Wo learn from thu " Montgomery Mail," that Judge lliee, of that city, has made a per sonal test pf the practical ,-aluo of tho Presi dent's Amnesty. Not being able, in eon sc. quenco of olllcc-holding before tho war,' to tilico the oatli of registration until now, when, on thc strength and authority of tho Exccu live proclamation, bc took tho oath therein prescribed. Under that oath Judge Rice offered to reg ister, and will ofter likewise to vote, lt is his opinion, and he stands high as a jurist, that every man supposed to bo disfranchised by Act of Unngiess can take thc oath of am nesty, ami in virtue of that oath is entitled to vote. Tito only exceptions made arc such as tho President has specified in his proclama tion. The eminent Judge holds that this ac tion on tho part ?d' individuals outlawed, by Congress entitles them to thc restoration of all privileges enumerated, and rights ol' prop- j city, except as to property with regard to slaves, and except in cases of lesral proceed ings under the laws of tho United States lie further maintains, that this Executive amnesty is superior to and independent of Congress; inasmuch as tito Constitution dele gates lite power of reprieve, and pardon to tho President, and his d?cision in tho premises can only bc invalidated by illegal and revolu tionary means.
