Prohibiting The Sale of Future Options
Upon Margins

SUCTION 1. That from and after the
loth day of Septemlier, ltH)t>, it shall lie
unlawful for any jhtsou, association of
persons, or cori>oratinii8, either as principal
or agent, to establish, maintainor
i operate an oflice or other plaee of busi|
ness in this town, within the .-orporate
j limits of the Town of Union, S. 0., for
I the purjMtso of carrying on or engaging in
j the business forbidden in this ordinance,

of violating this ordinance.

contract or agreement, whether or
not in writing, whereby any jierson or
corporation, either as principal or as agent
I shall agree to buy or sell ami deliver, or
! sell with an agreement to deliver any
| wheat, cotton, corn or other commodity,
'stock, bond or other security, to any other
|s rson or corporation, when in fact it
j is not in good faith intended by the. pari
ties that an actual delivery of the article
J or thing shall he made, is hereby declared
to Ik> unlawful, whether made or to Im* j

limits of the Town of I'nion, or partly !
i within and partly without the corporate :
limits of the Town of I'nion, it being the 1
intent of this ordinance to prohibit any
and all contracts or agreements for the

gin, commonly called dealing in futures, I
when the intention or understanding of |
the parties is to receive or pay the differ- (

market price at the time of settlement. |

Skc. Be it further ordained that
every person who shall lteeoine a party to
any such contract or agreement as is by
this ordinance made unlawful, and every
person who shall as agent, directly or
indirectly, participate in making or furthering
or effectuating the same, and every
agent or officer of any corporation who
shall in any way knowingly aid in making
or furthering any such contract or
agreement shall lie deemed guilty of violating
this ordinance.
Skc. 4. Be it further ordained that in
all prosecutions under this ordinance,
proof that a defendent was a party to a
contract, as agent or principal, to "buy or
sell and deliver any article, thing or property,
sjiecitied or named in this ordinance
or that he was agent, directly or indirectly
or any party in making, furthering or
effectuating the same or that he was the
agent or ollieer of any corporation or association
of |M'rsons in making, furthering
or effectuating the same, and that
the article, thing or property agnvd to
lx> sold and delivered was not actually delivered,
and that settlement was made,
or agreed to Ik- made, uimn a difference
in value of the said article, thing or property,
shall constitute against such defendant
prima facie evidence of guilt of the 1
offenses prohibited in sections _> and .'i of
this ordinance.

or corporation, either as principal

ating price of cotton, grain, provisions,
stocks, bonds or other commodity or
thing of value or either of them shall I
constitute prima facie evidence of |
guilt of the otTcnse or offenses prohih-1
iled in Section 1 of this ordinance.
Skc. 7. He it further ordained that
this ordinance shall not be so const rued 1
as to prevent or render unlawful thej
posting or publishing of market quota-1
tions or prices of commodities, stocks,,
bonds and securities by any regular or-1
gani/.ed commercial exchange or any !
other bona fide trade organization,
where no purchase or sale of future delivery
on margin is permitted.
Skc. H. That no person or corporation
committing any of the acts or
things prohibited, shall in defense |
thereof be permitted to plead the pay- i
ment of any license or tax to the mu- (
nicipality, nor shall the payment of
any license or other tax in any wi*eop- j
erate to relieve such offender from the i
penalties imposed by this act.
j Skc. 9. He it further ordained that
\ all parts of any ordinance or ordinances i
eon dieting with this ordinance be, and
the same are hereby repealed.
Skc. 10. Any person or persons, association
of persons or corporation violating
any section of this ordinance,
shall be pifnished by a fine of not more
than One Hundred ($lo<>) Dollars or suffer
imprisonment for not more than I
thirty days for each otlensc or violation |
of the same.
