him, from what source, the amount paid, to whom, and the amount
remaining in his hands ; ho shall, also, make annually to the Quarter?
master-General, a full report of the amonnt of money received by each
Brigada and Regimental Quartermaster in his division, the amount paid by
each, and the amount remaining in the li ands of each ; he shall be charged
with the payment of thc Militia of his division, when in the service of
the State ; he shall give bond, with sureties, in the penal sum of ono
thousand dollars, to the State of South Carolina, for the faithful perform?
ance of his duty, which bond shall be lodged with the Clerk of the Court
of the District in which he resides at the time of his appointment as
Division Quartermaster ; he shall be obeyed by all Brigade and Regimental
Quartermasters of his division.
XXXVI. It shall be the duty of each Brigade Quartermastef to receive
all fines imposed by 11113- court-martial appointed by the Brigadier-General,
or officer commanding the brigade to which he belongs, and pay over the
same to the order of the Commander-in-Chief, the Major-General of thc
division, or Brigadier of the brigade, to which he belongs ; he shall
annually make to the Division Quartermaster of the division to which he
belongs, and to the officer commanding his brigade, as often as may be
required by such officer, a full report of the amount of money received by
him, from what source, the amount paid, to whom, aud the amount
remaining in his bauds ; he shn.ll annually make to his Division Quarter?

lodged with the Clerk of the Court of the District in which he resides at
the time of his appointment as Brigade Quartermaster ; he shall bo
obeyed by all Regimental Quartermasters in his brigade.
XXXVII. It shall be the duty of each Regimental Quartermaster to
reeeive all fines imposed by any court-martial appointed by the Colonel,
or officer commanding the regiment to which he belongs, and pay over
the same to the order of the Commander-in-Chief, or Major-General of
the division, or Brigadier-General of the brigade, or Colonel, or officer,
commanding the regiment to which he belongs. He shall make, as often
as may be required by such officer, a full report of the money received by
him, from what source, the amount paid out, to whom, and the amount
remaining in his hands ; he shall be charged with the payment of the
Militia of the regiment to which he belongs, when in the service of the
State ; he shall give bond, with sureties, to the State of South Carolina,
I in the penal sum of one thousand dollars, for the faithful performance of
his duty, which bond shall be lodged with thc Clerk of the Court of tho
District in which he resides at the time of his appointment as Regimental
Quartermaster.
XXXVIII. It shall be the duty of the Judge-Advocate-General to attend
all courts-martial appointed by the Commander-in-Chief, and to prosecute,
in the name of the State, all persons who may be brought before such
courts ; and shall, when required by the Commander-in-Chief, or any
Major-General, give his opinion, in writing, on any point of Militia or
Patrol Law.
XXXIX. It shall be the duty of the Commissary-General of Purchases to
purchase all arms, equipments, munitions of war, ordnance stores, mili?
tary materials, medicines and surgical instruments.
XL. It shall be the duty of the Commissary-General of Issues to pur?
chase, or otherwise procure, all subsistence, fuel, forage, and straw for
bedding for troops in service, which he shall deliver over to the Quarter?
master-General, under such regulations as may be prescribed.
XLI. Thc Physician and Surgeon-General is charged with the govern?
ment of hospitals, and regulating the duties of Surgeons and Assistant
Surgeons. He shall be obeyed by the Apothecary General ami all Sur?
geons and Assistant Surgeons.
XLII. It shall be the duty of thc Apothecary-General to reeeive from
tho Commissary-General of Purchases all medicines and surgical instru?
ments ; and he is charged with the safe-keeping and distribution of thc
same.
XLIII. The Captain, First Lieutenant and Second Lieutenant of ?
company shall be ?lected by ail free white men above the age of eighteex
years,?rho have resided in the State at least six months n?xt preceding
the election, and belong to the company in which the vacancy shall occur.
XLIV. When any vacancy sholl occur in the commission of a Captain,
First Lieutenant or Second Lieutenant of a company, the Colonel, oi
officer commanding the regiment in which such vacancy sholl happen,
shall issue his orders to the Lieutenant-Colonel or Major, or officer com
mandiug the battalion in which such vacancy sholl happen, commanding
him to order an election to fill such vacancy, and also to order two fi
persons of said company to manage the election ; and the managers sind
advertise the election a;, two public places within the limits of the company
for at least ten days before the day of election, and shall open and hold ?
poll at the usual muster-ground of the company, from eleven o'clock A. M
to three o'clock P. M., count the votes on the same evening, and forthwitl
transmit to the Colonel, or officer commanding tho regiment, a statement
i in writing, showing the result of such election, certified by thc managers
ami he shall pronounce the person having the greatest number of votei
to be duly elected, and issue a commission to him accordingly. Whei
such election is contested, the Colonel of the regiment to which sucl
officer shall belong shall order his Lieutenant-Colonel and Major to hi
assistance, and shall hear and determine tho same, and their decisioi
shall be conclusive.
