The So promo Court in tho early days a ter the war held that the money l olongod to tho claimants. The loyalty test statuto barred practically every Southorn man interested. Tho loyalty lost was removed by Congress in 1905. E. H. Abrahams, attorney for the claimants, announced the decision of tho court of claims to-day. Will Take Appeal. Washington, Feb. 6.-An appeal to the Supreme Court probably will be taken hy the government from a decision of the Court of Claims which awards $251,502.28 In four cases of cotton sei.zed after thc close of the Civil War. Tho Lamar cases aro regarded as unique j because the corporation involved was I lor med after the war started, with \ (lu? ?iuuouneed purpose of purchasing I cot ion to be run through the block j ade. thereby hindering the defense of Ibo Union, lt was argued that tho corporation has no standing in a 1 ''lilted States Court, differing In that respect from a private individual whose colton was seized after the dose of hostilities. The Court of Claims' decision enunciates the prin ciple that recovery may he had where tho seizure took place after June I, '. The Supreme Court has held that no rocovory can he had in stich cases. It was In the seizure of Confederate cotton that the claims of individuals arose, the collectors admittedly appropriating much staplo belonging to individuals, which tho treasury specifically had ordorod should not he disturbed. As only about $5,000,000 was ever turned into the treasury for the cot ton, that is the maximum which can he recovered before tho court, under the terms of the law permitting coin pen: ilion for the seizures.
