The Bird and Fish Laws of South Carolina. Yprkyille E: qtiirer : By request of Mr. VV. II. Wylie, game warden of York county, we reproduce the following bird laws: act of 1905. Section 1. All wild birds, both resident and migratory are the property of the st tfce. Sec. 2. The following shall be considered game birds: Swans, wild geese, braut, wild ducks, vails, marsh hens, cooffc, agglu nul?s, surf birds, snip*, woodcock, sumi pipers, upland plover, curlew, wild turkey, prairie chicken, quail (pariridge,) rice birds, black bird-*, and dove, and may be hunted during respective seasons. Sec. 3. No person shall kill, catch or have in his possession, living or dead, any resident or migratory wild bird other than .a game bird, or purchase or offer tor salo any wild non-g.une* bird ' after it has been killed or caught except as permitted by this act. Sec. 4. That none of the ski ., plumage or body of any bird protected by this act shall be sold or offered for sale, irrespective of whether killed within or wit limit, mo stale. -Sec 5. No person shall take or destroy the nest of the eggs of any bird, or have them in their '? possession except as permitted in this act. Sec. 6. It is unlawful to ship or receive for shipment any uoneanu bird except as permitted in this act. .See. 7. Fur sc:enti(ic purposes -a certificate may be issued by the secretary of state giving the right to take birds, nests or eggs. They may trap euch birds only on their o\Vii land<, but, they cannot sell themi>r ship them beyond the ontiues of the state. " -'*?? tj Sec. 8. The certificates by the secretary of state shall expire on the 31st day of December o( the year issued and shall not be transferable. Sec. 10. * The following birds are not protected, nor are their nests and eggs and they may be killed at any time: English sparrow, coopers hawk, dock hawk, sharp thinned hawk) great horned owl, and all other birds destructive of other birds. Crows may be killed on the owner's premises it destructive of crops. N >ne of these birds shall be sold or ofFered for 3 do or shipped out of the stale. Sec. 11. Any person violating any of the provisions of this act, except Sec. 8, shall be guil 1 ty of a misdemeanor, and shall bo liable to a fine of not less than one ($1.00) dollar nor 1 more than five (5.00) dollars for 1 \ : T3E L each bird, living or dead, or part of a bird, or ne-t, or set o! e?ij?s, or part thereof, kiHe 1, captured or pocaessed in violation ot ibis act, or be imprisoned in the county ja'l tor not mnre than thirty (30) days. Sec. 12. AH acts or par s of acts heretofore passed inconsistent with, or contrary to the-pro. visions of this act, are hereby I renealed. ? L ? ACT OF 1907. It shall be unlawful to hunt any wild turkey, quail, partridge, woodcock, mongolian or other pheasant between the first day of March a id the fifteenth day of November except in the following counties, where it shall be unlawful to hunt them be'ween the first day of April and '>6 tir.\t day of November: Beautorf, Hampton, Dorchesfe.*, Charleston, Colleton, Barnwell, Berkeley, Aiken, Ooonee, Lexington, ^airfield. Saluda, Georgetown and Clarendon, or to sell or expose for sale, ship (,r export for sale, to pot-hunt, net, trap, or by firelight to catch, kill, injure or pursue with such intent any of the birds named in tiiis section, nor shall any person destroy or rob the nests of such birds. For violation, on conviction they shall be deemed guilty of a misdemeanor and shall be fined not more than I twenty ($20) or be imprisoned not more than thirty (30) days. No thine: in this act shall prevent the importation for sale ot any ol the said birds. The havin? in possession oi anv of the said birds sold or expose 1 lor sale, or shipped, shall be prima facie evidence of a viola'ion of this act and the burden of proof shall be upon the person to show that they were imported Irom another state or territory. fisii. It is unlawful to poison fish in s'rettm-t or waters of the state and upon dOnviotion the violator shall be punishable with a fine of not less than five hundred ($500) dollars or imprisonment tor not less than six (6) months. Section 527. It is unlawful to kill fish .in the waters of this state by dynamite or other explosive. Provided, that nothing herein contained shall be construed to forbid !he use of ex. plosive material by the officers of the state or the United States government in the dischaihre of tlieir duties, and that nothing shall prevent tho use of such explosives by any person or corporation minim? phosphate rocks in the navigable streams of the state under license trom the state. Any violation 9hall he deemed a misdemomor and par ty shall be fined not more than one hundred dollars ($100) or be imprisoned for not more than six (6) months, or both fined and imprisoned at tne discretion of the a >11rr ACT OF 1903. Section 1. It is unlawful to sell dynamite or similar explosive except upon written application. Section 2.