XLV. Each person elected an officer in the company, who shall accep
the commission, sholl be compelled to serve in the office to which he shal
be elected for twelve months, uuder the penalty of twenty dollars, and fifb
percent, on the amount of Ins last generaljtax, unless he shall be promoted
or remove out of the limits of his command, or become, from bodily o
mental infirmity, incapable of performing the duty thereof, or be deprive<
of his commission by the sentence of a court-martial.
XLVI. It shall be the duty of each Captain, or commanding office
of a company, to enforce, within his company, the Militia (and the com
mand?is of beat companies the Patrol) Laws of this State. He shal
assemble his company at least twice in each year, and shall instruct, dril
and exercise it in the schools of the soldier and company ; he shall bi
responsible for the correct instruction and good order of his company ; hi
shall constantly keep in office in his company the full number of non
commissioned officers required by law, under the penalty of fifty dollars
he shall appoint the Sergeants, Corporals, Clerk and Musicians of his com
pony, and they shall be removable at his pleasure; he shall make sud
returns and reports of his company as may be required by any of his supe
rior officers ; he sh ill report all tho defaulters of his company for thc ncgiec
of Militia or Patrol duty, all non-commissioned officers for neglect ef dat;
or disobedience of orders oft' duty, to the first court-martial authorized ti
? try the same, after the commission of such default, neglect or disobc
dience ; he shall cause them to be summoned to attend said court, whic]
he shall furnish with the evidence of such summons, and sholl transmi
to the court all written excuses that moy be given to him for that purpose
If he should have no defaulters to report to any court-martial detailed io
the tnkd of defaulters in his regiment or battalion, he sholl report tba
fact, in writing, to such court, and shall execute and obey all orders froi
any of his superior officers.
XL VII. It sholl be the duty of the First Lieutenant and the Seeon?
Lieutenants to assist the Captain of their company to maintain its militar
organization, and to enforce the Militia and Patrol Lows within the samt
and to execute ?iud obey all orders of their superior officers.
XL VIII. The officers, or others monaging an election for any Militi
officer, before, they proceed to hold thc election, shall be duly sworn tin
they will impartially he'd and faithfully conduct such election, and the
ore severally authorized to administer such oath to each other ; they sha
enter in a book or roll the names of all, persons voting at such election,
and shall provide a box or bag to receive the ballots ; they may require
any person offering his vott to swear that he is daly qualified and entitled
to vote, and may propound such questions as may be necessary to satisfy
themselves of his qualification.
XLiIX. In all cases of contested elections, a protest, in writing, stating the
ground of such contest, shall be delivered to the officer authorized to issue
the commission, and a copy shah he served upon the person having the
plurality of votes, within thirty days after the election.
Li. R?signations of .Militia officers shall be tendered in writing to thc
following officers, and if accepted, shall he retained on file in the depart?
ment of thc officer accepting them, viz: A Major-General shall resign to
the Commander-in-Chief; a Brigadier-General, or officer of the division
staff, to the Major-General of the division, to which such resigning officer
belongs; or if there he no Major-Gcneral, then to the Commander-in
Chief; the field officers, and officers of the brigade staff, to the Brigadier
General; and if they have none, thou to their Major-General, or officer
commanding the division to which they belong; the company officers and
regimental staff, to the Colonel or commandant of the regiment.
Ld. When any vacancy in the commission of any officer of the hue
shah occur, the officer whose duty it may bc to order an election to fill it,
shall forthwith issue his order, placing the officer next in rank in the corps
in which the vacancy shall happen in the office vacated, until an officer
shall have been elected and commissioned to fill such vacancy; and in the
interim, the officer so ordered to fill the vacancy pro tempore, shall have
the same powers and he liable to the same penalties as if elected to said
office.
LIL Each officer shall reside in his command, and on his removal
therefrom, his commission shall bc vacated: Provided, Thafwhen the
dividing hue between any regiments, battalions or beats, shall pass through
any city, town or village, any person holding a commission in either regi ?
ment, battalion or beut, may reside anywhere within the limits of such
city, town or village, without forfeiting his commission; and that when
the dividing line between two regiments or battalions, in any brigade,
shall pass through the lands of any person on which lie resides, it shall be
lawful for him to hold a commission in cither of such regiments or
battalions.
LUI. If any regiment or battalion shall neglect or refuse, for six
months, to elect an officer to command such regiment or battalion, or if
the person elected shall refuse to accept such office, it shall be the duty of
the Brigadier-General, or officer commanding tb^c brigade, to which such
regiment or battalion belongs, to appoint and commission a fit person,
liable to do ordinary Militia duty in such regiment or battalion, to com?
mand such regiment or battalion, and he shall be compelled to serve in
such office for two years, under the penalty (if appointed to the. command
of a regiment) of one hundred dollars, ami fifty per cent, on the amount
of Iiis last general tax; and if appointed to the command of a battalion,
under the penalty of seventy-five dollars, and fifty per cent, on the amount
of his last general tax; but he shall not be compelled ti; serve ia such
office longer than two years in four.
