Considerable interest was manifested in the trial by the Town Council of Messrs. W. H. and M. B. Kelly Thurs day night on the three charges of (1) irmoderate riding on the streets, (2) riding a bicycle on the streets after be ing ordered by two members of the Council not to do so, and (3) creating a nuisance by riding a bicycle on the street the 20th ultimo. George B. Cronmer, Esq., appeared for the young men, an.d copducted their defense. The charge was narrowed down to the question whether riding a bicycle on the streets were a nuisance. Messrs. B. J. Ramage, J. W. Gary, 0. P. Saxon, E. M. Evans, Griffin Dorroh, Griffin Williams, and others, testified that a bizycle is calculated to frighten horseis, though they had seen no horses frightened by them, except that one of the witnesses said he had seen a gen teman attempt to ride his horse up to one, but the horse refused to go near it. Charley Dawkins, colored, and another witness testitied that on Saturday, 24th ultimo, they saw a horse, attached to a buggy in which were two ladies, so frightened by a bicycle that he attempt ed to run, and would bave run had not the witness Dawkins caught bold of the bridle. On the part of the defense Mr. W. H. Clark testified that be had seen bicycles ridden frequently on the streets of Bos ton, Sprin'gfield, Worcester, and other New England. cities and towns, and the municipal authorities of those places made no eft'ort to prevent it. The de fendants testified that they had ridden the bicycle on the street at intervals since June or July; that they had heard of no law or ordinance against it; that Werden Ijibler, the 26th, told Mr. WV. W. Kelly not to ride it again on the street, at the same time saying there was no ordinance against it; that Intendant Pool bad told Mr. M. B. Kelly to sus pend riding it on the streets. The defense insisted that as to the irst charge there bad been no proof of immoderate riding; e a. the second that as there was no ordinance against riding bicycles on the streets; the order of one or of two Councilmen not to ride was no more than an order of a private citizen, and a disobedience of such order was no violation of law ; and as to the third that to prove bicycle ridinu~ on the streets a nuisance it must Various and all About.
