South Carolina, That all alcoholic | liquors and beverages, whether manu- jfactured within this State or else- * where, or any mixture by whatsoever name called, which if drunk to excess * will produce intoxication, are hereby declared to be detrimental, and their P use and consumption to be against the P morals, good health and safety of the State, and contraband. That it shall , be unlawful fpr any person, firm or corporation or association within this State to manufacture, sell, barter, ex- j* change, receive, accept, give away to induce trade, deliver, store, keep in , possession in this State, furnish at public places or otherwise dispose of any spirituous, malt, vinous, fermented, brewed or other liquors and beverages, 2 or any compound or mixture thereof which contains alcohol and is used as ? a beverage, and which if drunk to excess will produce intoxication, except as hereinafter provided. r Section 2. That wholesale druggist* ? may lawfully sell in wholesale quanti- ? ties to retail druggists and to public 1 or charitable hospitals or to medical P or pharmaceutical college, and in no 2 other way, pure alcohol for medical purposes only, or grain alcohol to be used by chemists or bacteriologists actually engaged in scientific work and ? for such purposes onlj, and such wholesale druggists shall at the end of . each month in which any such sales have been made, file with the clerk ? of the court of the county in wnicn z they do business, a statement in writ- g ing under oath, giving the name of f the purchaser,* the price paid, the date of sale, and the quantity and F character of the alcohol sold. That if said wholesale druggist making such sale is not a resident of the State of South Carolina, then such statement u shall be filed in the office of the clerk ^ of the court of the county in which the purchaser resides. Section 3. That any retail druggist whose place of business is located in any of the incorporated towns or cities , of this State, who is himself a register- t ed or licensed pharmacist, or who , regularly employs a registered or t or licensed pharmacist, may sell, in the manner herein set out, upon , filing a bond in the sum of five thous- v and . dollars, to be approved by the clerk of the court, in which such druggist does business, conditioned for a ' faithful observance of the provisions Q of this Act, such bond to be'approved " by the clerk of the court, pure alcohol for medical purposes only, grain alco- = hoi to chemists and bacteriologists actually engaged in scientific work, and for such purposes only and wine to be l used for sacramental or religious pur- t poses only: Provided, That nothing herein contained shall prevent such druggists from U9ing alcohol in the J compounding of prescriptions or other medicines, the sale of which would not subject him to the payment of a T special tax required of liquor dealers by the government of the United j States: Provided, further, That nothing herein contained shall prevent t such druggists from compounding or g selling medicinal preparations manu- " factured in accordance with formulas j prescribed by the United States c ,, "Pharmacopaeia and National Formu- r lary which contain no more alcohol c than is necessary to extract the medi- c cinal properties of the drugs contain- c ed in such preparations, and no more ( alcohol than i9 necessary to hold the medicinal agents in solution, and c which are manufactured and 9old as " medicine, and not as a beverage. ? Section 7. That it shall be unlawil to sell wine for sacramental poroses except to a minister, pastor, riest or regularly constituted officer f a regularly organized religious ongregation or church. That all statements or rescriptions required by this Act to e filed in the office of the clerk of the ourt shall be recorded and properly idexed by him in a book kept for that urpose, whicn shall at all time9 be pen for public inspection, and a cerified copy of such record, or the riginal statement or prescription, rith the certificate of the clerk of the ourt- indorsed thereon, showing that b ha9 been recorded, shall be prima acie evidence of the facts recited herein. For making such record, the lerk of the court shall be entitled to harge and collect for each prescripion a fee of five cents, and for each tatement, other than prescription a ee of fifteen cents, which, shall be aid by the party filing the same. Sec. 9. That in addition to the retirements hereinbefore prescribed, ,11 li sensed and registered druggists elling alcohol by prescription 9hall :eep a record thereof, which shall iear the true dates of the sales, the >ame9 of the persons to whom 9ales pere made, the names of physicians r surgeons upon whose prescriptions iach were made 9uch records shall >e subject at all; times to the inspeci^n of the solicitor of the district, he sheriff and other peace officers of he county, the mayor and police officers of the city or town in which said icensed and registered pharmacist's business is located, and all other perons, and each druggist making any mch sales shall be required to report, mder oath, to the Circuit Judge preiding at each term of court of the :ounty in which said druggist is engaged in business, a true statement of uch facts, and also file on Monday norning of