Yon committee find, by the roport of th county canvassers for thosaid county (which report is made out in prope form, signed .by the county canvasser and sigued and sealed by the clerk o tho Court of Common Pleas am Uoncral Sessions for Abbovillo Conn ty,) that, for senator, James S. Cotl Tau reccivqd fourteen hundred urr eight (1408) votes, and L. L. (jlnfii iburteeu hundred and three (1403 Qtes, making a majority for Jamu S. Cothran of fivo (u) votes. You committee havo concluded that, ac cording to^Ar'ticte vin and Section 1 or theConstitution of this State :u1h? by Section 32 of at) act of the Cienci al Assembly, ratified on tho 2fith da; of Septomber, 1868, that the report o statement of tho county canvassers i pritna factc evidence of the said Jaine S. Cothrfrn's right to a seat a?? scnato from the County of Abbeville. Bu the said James S. Cothran's seat i contested by I>. L. Gulliii, one of tin county canvassers for Abbeville cotui t?y, upon tho following grounds, t< wit : First, Because tho poll at Calhoun': Mills was not opened according to law Secondly. Because there was onl} one of the legally appointed manager* that actod as managers at Calhoun's Hills on tho day of election, to wit the 25th day of May, A. 1>. 18USI Tlrirdly. Because at Child's Cross Honda there were three young men reentered on the day of said election, contrary to the act provi< tg for un election to fiil certain -vr. ..ncief", approved the 2od day of March. A. 1>. 18G9. Your committee have examined several witnesses in this case, according to the testimony* of L. P. (lufh'n, the poll was not opened at Calhoun's Mill till 8* o'clock A. M. M., anil remain ojK-.n till 0 o'clock P AL As it 1ms been shown that the poll at Calhouu's Mills was not opened as the law directed, it is plain that ihe law was uot complied with, and the election at that poll was uot held according to law. Agai>? it is shown, l>y the testimony of the Same gentleman, that he was at Calhoun'^ Hills on the day of the Kxid eletionr<acting as deputy Stall" constable, and saw the chairman of tho board pF managers appoint a person to act as manager of election at that poll, and he (the said (iullin) did aiot object to such appointment. Your committee have concluded that, according to section second of an act of the General Assembly, approved the 2Gtli day' of September, A. 1>. 1808, none but tbe Commissioners of electiou who wore appointed by the iioxoruor had the right to appoint :> manager or managers of election ; aruj that, therefore, the election which was holdfu at the poll at Calhoun's Mills, on the 25th day of May, 1869. managed by a^pawou who had not the legal authority so to act, ia illegal, and should have "been declared void by the county ?4UU'-asser& Th^' ground upon which the scat of Mr.'Cothrau is contested thirdly is, that three }*onng men registered on the day of ?locticm. Your committee hold that the fact of those young men having registered on the day of election did not qualify tfyom to vote, nor the fact of tfiejr&ot hieing registered disqualified them from voting, it' they pos.
