E> ul '.: Ju I ? ?unt cht ' ors to Sell?heir 7?tvl and Rcrscfnal Property, and lo Confirm Sales al rendy made, in Conformity -reith (Conditions herein Specified. SECTION 1. Be it enacted by th Senate and House or Representatives of the State of South Carolina, now mot and sitting in General Assembly, and by the authority of the same, That from and alter the passage of this Ant judgment debtors may, and thoy are hereby, authorized and empowered to seli and convey any or all of their .real and personal property which muy, at the time be subject to levy and sale to satisfy any judgment or d??ree of any Coy ri in this State against the said debtor, and to pay over the entire proceeds of sai l sale or sales to the Sheriff in wh?3e office such judgments, execu tions or decrees are lodged, to be ap plied by said Sheriff towards the sat isfaction of the sojiie ; and, provided no objection shall be made in writing by either-of 'tl?e judgm?nt creditors and filed with said Sheriff as to the price at-which the said property may have been sold within three months from and after the time such payment shall have been made, the said sale or sales shall thereupon be considered confirmed ; and the said Sheriff shall make the following endorsement on the back of the deed or deeds of con vevanee, viz : " No objection having been filed in my office to the within bargain and sale within the time pre scribed by law, this bargain and sale is therefore confirmed ; ' the same to be dated and signed officially by the said Sheriff. SEC. 3. Be it further enacted, Thai in the event that the property, wher exposed for sale by the Sheriff, as provided for the Section 2, should bring more than the amount of the indebtedness cancelled by theproceedi of the sale made by the debtorj 'the purchaser from the debtor shall be re funded the amount paid by him, with interest from' the time of payment, and the bargain and sate made by the debtor rescinded, and titles exe cuted by the Sheriff to the purchaser at his e>ale ; and, after deducting the costs and expenses by reason of the levy end sale, the remainder to be applied, according to law., towards satisfaction of the judgment or exe cutions in his office. SEC. 4. Be itfurther enacted; That all Sales of either real or personal property made by judgment debtors, and the entire proc?eds of said sales ^aving been paid into the Sheriff 's office, to be applied toward, the satis faction of the demands in that'office against such debtor prior to the pas1 sage of this Act, shall be considered confirmed, ? unless objections to the price at which said property had been sold shall be made by any of the judg ment creditors within three months from and after the passage of this Act ; and, provided objections shall be filed, as specified in Sections 2 and 3 of this Act. . $EC,:5. B& 'it further enacted, That all Acts and parts of Acts, inconsis tent with this Act, are hereby re pealed. Approved March 7,1871. , ' . AN ACT to amend an Act Entitled " An Act to Incorporate the Some stead Building, Planting and Loan Association, of South Carolina." Be it enacted by the Senate and House of Representatives of the State of South Carolina, now met and sitting in General Assembly, and by the authority of the same, That the said Act be so amended, in Section 1, as tc read, between the words " Plant ing" and,"Loan," " Dime Savings ;" and in Section 2 to read " twenty five dollars" instead of " two thou sand." Approved March 7, 1871. AN ACT io Authorize the Formation .of and to Incorporate, the Tugaloo and Chattanooga lailroad Com pany. Whereas, it is desirable that there should be a connection, by railroad, between some point on the Blue Ridge Railroad and Chattanooga, Tennes see ; therefore, SECTION I. Be ii enacted by the Senate and House of Representatives of the State of South Carolina, now met and sitting in General Assembly, and by the authority of the same, That the formation of a corporate Company is hereby authorized, for the purpose of constructing a rail road from some point ou the Blue Ridge Railroad, in Oconee County, to the town of Chattanooga, in the State of Tennessee, so far as ?aid railroad s!:all run through this State, the said Company to have exclusive right to make, keep and use such railroad ; and, for the term of time hereinafter mentioned, no other railroad shall be constructed between the same points. SEC. 2. That, for the purpose of raising the capital stock of said Com pany, it shall be lawful to open books at Walhalla, under the direction of Robt, A. Thompson, E. P. Verner, P. L. Dean, 0. M. Doyle and A. E. Nor men, as Commissioners, and at such other places, and under the direction of such other persons, as the said Commissioners^pr a inajority. of them, may designate, for 'the- purpose of receiving .suscriptions to ab anfount not exceeding two millions, of dollars (^2,000,000,) in shares of. one hun dred dollars each, to constitute a joint capital stook, for the pufpo.se of con structing and carrying into operation' the said railroad; anu, on each share of the stock the "subscriber shall pay to die Commissioners who shall be aphorized to tal?e .the'same, the sum pf five dollars-in lawful money of the United States. SEC. 3. That when the sum of three hundred thousand dollars.'($300#00) shrill have been subscribed, in the manner oefore specified, the subscri bers shall be, aD? they are hereby, declared to.be 'a body corporate, .to be known by the; name and style of the Tugaloo and Chattanooga "Rail road Company, abd may meet and organize the said Company, at such time and place as may be designated bv the Com missioners before nam?d for Walhalla. SEC. 4. That the charter hereby granted shall continue and endure for the'term of thirty-six.years from the date thereof ; and this Act -shall be taken and deemed to be a public Act; and all Acts and parts of Acts; "in consistent with this Act, be, and the same are hereby, repealed : Provided, Th?t sajd Company shall oommence the building of the said road within two years, and h?ve the same com pleted .within six years. AN ACT to Require the County Com missioners to Report to the General Assembly.