The Dispensary Independent of -the Revenue Laws of tbe United States, Says the Attorney. Washington, Aug. 27.?Franklin and Mackey, attorneys f< r South Carolina in the claims for rebate of wholesale and retail liquor licenses paid bv the South Carolina dispensary, today tiled an additional brief with Mr. Yerkes, the commissioner of internal revenue. The position taken by Mr. Mackey is that, independently of the constitutional question in tbe case, revenue laws of the United States hare nu application whatever to the dispensaries. The dispensary system, it is claimed, is a State institution and being such is not taxable under the revenue law. Reference is made to the section ef the revenue law under which retail liquor dealers are taxable, and Mr. Mackcy contends that the supreme court has held that the word 44person" men| tinned in the law does not include a State. - The dispensaries, he holds, are State institutions, and he says, the taxes, if payable at all, are payable by the State, which he contends is not liable to pay such a tax. Mr. Mackey further insists that even if congress had intended to include a State within the provision of the revenue law such intention would have been futile, because ever since the days of Chief Justice Marshall it has bsen held by the supreme court in repeated decision that the federal government has no more power to tax a State institution than the State has te tax an institution of tne federal government . y Lancaster county proposes to have an exhibit at the Charleston exposition some bustling will have to be done. George Howard, a member of the mob which lynched Robert White, a negro, in this county some months ago, was today convicted of murder in the first degree and was sentenced to life imprison* ment. The case was called in the Circuit Court today. After the State's evidence was submitted the attorney for the defense an . Bounced that Howard desired to make a statement to the court. Coon being sworn Howard admitted his participation in the lynching and gave the names of the members of the mob, which numbered 13. After being out almost two hours the jury returned a verict of quilty of murder in the first degree and fixed the penalty at life imprisoment. ! Howard is ene of the most prominent farmers in his section of the country. White was accused ef shooting a white man.
