Spartan burg Attorney Answers Ques tions Asked by Dr. Carlisle 1 News and Courier. ) Hov. Mark H. Carlisle, Greenville, c Dear Brother: I have just lead your open letter to Kev. S. A. Nettles, copies ol which you have furnished lo the daily papers of the State, asking hy what authority lo bas resumed thc -editorship of the Southern Christian Advocate. As you have sought information in this way, as ono of Mr. WHles's legal ad visers ti the matter. I gladly give' von the information il von are really , ignoran) In the matter. The ron traci which he has willi the South Carolina Conference nol only gives him full an<l complete nu t buri ly lo od't thc Advocate, bul makes n his legal bounden duly lo do so. This was Hu1 opinion given to him h\ Judge Purdy and myself ns his legal advisers; of its correct ness lhere is no question or doubt. Some years ago, as von doubtless know, thc conference placed the af; fairs of the Advocate in the hands of j a large publishing committee, with tull power to elect th?- editor and cont rael for its publication. In 11)12 , an effoi I was made to overthrow ti.is com mil tee. lt Failed, and tho con ference overwhelmingly endorsed the rom m i Hoc and Mr. Nettles's manag?'- ; ne ut ol Hu paper In the following .spring the publishing committee re elected Mr. Nettles editor and pub lisher of the Advocate, and entered Inti) a written contract with him to (hal effect, secured Oil his pari by his Pond for $10.000. The commit tee acted upon the authority of the conference and heine in law and fact the act ol the committee was the act of the conference. Unable to secure I lie cuni roi of the Adv?cale in this upright and open manner, it seems thai sonic partie- entered Into an un holy conspiracy lo secure it^ control by ruining the reputation of it> edi tor. For decency's sake | will say nothing here and now of the mei hods employed and the men behind them. Perhaps von >lo mu know some of (hem. I will sa.\ I his much, how ? ver- I know this case from begin ning to end. I have practiced law for over HO years; and in all thal time I have never known -i case, ei Ihcr ill the civil or criminal courts, where such methods have ever been attempted, or would have been toler ated l>v the hench or har. By such methods he was convicted, and be bas served his sentence as imposed. The nighest courts ol our church have adjudged that the conviction I WHS illegal and the punishment un merited. The College of Bishops voluntarily held (hal thc hearsay evi dence on which he wis convicted could not bo entertained in any church court. The court of appeals b^'ld that ns matter of fact he was no? guilty of th? falsehood charged against him, and as io the Impulsive nels alleged as improprieties that 1 ibi-y were not serious enough oven io give o i he cou ri t be jurisdiction j Io place him on trial. There ma.v be sunn- wno are ignorant of the facts.' and with Hie arrogance of Ignorance may think the) kno?\ more of Hie I truth than lite conns which heard tho ev id< m e. or with an overweening assn ni pt ion of sanctity may assume that limy are holier than the judges who sal lu those courts. These may prefer to believe him still guilty. There may he others who see the farts through the putrid lenses of their own malignant souls and still profess to believe hun guilty. !.. them ali.ne; mt one cares for their good or had opinion.- I am glad to know thal you arc nol of t li is kind and do not question the just ness ot his acquittal. This being so. he stands a t guiltless before Hie church as you or any other of ;i ministers, 'and, therefore, we have advised him. there is no reason why the church should not carry out its contract with him. and no ex? use for his not earrylng out his contract with thc ch li i ch. The "resolution:." in th - confer ence, of which you boast the pater nlty, afford no such reason or ex '.use. A valid contract, legally en tered lalo by a Christian church ls al feast binding upon it as it would bo upon the sinners and the ungodly. What power of justification had you or the conference to violate this written agreement? Had Mr. .Net tles been guilty of crime, he migh* have forfeited lils rights under his cont rael. Bul yon declare you In tended to violate the contract and deprive him of his rights under lt, whether he was innocent or guilty. 11} what authority or rule of right eousness could you and your follow ers induce the Bishop to try to vio late the laws of the land and disre gard the legal contract of the church? If yon were the author of those reso lut ions, and misled a majority of the conference into attempting such an act, it is small subject for boasting. And your attempted action was as much in violation of the laws of our church as it was a violation of the laws of th?> State. You say that you believe the expressed will of the con ference should he obeyed. That de pends on how that will 1 as been ex pressed. The appointing power in our cnn ich, as you well know, rests entirely with the bishop and his cab inet. The conference has no legal right or power to dictate whom he shall appoint or not appoint to any work connected with Hie church. The only time when i he permission of i he church is necessary is when the Bishop desires lo appoint a preacher lo work outside our church. li is true that Hie conference can entertain a complaint against a preacher for ' unacceptablencss," and your "resolutions'' to have had the semblance of legality, must have been construed 'o he ot this nature. But 'he church law expressly provides thal in all such complaints the church shall investigate the case, and thai the accused minister "may defend himself in person or hy rep resentative." Tim law is further laid down in McTyeire's Manual. page I.">i!. This should be conducted with the formality to guard against hasts and unjust action, lt must not res' entirely upon