The state Senate exorcised its chamber of the Eugene Carmichael affair Wednesday by voting that no senator can retain his seat after being found guilty of a felony or election-law violation. The former Dillon County state senator caused a sharp split in the membership and months of soulsearching in the upper chamber last year when he refused to resign after he was convicted of federal vote-fraud charges. He finally resigned under pressure in March 1982 after several efforts to remove him failed. Some senators said they refused to expel Carmichael because his conviction might be overturned on appeal. Under the rules at the time, the Senate president pro tempore did not have the option of suspending a member upon conviction or guilty plea. If the senator exhausted his appeals, twothirds of the Senate membership could vote to expel. "I feel like we did a good job," said Sen. Robert Lake, chairman of the Senate Ethics Committee. "It was not subject to any amendments...there was very little debate. The Senate apparently agreed 100 percent with what the Ethics Committee came up with." The Senate passed another rule that would allow the Senate Ethics Committee and the Senate president pro tempore "to subpoena copies of indictments, pleas, sentences and transcripts of a trial" for their own information, Lake said. I "If we receive information about 1 someone convicted of a crime, we need to substantiate the crime, the conviction and how serious it is," 1 Lake said. 1 The Senate also passed a companion bill enabling the rules change 1 .^^k * Jp % iiW^Mgf HK ckw^I'* n^ > 4^ jobp^bbbi ** ^Bi JH'... y Cathedral Child Care Center took a tour of th or awhile ? even if it's only across the street. *f Qnitt*n o..r.M^> y UbllQIC dlipUUi Jniversity Faculty among his constituents rd of trustees and "You've go to talk a rk together to keep ask 'Is this person representing Clemson Faculty Senate aping Atchley and his But John Huffman, c programs. Lake said the change in the rules was not made earlier because the Senate had not experienced the problems raised by Carmichael's battle to hang onto his Senate seat after conviction. "We had no experience and we learn more by experience than we do by reading," he said. "We got into the Carmichaei affair and realized we were ill-prepared to deal with the situation he presented us when he wouldn't step down." Lake said the expulsion of a senator would still require a vote of the Senate because the state "constitution will not let you take that right from a man without a two-thirds vote." He said this year was a better time to deal with the rules change than last t>ecause the Legislature is dealing in a 'sensible, sane, moderate environment." f t v ^ "m jpa I^[ 4^1 Photo by Andy Lavalley e State House yesterday as a field trip.
