It 1= a sad commentary upon the frailty of i human nature that many men will do wrong if tlure are no curbs to their action either in the way of obvious self-interest or strong social and legal barriers. The jury as a part of our legal procedure presupposes this moral condition of men and is intended to contravene and defeat the purposes of the vicious and unscrupulous members of society. But however just and benevolent any institution may lie in the trifle dnnfomnlaioil i* 5^ r* 1 ? vumw wu?.viu|/iuvvvi( it 10 m? ao puasible for the evil ingenuity of men both to defeat these desirable ends and to force the most just provision of law to minister injustice, to foster corruption and promote oppres- , sion. And out of these circum- , stances comes the call to eternal 1 vigilance, the price that law and so- ' cial ethics must pay in order to sup- ' press and conteract the disintegrat- i ing influences that are ever ready ' to undo tlio constructive work of ' patriotism and disinterested service 1 for the public weal. Are we, as citizens of a commonwealth, paying this < price? Are we, alive to the abuses < and wrongs, not inherent in the jury as such, but adherent thereto when managed by corrupt men? The jury as a piece of our legal machinery, is only as good as the twelve men who, in any given case, compose it. As an abstract item of legal procedure it is a mere working idea, and must have men to work it. " that is. real men, men of robust ( c.orality, endued with the most sub* 1 stantial elements of character, if <" possible, men of broad intelligence, h taught in the school of experience i 1 <* nowhere else to reason accurately v and form conclusions dispassionately. 1 it is not essential that the juror A should be a colloire graduate, tliniierh I li this, other things being equal, is an o advantage. Breadth of training and r sympathy have a deep significance <> for the duties a: d functions of life tl as a v. hole, and not less in anywise e for jury service. As a foundation ^ for jury service a man should have a good, sturdy common sense and c solid principle; and in addition to n this much more is desirable. Education in the common technical sense tl :t valuable in helping one to combat I petty biases and blinding prejudices, ti in weighing evidence and arguments, o in discerning without approving the y skill that would "make the worst1 o; appear the Letter reason." But when manifest injustice is perpetrated by the custodians of the people's rights, when pifjuiuif aim ignorance mumpii over; fairness and truth, when inequity becomes iniquity, respect for the law ceases, and the demoralization is farreaching. And one of the large penalties which society must pay for this, state of things is that intelligent,; law-abiding people naturally shun a' country where life and property are unsafe and justice is set at naugnt in the courts. Society is a unit, an 1 j where one member suffers all suffer, j The perversion of justice through' juries or otherwise will in the end injure the poor, the Ignorant, the depraved; and the very class which brings injury to the social body must itself suffer.
