Miller defeated Mike Bryant by 50 votes to e the run-off. In the vice presidential race, Glory Gault to 3,383 votes cast and will face Jim Kemp in a r spot. Both sides have been battling for ownership since June 1979, when a court order forced USC to return the property to the Rembert family. The Rembertj allege USC made "unlawful and unauthorized" use of the land. Columbia attorney William Pope, representing the Rembert family, restated claims that USC was acting without proper authority when the university filed condemnation papers Aug. 28. Pope told 5th Circuit Judge Walter Cox the university's actions were not authorized by USC's Board of Trustees. He said USC failed to comply with a statutory requirement that condemnation be used only incases of "public necessity." Pope said the property, therefore, is not a "necessity" for USC. USC LAWYER Timothy Quinn said the university has immediate plans to use the land as a parking lot, as it had been used from June 1975 to June 1979. The deposition, he argued, stated several alternatives for the land's future use, including use as a USC parking garage site. Although Pope said the university had no legal authorization for condemnation procedures, Quinn said Board of Trustee authorization was not needed in previous condemnation procedures by USC. However, acting on recommendations from the administration, the board ratified condemnation procedures against the Rembert's property Dec. 5, Quinn said. Pope said yesterday the university is "in effect condemning" any income to be gained from the land. POPE ALSO said he stands firm in his argument that the price offered by USC for the lot is inadequate. The university last June offered $85,000 for the land, hut the Remberts value the lot at $600,000. According to Pope, USC acquired the Booker T. Washington High School land in 1974 for $5.50 a square foot. He argued that now, six years later, the university is only willing to pay $1.70 a square foot for "the Pit." Cox asked several times during the hearing for Clarification of the attorneys' arguments. He said he was "troubled"' particularly about the authorization for USC's condemnation proceedings.
