Carpenter at once hailed the stea iter and gave the information that the bark and cargo wm a prize. It will be reneinbered that thin Lieut. Carpenter is tin same officer that was on board the brg Dolphin, nt tlie time of the capture by her of the slave brig Echo, with over three hundred African* on board, and in that instance, as in this, was the officer who first boarded the slaver. If his sue cess in capturing slavers should continue, be wj?l he in great danger of being run by the Black K?|vubiicans for the l'resi dency^or it may be that the English Government will apply to have him sent to the Coast of Africa, that his prestige of success may have a wider and more extensive ield of operation*. He is a native of Massachusetts, and hia brother oflieers speak of linn hh a good and tuer iloriou* officer. At the time of the capture, the negros on hoard raised a loud yell in token of their pleasure, hut whether they under flood the lull consequences of the change in their condition is verv doubtful. Their condition show that they have been well tieate l on the passage by those having them in charge. The truth, as shown by the evidence iiuw be ing taken before the Coir missioner, doubt less is that the bark Wildfire sailed from New York, in the month of December last, for lire Coast of Africa, with the un deratAnding that sire was to be there sold, and the crew to get back to the country as best they could. flint she did go out, and while in the Congo K:ver, was passed over to the possession of the Spaniards, by a transfer to the Spanish agent of a house in Havana. From this lime the Spaniards assumed command and control, and the American master came back as a passenger ; and the Amer ican crew were told that they must work or have no food or drink, and that if they worked well they would be well paid on the bark's arrival in Cuba. In this state ment the entire American crew and ofli cers agree, while the Spaniards say that they were on the Coast of Africa, on the arrival of the bark in the Congo Iiiver, o?,t n?i.? ..... u?...g V. ... ?, took passage to tlit) bark aa passengers, and were such on tite voyage home ; and that the bark was navigated home by the American Captain and crew. Thie statement, however, does not tally with the claim of the Spanish Captain, when the bark v. as first captured. The prisoners have secured the servicee of good counsel, who think that the Spiuiard* must he discharged after the oxamination before the Commissioner clo sea, and that if the Americana are held lor trial that no jury can !>e found to convict them on thie evicjenca. The re1 cent decision of Judge Magralh, District Judge of South Cerolina, covers all the important points involved in tbie esse, and it is be!ieved that no single Judge would assume to overrule that able, clear and masterly exposition of the Act of 1820. It la very certain that no fair jury, North or 8outh, could be brought to convict the accused with this decision before them. 810 MA.
