That lt shall be unlaw ful for any person or persons to cut or mutilate trees on any streets ol' the town without permission. Section li. That it shall be unlaw ful for any person or persons to hitch horses, mules or other live stock to any shade tree on the streets or sidewalks, or otherwise permit ting any act which ls calculated to injure said trees. Section l. That il shall he unlaw ful to leave melon rinds or other trash on the streets. Section 6. Whatever renders tho soil, water, air or food impuro or un wholesome, is declared to be a nuisance and illegal, and every Jier 80n aiding in creating or contributing lo tho sanu'. or who may support, continue or permit any ol' them shall be deemed guilty of a misdemeanor. Section 2. No refuse fro in houses, stores, factories or any building which ls deleterious or injurious to health shall ho accumulated, thrown or emptied or in anywise deposited upon any Of the public stree!*; or va cant lots within the corporate limits I of tho Town ol' Walhalla, unless tho I same ?hall ho properly removed front public street or vacant lots, and said place and contiguous surface properly disinfected once in every 2 I hours. Section 5. Tho owner of every (welling house in the Town of Wal lalla shall provide tho person occu lting the same with a convenient, suitable privy, either surface or sewer. No surface privy shall be within ten feet of a drain or within fifteen feet of a street or within twen ty-five feet ol' a well or spring of water. All privies, public and pri vate, shall be so protected from view as not to offend thc public, eye. Section fi. No person shall bury any privy deposit or any other offen slve matter on his premises, nor per mit it to be done. Section 7. The Town Marshal shall have all surface privies cleaned out and limed every week from .lune 1st to October 1st. and once In every two weeks from October 1st to June-1st; and he shall personally inspect such work as often as possi ble, and at once upon lodging of com plain Tin bis hands of failure to clean properly and as required. Section 7-A. That any person hin dering, obstructing or interfering with the Town .Marshal in the dis charge of the duties required of him by and under the provisions of this Ordinance shall be deemed guilty of a misdemeanor, and upon conviction shall bo punished by Hue or imprison ment, at the discretion ol' the Mayor, or Aldermen, within the limits of his or I heir authority. Section S. All persons occupying the premises shall pay the Clerk as sanitary dues the sum of twenty-live cents jier privy per month, payable quarterly on the first day of January, April. .Inly and October. Section u. IO very householder or head of a family in a house wherein any ease ol' infectious disease may occur, shall report the same to the Hoard of^>lealth within twelve hours of his first knowledge of the nature ol' such diseases, and until instruc tions are received from, the said Hoard of Health, shall not permit any clothing or any article which may have boon exposed to infection, to be removed from the house. Nor shall any occupant ol' any such In fected house leave his abode or resi dence without the consent of tho said Hoard ol' Health. Section 10. lt shall be unlawful for any person to spit upon any paved sidewalk within the corporate limits of the Town of Walhalla. Section ll. All beef cattle shall, liefore slaughter, be brought in front of City Hall and there be Inspected und approved by,the Marshal or some one in his stead. Section 12. That every animal so inspected and approved shall be" kill 3d within twenty-four hours of said inspection: Provided, that animals may be inspected on Saturday's to bo killed on Monday. Section 13. No animals shall be inspected between the hours of t> p. m. and fi a. m. of any day. Section l i. No animal rejected upon inspection shall be killed, and the meat thereof offered for sale within the corporate limits of the town, and any persons who shall kill the rejected animal and offer the meat thereof for sale within the cor porate limits of the town shall be guilty of a misdemeanor, and on con viction shall be punished by Impris onment, with or without hard labor, lor not less than ten days nor more than thirty days, or pay a fine of not less than ten dollars nor more than one hundred dollars. Provided, Tliat nothing in this section shall be construed as ap plying to dogs belonging to any party or parties passing through the Town of Walhalla. Section 4. That it shall he unlaw ful for a bull dog or any other vicious dog, or stock of any kind, to run at large within the corporate limits of the town at any time. Section o. That all dogs In the town must be registered and number ed in the office of tho Clerk of the town, and the owner of every dog shall provide a collar upon which the number of the dog shall be stamped for identification. All dogs in town now must be registered by the 1st, day of 'March, lil IS, and 'any person coming into possession of one after that date must have lt registered and collared within five days. Any dog found on the streets not collared and numbered shall be taken up by the Marshal and be liable to be shot, at the discretion of the Mayor. That for said registration and numbering, the I Clerk shall collect a fee of ll Tty cents ? for each and every dog. which fee shall be turned into the Treasury of the town as general funds. Section fi. That any person, or per sons, violating any of the provisions .of this Ordinance shall be liable to arrest ?ind fine, or imprisonment, at ' the discretion of the Mayor, within ! the limits of his authority. De lt Ordained by the Mayor and Aldermen of thc Town of Walhalla, in Council assembled, and