' of Voters and the Conduct of Pri- ' mary Elections of the Democratic Party of South Carolina. | 7. ADOPTED MAY 15, 1912. D., 1912, and the second Erimary held two weeks later, if one e necessary: I Rule 1. The qualifications for mem^ bership in any subordinate club of the Democratic party of this State, or for voting at a Democratic primary, shall be as follows, viz: The applicant for membership, or voter, shall be twentyone years of age, or shall become so before the succeeding general election, and be a white Democ-at, or a r nc^iv wiiu vuitu ior uenerai nampton I, in 1876, and has voted the Democratic ... picket continuously since. Provided, That no white man shall be excluded from participation in the Democratic party, who shall take the pledge required by the rules of the Democratic party, and whose name has been enrolled on the Democratic club list five \days before the said primary election, and who is otherwise qualified under I the constitution and rules of the Dem' ocratic party to vote in the primary V j elections: Provided, further. That in ? * the county of Charleston no person shall be registered upon a club list or dwb roll, except upon his written application signed by himself and .. witnessed by at least one witness who shall subscribe his name as such and residence ,the said applicant setting out his residence by street, number and ward (where these designations exist). The managers at Hnv of tv,o t / primary election shall require every voter in a Democratic primary election to pledge himself to abide the results of the primary ,and to support the nominees of the party, and to take the following oath and pledge, viz: "I do solemnly swear that I am duly qualified to vote at this election according to the rules of the Democratic party, and that I have not voted before at this election, and pledge myself to 1 support the nominees of this pri- ! mary." I Rule 2. Every negro applying for membership in a Democratic club, or ; offering to vote in a Democratic primary election, must produce written statement of ten reputable white men who shall swear tnat they know of their own knowledge that the applicant or voter voted for General Hamn ton in 1876 and has voted the Democratic ticket continuously since. The statement shall be placed in the ballot box by the managers, and returned witrf the poll lists to the county chairI man. The managers of election shall keep a separate list of the names of all negro voters, and return it with poll lists to the county chairman. No person shall be permitted to vote unless he has been enrolled on a club lis! at least five days before the said primary election and has been a resi oenc or tne state one year and of the county in which he seeks enrollment j sixty days perceding the next general election; Provided, That in Charleston county the voter must have his name on the club list at least sixty days p the said primary election: Pro>k f further, That in the county of Charleston the club rolls shall be filed with the county auditor at least sixty days before the primary election. The club lists shall be inspected by and certified to by the president and 1' secretary and turned over to the managers to be used as the registry list. Rule 3. Each county executive com . mil tee of the Democratic party in this State shall meet on or before the first Monday in August of each election /- year and shall appoint three managers for each primary election precinct in their respective counties, who shall hold the primary election provided under the Democratic constitution, in accordance wun tne acts of the general assembly of this State regulating i primary elections, the constitution or I the Democratic party of this State < and the rules herein set forth. The i names of such managers may be pub- i lished by the chairman of each couri- 1 ty executive committee in one or more i M county papers at least two weeks ! before the election. Rule 4. Each voter in said primary i shall vote two ballots, on which shall l be printed the name or names pf the < candidates voted for by him for each < of the offices to be filled, together i with the names of the office. Auditor. \ i Magistrate. < Master. County commissioners. No vote for house of representatives 1 shall be counted unless it contains as < many names asthe county is entitled to representatives. Rule 5. The managers of election ; shall open the polls at 8 o'clock a. 1 m., and shall close them at 4 o'clock p. m.; Provided, That in the city of Charleston the polls shall open at 8 o'clock a. m., and shall close at 6 o'clock p. m. After tabulating the 1 result, the managers shall certify < the same and forward the ballot-box, poll list and all other papers relatme to such election.?bv one r number to the chairman of the respective Democratic county executive committees within forty-eight hours after the close of the polls. At any election when the right of a person to vote is challenged, the managers shall place the vote so challenged in an envelop and endorse thereon the name of the voter and that of the challengers, and the person so 1 challenged shall be allowed to vote, i and the challenged votes shall be kept 1 separate and apart and not counted, i but turned over to the county execu- < tive committee, who shall at its first < meeting thereafter hear all objections to such votes, and where no person 1 appears to sustain an objection made \ at the polls the ballot shall be removed from the envelope and mingled < with the regular ballots and counted, but where tne challengers appear, or 1 produce witnesses in support of the ] challenge, the committee rnall proceed < to hear and determine che question, i and in all instances the voter shall I have the right of appealing to the < State executive committee. (Amendment 1912.) 