The government today ordered investigation of the South Carolina riots by which James W. j i Tolhcrt, assistant post master at McCormick, it is alleged, wasl compelled by the threats of an j armed mod to abandon the oflico ! and hit) homo. With that view the matter has I been placed in the hands of United I States District Attorney Luthrop with instructions to look into the matter with a view to the prosecution of any violation of Federal statutes in this or any other cases growing out of the recent race riots in that locality. As a preliminary stop Mr Tolbert has sent a telegram to Governor Ellerbe at Columbia ask ing to know whether as governor j of South Carolina he ran and will; afford him protection iu returning! to the State. No reply has >et been received. TOLBERT'S INGEN1US TELEGRAM. Gov. Ellerbe Sends a Brief, but Expressive Reply. To all appearances it looks as if the federal authorities intend to take some action in the matter of the rioiing at Phcenix ou and after election day. The grounds for action will bo based on in terference with the United States mails. The following long telegram to Governor Ellerbe from Jss. W. Toll>ert, postmostor at McCormick, appears to be the preliminary move. It reads: 'iWashington, D C, Nov 15. "io me Uov. of South Carolina. <4I am a citizen of South Carolina, whero I was born and raised, and have always resided. My homo is ut McCormick, in the j county of Abbeville. My wife I is postmaster there, and 1 am her assistant, and conduct the otisiness of the oflice for her, she beI ing a delicate woman. On rhursI day, the 10th instant, 1 was forced by an organized ami armed mob of a hundred men to leave my family and my home under the threat that if 1 remained there I would be killed. I therefore fled for safety because 1 was un1 able to resist the mob. I am a large landownor in the county of Abbeville, and also the owner of valuable houses and other real estate in the town of McCormick. My wife is there with our only [child, a girl of four years old, ! without my presence and my protection, on account of the uction of an armed mob, and my property is without proper care. 1 have committed no crime against the laws of my country and have done nothing to give any offense whatever to any man or set of men, save that 1 am a monaher of the Republican party and believe in the doctrinee of that party. Washington, Nov. 17. ? R R Tolbert with several negroes from South Carolina were at the white house today. They were not admitted to see the President and expressed indignation that they do not have free access to the executive mansion. They called at the department of justice and tued to secure an opinion on Got. Ellerbe's telegram. Tolbert argues tbatthe Governor clearly acknowledges that the State cannot afford protection and he is trying to secure this opinion from tho government. He has not bean able to do so, however. Postal Department Woh't Act. Concerning claims of interference with the postal service, it is stated at the postoffice department that there is no evidence that the postal service has been interfered with, that officially the department has no knowledge of Tolbert, who ?s only assistant postmastor at a fourth class post office and therefore, appointed and em ployed by the postmaster and not by tho department. The postmaster is the wife of Tolbert and as she is not interfered with the department officials say there is nothing to show that the department sho dd act in the matter.? Mr Tolbert called on Postmaster , General Smith with a view to securing some action in the premU j sos, but was told of the conclusion of tho department, that there J was nothing of which it could I take cognizance.
