"He was facing Going, by turning around in stooping position toward Mr. > Going who was leaning on the desk. Cross examination. The question as to Mr. Splawn's position was not asked me by auyone except Mr. Duncan and Mr. J. C. Wallace. Mr. Going did not have an angry look b< tore the shooting. I never heard a word between them. Dr. M. T. Smith?I reached Mr. J. M. Splawn about 7 o'clock. I was called by telephone. Met them taking him homo. Made examination, found one shot in olbow of right arm, another in angle of j?w passed out near spine, one entered spinal column at side, another grazed the hip. The shot striking angle of jaw ranged downward and came out aix inches below aud near spine. Another struck olbow, ranged ud and passed i out five or t*ix inches ubovc. Iin mediate cause of death hemorhage. Only necessarily fatal wound was the one in his back. Did not get the hall. Found several portions of the i ullet ihnt struck the rib. Found no ball in the body.