LIV. If any beat, company shall neglect or refuse, for two months, to
elect an officer to lill any vacancy which shall occur in it, or the person
elected shall refuse to accept of such office, it shall bf the duty of thc
Colonel, or officer commanding-the regiment to which such company
belongs, to appoint and commission some fit person, liable to ordinary
Militia duty in such beat, to fill such office, and he shall be compelled to
serve in such office for twelve, months, under the penalty of thirty dollars,
and fifty per cent, on the amount of his last general tax, unless he shall
be sooner promoted, or from bodily or mental infirmity ,become incapable
of performing the duties thereof, or remove out ?f the limits of his
command, or unless the company shall sooner elect some fit person, who
shall accept such commission ; and it shall be the duty of the Colonel, or
officer commanding the regiment, to appoint and commission, as often as
the appointment shall be refused ; and iu every case of refusal to accept,
the penalty shall be enforced ; but no person appointed by the Colonel to
an office in a beat company shall be compelled to uniform himself, or
serve in such office longer than one year in three.
LV. Every person appointed a Sergeant or Corporal in a company
shall be compelled to servo in that post for twelve mouths, under tho
penalty of twenty dollars, and fifty per centum on the amount of his
last general tax, unless he be sooner promoted, or shall remove out of the
limits of the company, or shall become, in thc opinion of the officer com?
manding the company, incapable of discharging the duties of the appoint?
ment ; but no person shall be compelled to serve as a Sergeant or Corporal
longer than one year in two.
LVL It shall be the duty of the Sergeants and Corporals of every
company to wara tho subaltern officers and privates of their respective
companies, whenever necessary, to all musters ; to summon (when required)
all defaulters of Militia and Patrol duty, all iion-conraiissioiied. officers for
neglect of duty or disobedience of orders off parade, and all fatigue-men
for the non-performance of duty, to the court-martial detailed for their
trial, and to report, in writing, oa oath, such summoning to the Captain
or commanding officer of their company, before the sitting of such court ;
and the officer under whose authority any Sergeant or Corporal shah be
required to summon any person to a court-martial, is hereby authorized
to administer an oath to prove such summons, and to certify the Rame.
And it shall be the duty of all officers, whose duty it shall be to appoint
Sergeants and non-commissioned regimental staff-officers, to give them
respectively a certificate, signed officially, specifying tho appointment, its
date, and the company or regiment to which they belong.
LV?I. It shall be the duty of each Clerk ia any beat company, once
in every year, to take a census of his company, and he is authorized to
demand the aame of every person resideat witina its limits, ami inquire
iuto the liability ot such person to perforai Militia or Patrol duty ia such
company; and if any person shall fail or refuse to answer satisfactorily,
on oath, (which oath he is hereby authorized to administer,) tte necessary
inquiries of such Clerk respecting his liability to perform such duty, such
person shall be enrolled by the Clerk, and shall not afterwards be permitted
to plead any exemption or disability which existed at the time of such
enrollment; and if ia ti^e sixteenth regiment, ?hall forfeit and pay the
sum of ten dollars, io 'oe sued for and recovered before any Magistrate,
which penalty shall be paid into the hands of the Qitartermastcr of the
sixteenth regiment ; he shall keep a roll of all persons liable to perform
ordinary Militia duty, a list of all alarm men, and a roster of all persons
liable to perform ordinary Patrol duty in his company ; he shall, under
the superintendence of the Captain or commanding officer of the company,
make out and furnish all Patrol warrants to the commanders of Patrols ;
shall make out and present to the commanding officer of his company
all the returns of the strength and equipments of the company that shall
be required ; lie shall keop a book in which he shall record ali written
orders received or issued by the commander of the company ; and he shall
be exempt fron drill at company, battalion, regimental and brigade mus?
ters. Every Clerk of a company, for neglect of any duty required by law,
or disobedience of orders, shall be fined in the sum of five dollars, aud
and fifty per cent, on the amount of bis geaeral tax.
LVLLt. The cavalry of this Stato shall consist of volunteers, ia the terri?
torial limits of each brigade of infaatry, who shall hold themselves in
constant readiness to march to any point in the State, to suppress insur?
rection or repel invasion ; and no company shall consist of more than ono
Captain, ono First Lieutenant ami two Second Lieutenants, four Ser?
geants, four Corporals, one saddler, oao farrier, one trumpeter, and eighty
privates.
LIX. No company of cavalry shall be received or organized as a
company, unless such company, at its fir-^t inspection, shuU consist of at
least one Captain, out; First Lieutenant and two Second Lieutenants, four
Sergeants, four Corporals, one saddler, one farrier, one trumpeter, and
thirty-two privates, ia full uniform, and eachjaiember fully equipped with
