of Maryland, abrogating the "license
agreements" and paves the way for
the retrial of the criminal suit against
the "bath tub trust." the first trial of
which occurred several months ago
and resulted in a disagreement.

sistant to the attorney general, who
prepared the case and argued It, said
tonight:
"In the argument in the supreme
court the main reliance of the de?
fense was in Dick vs. Harry, called
the mimeograph case, rendered by
the supreme court last March. There
it was held that the owner of a patent
on a mimeograph may compel the
purchaser of the patented mimeo?
graph to buy from him (the patentee)
all paper and ink which is to be used
on the mimeograph, although, of
course, the paper and ink are not
covered by the patent.
"The decision of today refused to '
extend the doctrine of the 'Dick cuse'
to the unpatented product of a pat?
ented machine. The defendants in the j

bath tub case, owning patents on
machines used in the manufacture of
enameled ware all made agreements
to fix prices and destroy competition
in commerce In the unpatented ware.
"The economic effect of the pros?
ecution by Attorney General Wicker
sham is interesting. The combination
commenced operation in June, 1910,
At once complaints poured into the
department of justice. The attorney
general commenced proceedings July,
1910. Since the combination was
broken up, the prices of the products
have fallen from 25 to 40 per cent,
yet today nearly all of the manufac?
turers engaged in the business are
running their factories overtime, and
they are making money at the re?
duced prices prevailing in this period
of competition."
