Seymour, Commissioner of Patents, respondent, was decided by Justice Bradley of the District Kuj preme Court, In lavor ol the petitioner, who 1 is really Gov. Tillman. In pursuance oi his scheme for controlling the liquor truffle lu the State Gov. Tillman sought to register a trade mark. In which the device and motto was to be the Palmetto, the . same to be applied to every package or receptacle containing spirituous liquor to be sold under official sanction. In order to secure the right or registration . uuuer the net oi Congress, it was necessary to , establish the fact that tbe goods were used In i traffic with some foreign country or counirleti . or some Indian tribe. Accordingly a case of I Soutli Carolina "pine top" whiskey was sent to Canada and sold at a nominal priceHaving thus established tbe trade of the State with a foreign country, Gov. Since then Justice Bradley has had the ca?e under conulceration and yesterday morning he renderi ed his decision lu tbe lorm of an alternative writ of mandamus against the Commissioner . of Patents, commanding blm to register tbe i trademark as prayed by tbe petitioner. Tbe , order Is as follows: This cause coming on to be heard upon the rule to show cause herein Issued, tbe petition, with its exhibits, and the demurrer thereto tiled, and the same having been argued by counsel, it is thereupon, on consideration by the court, ordered and adjudged, tbls 3d day of October, 1893. that the said demurrer be and hereby Is overruled; and it is also further ordered that an alternative writ of mandamus issue to tbe re*pondent, John Seymour, Commlssloner of Patents, as piayed In the pell' Hon, commanding him to register, as provided lu the act of Congress of March 3,1S81, the trade maik of tbe relator, tbe State of i South Carolina, as tbe same as described and exhibited In the petition hereto filed, the said writ to be returnable on Saturday, tbe 7tb instant, at 10 o'clock a. m. 1 A. As In the first Instance, as a sort of courtesy to an official of such rank as 1 Commissioner Seymour, a rule to show cause was issued Instead ol a peremptory manda. inuh, nolo ibis decision an "alternative" writ > Is Issued Instead of a peremptory mandamus. ; This Is, In effect, an order that the Commissioner ol Patents must register the Palmetto trade mark, or appear before the court on next Saturday to show cause why he has not obeyed the order. As be bus already stated the legal reasons why, in his mind, he should not register the . trade mark, and these do not seem sufficient to the court, It Is surmised that the ouly course the Commissioner can pursue is to obey or openly defy the order, In which case a peremptory mandamus will be Issued next Saturday. Of course an appeal Is possible In the case, but up to date the Palmetto people are decidedly on top. Judge Nimotiloii on the "Palmetto" Cane. Washington Post, Oct. 7th.
