Every sack warranted. and GRIST, Rice and Fine nccesary to keep it in a safe condition. It was admitted that the defendants were duly warned to work the high ways and that they failed to do $p. The defendants were convicted and location is one of tire sentenced to pay each a fine of five in tlie sta te. dollars or be imprisoned ten days in the county jail. The defendants' ap peal on the grounds— 1. That their employment, as above stated, in the service of the railroad company is a “justifiable excuse.” 2. That being so employed they are not liable to road duty. These defendants are not the em ployes of the government, either State or Federal. They have no claim on the government and are in no way responsible to it. They are employed and, I take it, paid and can be dis missed by the railroad company at its pleasure. Except that they are paid for the time thev work and not by the job, there is no difl'erence between them and those who get out cross-tics, bridge and trestle timber and fire-wood. 1 see nothing in the nature of their con nection with the railroad company which exempts them from road duty. They are not exempt by statute as'a class. What is a justifiable excuse is not defined in the Acts. I think, however, that it must be something in the nature of an emergency, which cannot, with reasonable care, be provided against as sickness or death in one’s family, or even of a near neighbor or friend, where the common interests of human ity demand that business shall he laid aside for the care of the sick and dy ing. Some heavy loss from fire or flood might be sufficient to excuse the sufferer during the temporary pres sure on him. I do not think that any class of persons not named as exempt in the Act can plead their employmer or occupation as ipso facto a valid or justifiable excuse for tailure to de road duty. The vernal equinox occurs on the 21st of March, and the supposi tion that the two are exactly six months apart may lead to the error. The name takes its origin from the fact that when the sun passes through Ihe plane of the celestial equator, the days and nights are of equal length in all parts of the world. The equinoctial points, or those where the cetestial equator and ecliptic intersect" each other, arc the first point of Aries and the firet point of Libra. The sun en ters the first on the 21st of March and enters-the latter on or about the 23d of September. About the time of the eqninox violent storms may be looked for. I have just returned from a visit to my Newberry friendsj! after an Absence of two months. [ < noticed the crops of corn and cotton in Newberry were in about the same con- i ditlon as in Fairfield county. At the town of Newberry they say they have not hod a full season of rain since last April. South of the town and east they have hot tor crops. Gardens have but fen vegetables in town or vicinity. The town council have a fine fire engine and two cisterns of water con venient. The merchants have full sup plies of dry goods and groceries. The cotton factory is progressing in its structure. The foundation has been laid with the best of granite, and building up with good brick.