opinions ?ind sentiment, hut the complaint of inaccpetahle ness .... should he set forth with sufficient allegations of fact and proofs to give the accused an op portunity to make his defense and tr the conference a sale basis of judg ment .... the testimony taker should look, not only to the fact ol unacceptability, hui to the cause." The record shows that in pushim through these resolutions you obeyoi none of these fair and just require monts. Von mendy charged tha there was opposition to him. and die not even allege thar such oppositioi was just. When he asked to he hean in his own defense, this clear lega righi was denied him- you con detuned unheard! Not a particle o proof appears to have been laid lie fore i he conference to sustain th complaint; the resolutions wer passed entirely on "opinion and sen liment." The law expressly ino vided that testimony should be ot fe red as to the cause, if proof ha been made before that conferenc 'hat the charges against Mr. Nettle were false, and had been brough igninsl him in order to secure th control of ibo Advocate by rillnill his reputation, do von really thin Ilia) Hmso resolutions would eve have been passed? Would they have been passed h the very men who a year before lia inven him their hearty support an endorsement? No. Dr. Carlisle, voil Clink so you do the noble me of our conference <rave Injustic* Most of them want only what is rigl and inst and Christian Those res? lutions were unlawful in their pu pose, unlawful in the methods I which the) weir- passed, adopted Ul der a misconception of the facts an are bindii.g on no one, either in la or in conscience. No bishop ne< tremble at your threat If he dlsobe; your resolut ions. But this is nol a question of a pointnienl b) the bishop. The ed tor-hip of ?he Advocate, like ll presidency of Wofford College, whl church work ls not necessarily tl work of a preacher of tiie eorifMenc ]' could legally be done hy a loc preacher or by a layman. There no law against it. When Mr. Nelli was suspended he employed a te; porn ry edPor to do his work. Wit? his illegal conviction was reversed was restored to .ill tin; rights lu- e joyed before his trial. Those rigl are clearly defined by the cont rn entered into with him hy his COU fi once through their publishing co mitte,-, ii ivas no' necessary f hitn ?o no back to them to seen these rights afresh, nor lo the ci few ; fe, nor lo the bishop. His rip lo dit and publish the paper so lo as he is a preacher in good stand! i-> n established right, protected a s lenin agreement made with h by his conference, in reliance uji which he has spent large sums uione' . Unless he voluntarily s renders them he cannot legally righteously be deprived of thom tu the end of his contract. It ls regr table that any member of the c< terence should seek or desire to so. when it could only he done in \ latlon of the laws of the State r tho obligations of the church, h of which are based upon the laws of morality. I have given you tho authority by which Mr. Nettles ls the editor of the Advocate. As I have said before, contracts are as binding upon the sons of (5<>d as upon the sons of men. Doubtless you knew this, but forgot it. Von should also have known' the Church law. You have been a presid ing elder. If you did not the discip line w;u before you, and you could have learned it there mon? readily and accurately than hy applying to the general public for information in the matter. Very truly von rs. Wm. M. Jones. Of Counsel for Kev. S. A. Nettles. Sparenburg. June I, 10 14. Dr. Carlisle Renews Hostilities. (So. Christian Advocate, June 11.) We publish on the next page a communication from Dr. Mark H Carlisle, questioning our right to re sume the editorship of the Advocate: and, also a reply from Wm. M. Jones, our counsel in this matter, giving the information asked for. Dr. Carlisle sent this letter to tin Advocate for publication. We wrote him as follows: .Dear Kroti ' Your letter ol* June I was received yesterday. lt is my desire thal the hostilities in our conference shall cease. i am sure that the laymen and many of the preachers -hare with me in the de sire for peace tor : lie church is be ing hurt hy this strife. I am deter mined if the light is to he opened up again i: shall be by those on he other side, and they and not I or my friends, must hear the blame for tin continued bitterness. The hoard of managers has deemed il unwise Ilia' there should lie any further discus sion of this matter in the columns ol' the Southern Christian Advocate However, I take pleasure in giving you personally the reasons for my action and theirs." And we gave him briefly the same reasons given hy Mr. Jones in his answer printed nu the next inigo. lint without waiting to hear from us. and before the Advocate was pub lished. Dr. Carlisle furnished copies of his letter to the leading daily pa pers of the Slate, with request for publication! Such a course on his part naturally raises the question in the minds of an honest public, whe ther Dr. Carlisle was really seeking light, or trying further to injure our reputation. Seeing that the matter has thus i been dragged before i he public, then j seems no reason why the readers of tho Advocate, who are Methodistsand interested in its welfare, should not he informed in regard to the matter. Any hurt to the church bas already beeu done. lt is not anything that we had to 'ear or anything that we had to conceal for our own sake that has caused us to wish fe*- peace; hut solely for the good of the church and Master whom we serve. Our enemies have done our reputation all the harm they could. The more light that is turned on, the more clear does my vindication appear. Km for the sake of the church, il is with re greal that we again see the matter reopened in ?he public press. "Tiz" SOOTHES som:, TIRED, SWEATY PK KT. Ah! what relief.