1 Rule 6. The county Democratic ex- < ecutive committee shall assemble at 1 their respective court houses on the 1 mnrninnr nf rlovr election on or before 12 o'clock M., to < tabulate the returns and declare the J results of the primary, so far as the i same relates to members of the gen- < eral assembly and county officers, and 1 shall forward immediately to the chairman of the State executive com- s mittee at Columbia, S. C., the result < jf the election in their respective i counties, for United States senator, < State officers, congressmen and solic- 1 tors. I Rule 7. The protests and contests ! for county officers shall be filed within 1 two days after the election with the J chairman of the county executive com- 1 mittee, and said executive committee shall hear and determine the same at ts first meeting thereafter. The State sxecutive committee shall hear and de:ide protests and contests as to United States senators, State officers, congressmen and solicitors, and three lays shall be allowed for filing the same after the decision of county ex?cutive committee: Provided, That no member of the county executive committee shall act in any contests wherein his candidacy is acted on, and pro/ided further that no member of the State executive committee shall act in any contest wherein his candidacy is acted on. Rule 8. Candidates for the general asembly and for county officers shall file with the chairman of the county executive committee a pledge in writing to abide the results of the primary and support the nominees thereof. Candidates for other officers shall file such pledge with the chairman of the State executive committee: Provided, fhat the pledge of such candidate shall be filed on or before 12 o'clock, meridian, of the day preceding the lay fixed by the county executive committee or the State executive committee for the first campaign meet inff or tne county or State, respect-1 ively: Provided, further, That in Charleston county the candidates for congress, solicitor and county officers ros HOODS A1 customei ily 10 Ya Coupons 1 ! 7TT shall hie their pledges ana pay their issessments within the time fixed by he county executive committee. No rote for any candidate who has not paid his assessment nor complied with' ;hs rule shall be counted. The following is the form of the jath: "As a candidate for the office >f , in the Democratic primary election, to be held on the ast Tuesday in August, 1912, I heresy pledge myself to abide the results >f such primary and support the nominees thereof, and I declare that I am a Democrat and that I am not, nor vill I become the candidate of any faction, either privately or publicly suggested, other than the regular Democratic nomination." If tne candidate is running for the United States Senate, or for the United States House sf Representatives this additional pledge shall be required: "I will support the political principles and policies of tne Democratic party during the term of office for which 1 may be elected, an dwork in accord with my uemocratic associates in congress on all party questions." "This the day of , 191?." Provided, that after the time for filing such pledges, and before the close of the election, should any candidate die, it shall be the duty of the State or county executive committee (as the case may be) to afford opportunity for the entry of other candidates for the office involved, and should such death occur more than twenty days before the first primary, then said committee shall make provision for other additional candidates entering the race, but if said death occur after said twenty dqys, then the balloting for said office shall not be at the succeeding primary, but au said committee, and that they shall provide for the filing of pledges. A second primary! when necessary, shall be held two weeks after the first ,as provided for under the constitution of the party, and shall be subject to the rules governing the first primary. At said second primary the two highest candidates alone shall run for any one office, but if there are two or more vacancies 'for any particular office, then double the number of candidates shall run for the vacancies to be filled. For instance, in a race for sheriff the two highest shall run. Rule 10. In the event of a tie between two candidates in the second primary the county chairman, if it is a county office, and the State chairman, if it is for United States senator,, State officers, congressmen, or solici tors, snail order tne intra primary, rhe question of a majority vote shall t>e determined by the number of votes cast for any particular office, and not by the whole number of votes cast in the primary. Rule 11. Each county executive committee shall furnish the managers it each precinct two ballot boxes, one for State officers, and the other for congressmen, solicitors and county officers. Rule 12.