each week a list of the altohol sold by him, to whom ?old and >y what physician prescribed, with he chief of nolice and the mavor or I ntendent of the municipality, and >ost one copy in some public place in mch municipality. Sec 10. That nothing in this Act ihall prevent the sale of wood or delatured alcohol. Sec. 11. That any person who vioates any of the provisions of this Act hall be guilty of a misdemeanor, and ipon conviction thereof be fined in a um not less than one hundred dollars lor more than five hundred dollars, or mpri9oned at hard labor for a period >f not less than three months, nor for nore than one year; and for the sec>nd or any subsequent offense, upon jonviciion thereof, shall be impris>ned at hard labor for not less than me year nor more than five years. Sec. 12, That any druggist or phylician who violates in any way the >rovisions of thi9 Act shall, in addiion to the punishment herein prodded, have their license revoked for i period of not more than one year or each offense. Sec. 13. That this Act shall not lave the effect of preventing the inlictment, prosecution and conviction f any person who has been guilty of he violation of the present criminal aw relating to the dispensary or punshment therfor, as now provided by nr. nffanofic Vinvotrifnro ?? This Act 9hall take effect n the first Tuesday in August, 1909: Provided, That in the counties then aving dispensaries an election shall e held on the third Tuesday in Augst, 1909, for the purpose of determinig whether the dispensaries located herein shall be reopened, and such lection in each of said counties shall e held and conducted by the same fficers and under the rules and reguitions provided by law for general lections, Sec. 15. At such election the elecon commissioners for such county i iall at each voting 4precinct therein rovide one ballot box in which the allots must be cast. Any person ho is a qualified elector of such coun/ may vote in said election. Every oter who may be in favor of the sale f liquors and beverages in such counes shall cast a ballot in the box proided therefor, on which shall be rintedthe words, "For sale and manfacture of alcoholic liquors and bevrages," and ever}7 voter opposed iall cast a ballot upon which shall be rinted the words, "Against sale and lanufacture of alcoholic liquors and everages." In case an election as erein provided shall result in favor f the sale of liquors and bevergaes, le dispensaries in each county so 3ting shall be reopened and conduct j unccr the provisions of an Act en ti i r c I n EL ??? 919 Cervais St. ?3 rfv I 1 _ t* ne No Everything f( guarantee to sax Call to see us wh A I 919 GERVAIS ST., titled "An Act to declare the law in reference to, and to regulate the manufacture, sale, use, consumption, possession, transportation and disposition of alcoholic liquors and beverages within the State, and to police the same," approved the 16th day of February, 1907, and Acts amendatory thereof: Provided, That all the provisions and limitations of the said Act not inconsistent with this Act shall remain in full force and effect in ail of the counties of this State: Provided further That in counties which shali reopen dispensaries therein, the county dispensary board and dispensers in office on June 30, 1909, shall continue to discharge their several duties as if such dispensary or dispensaries had not been closed: Provided, That in the counties which have heretofore voted upon the question of dispensary or no dispensary under existing or previous laws and have no dispensary at this time, shall have the right at any time after the expiration of four years from the last election on the liquor question to hold an election upon the question of dispensary or no dispensary, as provided in an Act entitled "An Aot to declare the law in reference to, and to regulate the manufacture, sale, use, consumption, possession, transportation and disposition of, alcoholic liquors and beverages within this State, and to police the same," approved February 16, 1907. Approved the 2nd day of March, A. D. 1909. Before the hour fixed for opening the polls Managers and Clerks must take and subscribe the Constitutional oath. The Chairman of the Board of Managers can administer the oath to the other members and to the Clerk; a Notary Public must administer the oath tn the Chairman. The Mana gers elect their Chairman and Clerk. Polls at each voting place must be opened at 7 o'clock a. m. and close at 4 o'clock p. m-, except in the City of Charleston, where they shall be opened at 7 a. m. and closed at 6 p. m. The Managers have the power to fill a vacancy, and if none of the Managers attend, the citizens can appoint from among the qualified voters, the Managers, wTho, after being sworm, can conduct the election. At the close of the electon, the Managers and Clerks must proceed publicly to open the ballot boxes and count the ballots therein, and continue without adjournment until the same is completed, and make a statement of the result for each office and sign the same. Within three days thereafter, the Chairman of the Board, or some one designated by the Board, must deliver to the Commissioners of Election the poll list, the boxes containing the ballots and written statements of the results of the election.
