Judge Simonton
Renders Decision.
Remands the Fertilizer ''Tnist"
Case to State Court. A Victory
for Mr. Bellinger.
Special to The State.
C harleston, July 21). ?in the
United States circuit court t~dav
Judge Simonton handed down his
decision in the case of the State of
South Carolina against the Virginia-Carolina
Chemical company,
granting the motion of plaintill
ft>r the remand of the case to the
State court.
The decision is a victory for
Attorney General Bellinger. It j
will lie recalled that several
months ago Attoi ney General Bellinger
brought action against the
Virginia Carolina Chemical company,
in the Ricldand county
court, under the nnti trust act,
ii - *
aueging uiut Uio jconipany was
pin chasing and acquiring a monopoly
of the fertilizer industry,
contrary to law.
The attorney for the company
moved before Judge Buchanan
for a transfer of the suit to the
federal court, alleging the act to
bo in derogation of the constitution
of the United States. The
judge refused tho motion, but the
attorneys secured copies of the
proceedings and tiled them in the
circuit court and later Judge Simenton
heard the arguments on the
motion of Attorney General Bellinger
for the remind.
Judge Simmonton's decision is
lengthy, containing many law citations.
