It. is question of the fitness of men who sii on the bench as judges—n question as < old as the battle for civil liberty—as old as the light against robbery in the form of law; hut w hich, as eases cou- s autly come up to show, is never too old to be of practical moment to the public. In this case the circumstances were those of the publication of an ordina ry piece of news. IVe printed the re port sent by telegraph of a tire at Edgefield, in South Carolina, with the allegation that some of “the leading citizens” of that place believed the fire 11 be o incendiary origin and believed it was kindled by “one Malloy;” but of this Malloy there was no further iden tification by given names, nor, indeed, any other identification whatever, ex cept in the statement that he was the same person who was believed to have on a former occasion set fire to his own store for Die purpose of obtaining the insurance and that he bad absconded since this latest fire. If there was a Malloy to whom this description would apply he might properly hold that lie was the man referred to; but it must be thought that he could scarcely pre tend that he had tnuch character to lose. With no further identification than this ot Die inculpated person, one James Francis Malloy came forward and claimed to be the man referred to in the report. That a man should, by his own act and endeavor, proceed to prove, where all was doubtful at least, that he must necessarily be the person named in such a report, may not seem ivitMiuable at a first glance; but when we consider that such an identification might involve the possible collection ot twentv thousand dollars this point will be more readily understood.
