UNION'S DISPENSARIES CLOSED |

the said action. This petition was }
5ranted by order dated 26th day of I
ugust, 1005. At the hearing which
was had on 4th September, 1905, the
original Defendants^ above set out,
made return and joined in the prayer ,
of the complaint. The Defendants,
T. J. Retenbaugh, E. C. Howze and
Joseph Sanders, made return, denying
some of the allegations of the complaint
and asked that the complaint
l>c dismissed and that the law relating
to the closing of Dispensaries be enforced
in accordance with the election
held on I5th August, 1906.
After careful consideration and full
argument I have readied the conclusion
and so adjudge that the Act of
1901, by authority of which the said
election was held, is constitutional
and has none of the vices charged
against it herein ; and that the petition
upon which the election was ordered
contained the required number of
qualified electors, and that the special
election held thereunder, which special
election was authorized by said act of
1904, was legally and fairly conducted
by the machinery provided by law,
and that it resulted in a decided majority
for "No Dispensary," which result
has been duly declared.
It is therefore the duty of said Defendants
to at once close the Dispensaries
of Union County aforesaid, as
required by the said Act of the Legislature,
and this application for an injunction
to restrain and prevent them
from complying with such mandatory
requirement of law must be and is
denied.
The restraining order herein by me
granted August 22nd, 1905. has expired
at this hearing, and is hereby declared
110 longer operative ; therefore let the
Dispensaries in said County be closed.

upon constitutional grounds.
The supreme court does not meet
until NovcmlxT next. In the meantime
the dispensaries will remain
closed in obedience to the decree of
Judge Townsend.

Mr. R. M. Fincher, chairman of
the county board of control, says
as soon as he was served with the
decretal order of Judge Townsend
he notified all of the dispensers to i

Wednesday afternoon Mr. Fincher
was served with a notice signed by

and Stanyarne Wilson, attorneys
for Betenbaugh, Howse and
Sanders, to take Immediate charge
of all of the stock of beer and
liquors at three dispensaries and to
I close the doors of said dispensaries
as required by the order granted by
his Honor, Judge D. A. Townscnd,
that upon the failure of the Board
jof Control to carry into effect the
said order, legal action willhe taken
against said board. When Mr.
Fincher was served with this notice
he consulted his attorneys, and told
of the notice he had given the dispensers
on Tuesday afternoon.
We have teen informed that on
Wednesday Attorneys Evans and
Melton had the unblushing audacity
to go to Judge Townscnd and ask
him if he would grant them an
order staying the execution pf his
order to p}o?e thfr dispensaries. ~
Judge Townscnd very promptly and indignantly
resented this and re- j
marked that he had carefully con- |
BHlereti the matter and felt that lie
wa? right in his decision. Wednesday
night Messrs. Melton and
Evans applied to Judge Klugh at
his room for an order staying the
execution of Judge Townsend's
order, cloning the county dispensaries.
Judge Klugh very promptly
and properly refused to grant any
order at all.
We are surprised that lawyers
knew no more law than to ask one
circuit judge to vacate an order of
another circuit judge. We are told
that these lawyers will go before
Associate Justice Gary today for an
order staying the immediate execution
of Judge Townsend's order,
and in view of this fact the doors d(
