f Foreign News. j Nkw Yobk, July 9.?The steamer Saxouis, . with dates of the 27th arrived yesterday. The British Ministry have tendered their resignation, which the Queen accepted. It is supposed Lord Derby will form a new ministry. The Italians under the Kiug were repulsed in attacking the Austrians near Verona, on the 24th June. The battle lasted until night. Both sides fought bravely, but ended in the defeat of the Italians. The Austrians took 2,000 prisoners. The Italian army retreated across the Mincio. It is positively asserted that the HanoTcrinn army ib surrounded and must capitulate to the Prussians. This needs confirmation. Nothing is known of Beuedek's .movements. GEN'L SICKLES, commanding Department of the Carolinas, on the 2i'.th instant, by Special Order No. 19, has directed that white persons in Military custody, charged with felonies or misdemeanors on the persons and property of colored persons, should be turned over to the civil uuthoiilios for trial, and that like cases arising * hereafter will be disposed of in the same manner: t And whereas, this Order?so gratifying to t the feelings and sentiment of tlio people of i this Slate ?is based upon the legal opinion of c Chief Justice Duukin, given upon the urgent 1 request of this Department, and communicated ?. to UeB. That until the District Judges arc commissioned, the Court of General .Sessions retains jurisdiction of cases of misdemeanor committed by whites f on the person or property of colored persons, Chief Justice Dunkin says, "The Court of General Sessions had always cognizance of offenses committed by white persons against the person or properly of a person of color." < In the case of Statu vs. llill, 2d Spear, 150, which was an indictment against a white person for assault and battery on a free person of ooior, it was not only so ruled, but recognized as well settled law lor more thnn half a ceulury. The L?isricls Courts of December, 1805, not having been*put in operation, 1 suppose the general jurisdiction of the Court ot Ses- , sions remain; and 1 understand that such has been the ruling of the Circuit Judges in reference to cases of bastardy and vagrancy which ] have conie before llicin. < The 30th ocction, Act 18Go, provides "that ( in every case, civil and criminal, in which n ] person of color is a party, or which affects the ] person or property of a person of color, per- ] sons of color shall be competent witnesses." ] It is n remedial Statute and must be construed in reference to its object. My opinion is, thnt persons of color are competent to testify be tore Grand Juries and Magistrates in criminal cases touching the person or property of persons of color." And whereas, the security of the liberty of the citizens arising from his right to be tried by a jury of his peers, can only be retained, in the present anomalous condition of the coiintry, by the civil officers of tlic Slate executing the principles contained in the opinion of the justly distinguished Chief Justice, in good t&ith and with an earnest desire to give security and protection to the persons and property of the colored population. And to the end that this high privilege may be retained by the good people of the State, I, JAMES L OKK, Governor of the said Slate, do proclaim and declare, that it. is the duty of every Civil Magistrate to give careful consideration to every complaint made to him by n person of color against n white man for any iciviij u> imsuciiicHuur nuegeti to have been committed against the person or properly of a person of color; and if he, upon such consideration, concludes iliat there are reasonable grounds for such complaint, said Magistrate shall take the affidavit of such person of color, and issue his warrant against the offender, requiring his arrest and recognizance to nppeur at tho next term of the Court of Oeueral Sessions, just as if he would do if the party making tho complaint wcro a white man; and he will also recognize all witnesses by whom the complaint may desire to prove the charge, as is now provided by law, for securing the attendance of State witnesses. All Sheriffs and ' Constables will promptly, faithfully nud fear I f lessly execute all warrants as may he placed ? in their hands.