- < ' \ Be it enacted by the Senate and House of Representatives of the State of South Carolina, now met and sit ting in General Asse:ably, and by the authority of the sans, That the Coun ty Commissioners of each County snail, on or before the fifteenth of "December, in .each year, report to the General Assembly all accounts chargeable to their respective . Coun ties.; what have been allowed and settled ; the number, and amount of orders drawn upon the County Treas urer ; the taxes levied- and collected ; the amount expended for rebuilding or repairing Court House, Jail, Poor House and Bridges; in fact, a de tailed account of all their doings, as required by an Act entitled " An Act to define the jurisdiction and duties of County Commissioners," approved September 26, 1868. And upon fail ure so to report, they shall oe fined in a sum.not less than fifty, Ar,more than two.hundred dollars. Approved March 7,1871. AN ACT io Incorporate the Working men s Mutual Benefit Lije Assu rance Association, of. South Carolina. SECTION 1. Be it enacted by the Senate and House of Representatives of the State of South Carolina, now met and sitting in General Assembly, and by the authority of the same, That Edward Mickey, Samuel J. Keith, A. J. Ransier, Isaac H. White, W.H. J. Brodie, R. H. Humbert, Stephen Gary, Samuel B. Thompson, N. E. Edwards, Thomas D. McDow ell, W. J. McKinlay, P. R, Rivers, F. H\ Frost, W. E. Johnston, Wm. H?yne, and their associates and suc cessors, are hereby made and created a body politic and corporate, under the name and style of the Working men's Mutual Benefit Life .Assurance Association of South Carolina. SEC. 2. That the said corporation hereby created and established shall have succession of officers and mem bers according to its- by-laws, and shall have power to make such by laws, not repugnant to , the laws of the land, ana to have, use and keep a common seal, and the same to alter at will, to sue and be sued, plead and be impleaded in any Court iu this State, and to have and enjoy all such property, real and personal, as may be given, bequeathed or devised toit, or may be in any manner whatsoever ac quired by the said corporation : Pro vided,' The amount so held shall not exceed the sum of twentv-five thou sand (25,000) dollars. SEC. 3. That the said corporation may, from time to time, invest their funds, moneys, assets and all other property,- stocks, public or pri vate; notes, -bills, -bonds, with or without security, by mortgage of real or personal property, or by surety, in such sums ana. on such terms and conditions as they may deem proper ; and it shall be lawful for tne said corporation, Crom time to time, and^ at all times, to sell, convey, mortgage, assign or transfer all of its property, . real and personal, as and when it may be deemod proper and expedient, and tb mako and execute bonds under their corporate seal; with or without mortgage, for the purchase of real or personal property. ' . SEC. 4. That this Act shall continue in force for the space of twenty years, and that the same shall be taken and deemed a public Act, and may he given in evidence without being spe cially pleaded. Puffer, of the* County of Union, and .State of .South Carolina,' . and such other persons as now are, or may. hereafter be, associated with them, their successors and .assigns, be, and they are hereby, constituted a body corporate and politic, by the name and' style i of the Union Gold Mining Company, by . which name and . style they are hereby made capable in law to have; hold, purchase, receive, work, sell, mortgage, lease, enjoy and retain to them, their successors and assigns, lands, tenements, mines of . all characters, and chattels of what soever kind, as may be deemed by them most conducive to the objects and interests of- said corporation, which are mining and working for* gold and oth?r minerals, and manu facturing the same in Union County, and other "par ts of the State of South Carolina, and of sending the same to market. SEC. 2. That said corporation, by its title aforesaid, may sue and be sued, plead and be impleaded, in any Court of this State, make and use a common seal, altering the same at their pleasure, establish, alter and amend such by-laws and regulations as shall be deemed proper by them, not in conflict. with the Constitution or laws of this State, or the United States. SEC. 3. Cavender, Charles J Andell and Joshua Clendenon, and such persons as now are, or hereafter may be, associated with them, theil successors and assigns, be, and they are hereby, constituted a body cor porate and politic, by. the name and style of the Brewer Gold Mining Company, by which name and style they are hereby made capable in law to have, hold, purchase, receive, work, sell, mortgage, lease, enjoy and re tain to them, their successors and as signs, lands, tenements, mines of all characters, and chattels, of whatso ever kind, they may deem conducive to the object and interest of the said corporation, which, are minipg and working for gold and other minerals, and manufacturing the same, in Ches terfield County, and other parts oi South Carolina, and of sending the same to market. SEC. 2. That the said corporation, by their name and style aforesaid, may .sue and be sued, plead and be impleaded, in any Court of this State, make and use a common seal, and al ter and change the 6ame'at their pleas ure, and make'and establish such by laws and regulations, and such alter ations, and amendments thereof, not in conflict with the Constitution or laws of this State, or of the United States, as they shall deem proper.
