Mr. William Riley presented liispetiion praying to be excused as a juryman, is his children were sick, and that lie be- | rig a School Trustee, was exempt from wrformlug jury duty?petition granted. The ease of "the State against Henry | Riley assault and battery with intent to j cill was continued. The witnesses in the case of the State ' igainst Willis Donaldson indicted for , arcenyof livestock, were excused from i urther attendance, until the next term of j . ourt. The first case brought to trial was, at j, >f the State against George Evans indict-!' ?d for burglary, breaking into and entering the gin house of Mr. James D. Foodie, and stealing therefrom 150 pounds >f seed cotton, Messrs. Blake and Gothran for the defence, Mr. Cothran was opposed togoing to trial at this time, urging that it would ba a great hardship on the % prisouor to force him to trial in the absence of both of his senior counsel, and of material witnesses, who if present, would swear that the prosecution was founded in mrtiiOe ; that the prisoner was the foreman on the plantation ofthe prosecutor, and that Archie Watts a witness for the prosecution had sworn that he would cause the defendent to lose his place, cost what it may. Solicitor Orr resisted the motion for i-ontinnanoe, and in reply said that the prisoner had had ample time to have his witnesses bound over, as this was the fourth time that his attorneys had a-sked for a continuance, and this being the first awe on the dockcl should be brought to trial. The Court held with the Solicitor, md ordered that George Evans be arraigned and put on trial. Verdict guilty. There wore a threat many witnesses in this ease, both for the prosecution and defence?mostly females. Some of them swore roundly and most positively that ihey had seen the prisoner at the "Promised Land" on the day of the 17th December, with a shot gun, that he had ottered j it for sale to several of the men in that neighborhood and that finally one of them bought it tor $1.75. Several women of the village swore point blank that it was 110 such tiling, that the prisoner was here on the streets of the village ut the time that he was accused of selling the gun, and that it was impossible for him io be at two places at the same time. Tin 1 whole matter seemed to hang on a pies! ion of veracity between the pious 1 ?f the "Promised Lund" and the elite of the village, lie was convicted of petit larceny.
