesterday morning, between 8 and 9 o'clock, the Crcsswells again started on their journey, taking in the buggy with them a sixteen shooting Winchester rifle as if anticipating trou ble. Thoy had not been gone long when some oue came into the town and said the two tiDtt had beeu murdered. A party immediately went out to ascertain if the rumor was correct. A mile and a half from Edgefleld, on the road to 96, tho bodies of the Cross weite wore found. The older, Charles Cresswell, was per fectly dead?the body being almost rid dled with buokshot. D. Cresswell was soriously if cot fatally wounded. One hand was pierced by two balls ; the other hand by oqo; the chin was also struck; one ball entered the side, another the stomach. The latter is reported to have said that two men concealed by the way side had fired simultaneously -is they saw the buggy?afterward making their es ctxpu. He identified oue of the party as George Addison, Jr., a brother of the young lady of the ufiuir. Tho wouudod Cresswell is now an inmate ot a private house in Edgeficld. No arrests have yet been made. We are indebted to State Constable Ilubburd for the following account of the a flair, furnished by one of his depu ties : An affair of a very serious nature took place oue mile and a half from this place, on the 9(1 road, to day (August 5.) At about 10 o'clock, as two brothers?Char lie aud D. Creswell?were returning home in their buggy from this village, they wero'shot by two men?supposed to be George and James Addison?who bad conocalod themselves in a plum-true thicket, beside the road. Charlie Cres well was killed almost immediately?as he expired within a few minutes niter their reaching Dr. Parker's house, situa ted about 200 yards above where the bhooting ocourrod. D. Creswell is sup posed to be mortally wounded. Imme diately upon receiving intelligence oi the shooting, three of us mounted aud went out to endeavor to arrest the guilty par ties, but they had gone. A relative of the suspected parties came to the Sheriff and niyaolf, and told us that they were at his houso, and would come and give themselves up is soon as the coroucr's inquest was over, which waa theu being held." A HlDKUUS Remimscknck of the CHOLERA.?Tho death id' R?chling sug gests a strange incident in which be was an actor. In 1854, when he was build ing the Niagara'suspension bridge, a ter rible epidemic of cholera broko out umong his laborers. Mr. Roebling had an idea that he could cure cholera by a modification of the hydropathic treat ment. There were plenty of patients, and he begau in tho morning with a lit tle child, and before night had five cases in one shanty. At midnight they were till d* ad, and Mr Roebling disconsolate ly ubandoned tho pructice of medicine, though he was about as successful as any of the doctors. Everybody whf waa Buiitteu on that sultry Saturday died. There was nothing strange iu the affair, except the heroism of the muu iu his de sire to alleviate human misery. The further history of that shanty is really remarkuble. Mr. Roebling cheerfully assumed the expense of the interment; but there was a peculiar horror of that place, aud iu the wretched panie that prevailed, he could induce no persou to approach it. Ho theu offered fifty dol lars to any one wbo would throw the bodies off the bridge into the Niagara. No one would do X His next move was to inform the authorities that if ou Mon day morniug tho bodies were still there he would set fire to the shanty, and dis pose of ism- unwelcome charge by emula tion. Tho threat, was of no avail, and he kept his word. But a hemlock shanty furnishes little fuel ; the bodies were only scorched, and his funeral was still upon his hands. Ho finally paid two bravadoes from Lockport to bury them where they lay. Thoy were howl ing drunk, and full of blasphemies. Roth went back to Lockport aud died the next night. That closed the tragedy. With all bis taitnts, Mr. Roebling, as a doctor or undertaker, was not a success. f?icark (A.?/..) Advert!** :'.
