LAW DEPARTMENT I "Ignorantia legis neminem excwat" A very interesting and in structive case was heard in the Moot Court Thursday night, March 30th-the case of Gold smith and Co. against the Sou thern Express Co. The agreed statement of facts showed that an imposter in Spar tanburg, S. C., representing himself to be the agent of Smith & Co., a reliable firm of Green ville, S. C., ordered of the plain tiff, Goldsmith and Co., jewelers of Columbia, a diamond ring val ued at $200. It appeared that Smith & Co. did not have a branch office at Spartanburg, nor did they know anything whatsoever of the order of the ring. The defendant, knowing that there was no such firm in Spartanburg, but being aware of the existence of such a firm in Greenville, af ter using some' slight diligence in ascertaining whether the irr poster was authorized to receive the ring, delivered it to him, the latter absconding. Goldsmith and Co. brought thip action for the conversion of the ring by the Express Co. The plaintiffs were represent ed by Messrs. Polier and Shirley, C. M.; the defendants by Messrs. Jennings and Wilson. The court was composed of Frierson, Chief Justice and Wade and Davis as sociate justices. Judgment for plaintiff. Do You Remember? (With apologies to The State.) When, with two men on bases, that visiting pitcher walked Tom mie McMillan and Rudisill was next up and tripled, When Fritz caught a punt in that Davidson game and ran six ty yards through a broken field for a touchdown and was called back for putting one toe over the sideline, That lusty cheering when Red dy Metts came to the bat in that memorable Tennessee game and what he did, That famous slide of Crane Waring's into home plate, That Sam Owens used to pull that "Ellerzy" stuff in right field, That game on the northern trip when Foxworth hit a near home run and stopped on second because he was tired, The years that Bowen Chase went out for football, What a tame affair~ that Thanksgiving game was in 1911, The remark that "Nuts" Ogles by made about that Georgia team, What a happy tiime tihat Vir ginia matinee was in 1913, Also that Georgetown matinee in 1915, Mr. Billings, assisted by the Wake Forest team.