by author ity of the same: Section 1. That it shall be unlaw ful for any person to be found drink ing or drunk in the Town of Wal halla, whereby the peace and good or der of the town may be impaired, or thc convenience of other persons In terfered with. Section 2. That it shall be unlaw ful for any person to commit an act of public indecency on a street. Section S. That any person con victed of keeping a disorderly house within the limits of the Town of Walhalla shall, upon conviction of such offense, be fined a sum not less than $2f> nor more than $f>0, nnd the owner or lessee of any dwelling house or other building, situated within the said corporate limits, who lets or sub-lets any such dwelling to any person or persons to he used as a bawdy house or house of prostitu tion, shall, upon conviction, pay a fine of not less than -$.ri nor more than $30, for every day upon which such house or building shall be used or kept, and be otherwise punished within the discretion of the Mayor, Within the limits of his authority. k Section 4. That any person or persons who shall be guilty o? light ing, rioting, using profane language or other disorderly conduct within the corporate limits, shall be punish ed as for a misdemeanor. Section 5. Whosoever shall wilfully abuse or cruelly treal?' any horse, mule or other animal or beast of bur ilen, shall, upon conviction thereof, suffer imprisonment for not less than ten days or pay a fine of not less than $ 10. Section fi. That the Marshal is au thorized to arrest any person lound on the streets bo tweed 10 o'clock p. m. and 5 o'clock a. m. who cannot vive a satisfactory reason.for such presence on tho streets during these hours. Section 7. Thal all places of busi ness or amusement must be closed on the Sabbath, except drug stores for the salo bf drugs only; livery stables, restaurants, shoe shine stands; and meat markets and Ice dealers may open until !> o'clock a. m. for deliv ery of meat und ice; and also dealers in gasoline am) auto oils shall he permitted to Boll and deliver gasoline or other auto oils. Section 8. That, any person found loa ling Ort the streets of Walhalla, having no visible means of earning on honest livelihood, shall be deemed a vagrant. Section 9. Section ll. Thal lt shall be unlaw ful for liny person or persons to ope rate, within the corporate limits ot the town, any Blot machine or punch board of any kind or make whatso ever. Section 12. No person or persons shall Interfere with a 'Policeman In the discharge of his duty. Section 13. No person or persons shall keep, or permit to be kept, on their promises any placo where gam bling is permitted or encouraged. Section 14; That -any person keep ing or occupying a house where riot ing, boisterous or disorderly conduct occurs shall bc liable to Hue or im prisonment, at the discretion of the Mayor within the limits of his au thority. Section 15. That any person or persons drinking spirituous or intoxi cating liquors on any street or public place within the corporate limits shall be guilty of a misdemeanor, and sub ject to punishment, nt the discretion of the Mayor within the limits or his authority. That it shall be unlaw ful for any person or persons to light, or shoot or to advise, aid or nhjat In tho lighting or shooting of any llre cracker, cannon cracker, Hornau can dle, skyrocket, torpedo or other tire works of any description within tho corporate limits of the Town of Wal halla: Provided, however, That be tween the ho"rs of 7 o'clock p. m. on the 24th day of December and ,12 o'clock p. m. (midnight) on the 25th day of December of each and every year, it shall not be unlawful for a person, on his own premises, to shoot any of the aforesaid fireworks, ex cept cannon crackers or lire-crackers measuring more than one-half inch in diameter and three iijchcs in length. Section 17. That any person or persons violating any of the fore going Sections of this Ordinance shall be deemed guilty of a misdemeanor, and punished, at the discretion of tho Mayor within the limits of his a\i thortt. Au Ordinance to Establish Fire Lim its lu the Town of Walhalla. De lt Ordained by the Mayor and. Aldermen of the Town of Walhalla, in Council assembled, and by author ity of the ?une: Section I. That fire limits he es tablished in the Town of Walhalla, on Main street, on both North and South sides thereof, between Ann street and Tugaloo street; that with in said limits no new house shall hereafter be built of wooden mate rial, and no additional room or rooms shall be built of wood ?to any house now standing within said fire limits; Provided, however, That a piazza cov ered with slate, tin, zinc or gravel, may be added to any dwelling house erected within snld tire limits. Section 2. That all buildings here after erected within said fire limits shall be built of brick or stone and covered with slate, tin, zinc or gravel. Section 3. That no building or buildings constructed of wood of any size or dimensions shall be built or erected within two hundred (200) feet, of either side of Main street wit bin said tire limits. Section 4. That before any build ing of any character s baliche erected, altered or repaired within said fire limits, a plan thoreof stoall first . be submitted ?to tho Town Council for approval. Section f>. That any huilcling or structure erected within said fire limits contrary to the provisions of this Ordinance, may be abated and removed by thc Town .Council as a public nuisance at the exponse of the owner, >r owners, of said property. Section 6. That any building or structure erected within said fire limits, a plan thereof shall first bo submitted to the Town Council for approval. Se dion 7.
