Jonas said a medical examination revealed that Acquisto had suffered a ruptured disc in her back. The accident occurred Oct. 4 when Acquisto was lifting a 65 lb. soft drink container, she testified. She also testified she felt a "definite pull" when she lifted the container. HOWEVER. ARA disputes the time when she hurt her back. Hie accident happened on Oct. 4, Acquisto said, but she didn't report it then because no supervisor was present. For this reason, ARA contends, the injury might have occurred somewhere other than at work. After the accident, she saw an orthopedic specialist on Oct. 8. Upon her return, she found that the ARA had filled her position. "I quit Midlands Tec to take this job," she said. Acquisto claims she technically is still employed by ARA. An employer, she said, can't fire someone for being injured on the job. Nevertheless, she has not been paid since the accident. SHE ALSO TESTIFIED that she had worked once for 35 consecutive days. ARA denied this, though they admitted that she had worked seven-day weeks before. During this time, she said she had asked for extra assistance, but got none. She also said she needed help in lifting the soda container. At the hearing, three witnesses, testified they had seen her move soda containers. Bill Lark, the current night manager, said he also had to do this at busier times. ARA did, however, offer her another job. Commissioner J. Dawson Addis of the industrial commission presided at the hearing. He said he expects to decide the case within 30 dflVK flffpr (hp final ? mmmmwrn uvpvOUIVIK) Alt secured. Both attorneys, Jonas and H. Fletcher Padgett, Jr. for ARA, agreed the essence of the hearing was "conflict of testimony." "IT'S A VERY technical matchup of facts," Jonas said,"but the commissioner gave us every opportunity to present our cases." Padgett declined to comment in detail on his client's position. "I don't think it would be fair to my client or theirs," he said. Another hearing could be scheduled after Addis decides whether or not Acquisto has grounds for compensation.
