(Anderson Mail, 12th.) J. Oscar Mitchell, who until about two years ago was engaged in the mercantile business with John F. Acker, on Earle street, died very suddenly yesterday at the Wilton E. Lee home, Ave miles northwest of this city. Mr. Mitchell, who lived in the Den ver section, was driving to the home of MTS. Eskew. Arriving at the Lee place he decided to stop and change buggies. After driving up In the yard and making known his wishes he complained of having a headache, sind asked if he could get a-tablet to relieve the pain. Mr. Mitchell then went Into the Lee house to take the tablet. As ho was walking to the faucet to draw some water to take with the medicine he dropped to the floor and exnired. Mr. Mitchell was about 35 years of age and leaves a young wife, who was Miss Hombree, and two small children. Tue funeral services were held at Salem church this afternoon at 3.30 o'clock, being conducted by Rev. D. vV. DodgA, pastor of the Cen tral Presbyterian church. Carlile Courtenay, who last winter organized the Colonial Heights Baptist c -uren and has since been its efficient find beloved pastor, tendered his resignation at a confer ence of the church after last night's service. Rev. Courtenay's reason for resigning was that his work in con-, nection with the Baptist orphanage consumed so large a part of his time that he could not devote enough time and energy to the duties of pastor of the church. He announced that he would retain his membership in the church and would co-oi>erate with lils .successor in its upbuilding, and his resignation was reluctantly and re gretfully accepted by the congrega tion. Rev. Courtenay will remain as pas tor until his succe?uor ls definitely decided upon, Resolutions of appre ciation for hi3 work since the organ ization of the church and regret at his resignation were unanimously adopted. Washington, May 12.-R'>> resen tative H. Olin Young, of iBhpemlng, Mich., announced In a speech In tho House to-day his intention ef resign ing his seat. He discussed the con test Instituted by Wm. J. McDonald, a Progressive, saying 458 votes in tended for McDonald had not been counted for him and he. did not feel justified in holding his seat. Young was a canidate on the Re publican ticket. The State board of canvassers Issued a certificate to Mr. Young, declaring he had recelvod an apparent majority of 281, after 468 ballots cast by mistake for "Sheldon William J. McDonald" had been thrown out. Mr. Young declared the 458 electors Intended to vote for Mc Donald and that he did not feel justi fied in holding the seat. "I am now convinced," said be, "that if the 4f S .otes in dispute were counted for ti. > contestant the ver dict would not be In my favor. I am convinced that those 458 electors In tended to vote for William J, McDon ald, and while under the law be is not entitled to these votws, I. do not caTe to "hold a seat that may be ques tioned by honorable and disinterest ed men. I therefore have prepared my resignation and will forward lt to tho Secretary of State of Michigan and will file a copy with the speaker of the House." Negro Roys Get New Trial. (Columbia Record, 12th.) ' A new trial was ordered to-day by the Supreme Court in the case ? of Harry McIntosh and John Williams, two negro boys who were convicted of killing Andrew Jackson, a little white boy, In the city of Florence. The two negroes had been sentenced to die in the electric chair. The de cision was written by Associate Jus tice Hydrick and concurred In by the en th e court. The body of young Andrew Jack son was found in an empty box car on the repair tracks at Florence on March 8th of last year. Circum stances indicated that he had been I murdered. The shoe tracks of a man wore touiid leading to and from the car. Se\ eral days later four negro boys, Wi liam Foxwortb. Freddie Mc Intosh, Harry McIntosh and John Williams, were arrested on suspicion. Freddie Vlclntosh and William Fox worth made statements to the sheriff Implicating Harry McIntosh and John Williams, which statements were re duced to writing and signed by the two boys. These two were used as witnesses for the State, but when on the stand Freddie McIntosh denied j his statement and charged that it had I been obtained under duress, which the sheriff denied. The statemei is i were admitted, and the Supreme Court holds that the lower court i erred In admitting it. School Children Try to Lynch? New York, May 12.-Streets around public school No. 14, in Brooklyn, were black with children just let out for luncheon to-day, when an automobile truck became unman ageable and charged a group of lit tle girls. Mabel. Balmer, aged 10, was killed and Marcella Kelley, aged 4, was fatally hurt. Led by a few grown-ups, the children attacked O. L. Mount, the chauffeur, and were threatening to lynch him when po lice reserves rescued him. Columbia, May 12.-Assistant At torney General Fred H. Dominick will file a brief In tho Supreme Court 'here to-day in which lt will be con tended, on the part of tho State of South Carolina, that under the Webb law recently enacted by Congress, as applied to the liquor laws of this State, no shipment or whiskey into this State ls legal except it be to a dispensary. "But for the protection of the in ter-State commerce clause," says the Assistant Attorney General, "there is only one method of lawfully ob taining, receiving and possessing li quors in the State of South Carolina, and that ls by purchase from a coun ty dispensary for a lawful purpose. All other liquors are deemed and ex pressly declared to be contraband and may be seized without warrant." The brief contends there ls ample authority as to the right of the State to pass and enforce such a law. "Now that thia 'protection," (the protection of the Inter-State com merce clause), the brief concludes, "has been withdrawn by the Webb act/ the State laws apply equally to shipments from without the State as well as to * shipments within the State. The brief points x>ut that lt is now unlawful to ship liquor from one point In the State to another point in the State, and that shipments from without the State, even for personal use, are now only permitted under tho protection of the later-State com merce clause, which protection ls now withdrawn, the Assistant Attorney General contends, by the Webb law. The brief is flied on behalf of the State of South Carolina In the case of W. W. Atkinson, plaintiff, against Southern Express Company, which will test tho effect of the recently en acted Webb law. Should the contention of the As sistant Attorney General on behalf of the State be sustained, it will mean that even bona fide "personal use" shipments will be illegal, and the only way to get whiskey In this State will be to buy it from a county dis pensary in person. Vnderson, May 12.-A homicide with horrible dotr?"s happened near Antreville, just across the line in Abbeville county, yesterday after noon when John Hill used a razor on Enoch Ball, cutting Hall in the neck, almoBt severing his head from his body. The Jugular vein and the wind pipe were cut in twain, and the head was held on the body only by a few shreds of flesh. It is said that Hill was being chased by Hall, following a quarrel. Both men had been drink ing. Hall got pretty close In behind Hill when the latter drew his razor and bpgan carving Hall on the neck. Hl'l 'lias been lodged in Abbeville jail. Both are negroes. The Southern Power Company was very busy around Here last week cleaning the right of way for their electric Hues. This will pass several I hundred yards to the north of Rich land. The hands and overseers are camping near Richland Creek. If they continue as well as they did last week they will nearly finish the sec tion this week. Montreal, May ll.-The fate of the Titanic was narrowly escaped by the steamer Chiltern Range in a col lision with an iceberg to the east of Newfoundland Banks on her voyage from Hull to this port, Where she ar rived to-day. The bow plates of the steamer, a British freighter, were badly dented. The berg was struck In latitude 46.39 north and longitude 4 4.40 west, in the track of the ocean liners, but some distance to the north and east of the spot where the Titanic met her fate. Aftea the collision ??e steamer was surrounded by Icebergs, which, although they could not be seen because of the fog, evidenced their presence by the echoes that re sounded from their towering sides at every blast from the steamer's whis tle.
