Floyd Allen, aged ~>0, tall and gaunt, much the familiar type of the mountaineer, was in the dock. Judge Massie mounted the bench and Prosecutor Foster moved sen? tence upon Allen, who stood up. There was a shuttling of feet and a general movement among the mountaineers in the back of the room, but no sign to foretell the terrible tragedy then in the minds of every one of them. The usual legal formalities over, Judge Massie began pronouncing sen? tence. The last words that fell from his lips precipitated the tragedy. 1 "One year at hard labor?" Before the last word was cold, the fusllade began. Allen muttering an oath that he would never go to prison, sprang OUt of the prisoner's dock as Judge Massie collapsed upon the beach, Another roar >f shots and Prosecutor Footer was on the floor in a heap. March 15.?The end of the day'i chaee of the Hlllavllle raiders brought the death list of the court houne tragedy and its sequel up to five, Sidna and Floyd Allen, two of the chlefa of the hand which rode down on the Carrol] oounty court house yesterday and assassinated the judge, the proaecutor and the sheriff, are in captivity, both wounded severely. Sidna Allen's wife Is dead, shot in a pitched battle with a posse in the n OUntalne while helping defend her outlaw husband. The fifth death was that of Nancy Ayr. s. a 1'.t-y. ar-old girl, accidentally shot during the fusillade In the court house. All the other members of the gang, probably 18, are up in the mountains off toward North Carolina, well arm? ed, well supplied and determined not to be taken alive. The storming of Bldna Alien's house today was like a bombard" ment. The posse trailed through the hush four miles up the ridge and sur? rounded his cabin In a grove. The Blues collected <f this subscription $598.50 and the Reds, $237.50, or a total collected of $s;;?', At the commencement of tin* eonteat it was decided that the team makin ? the largest number of points should be the winner of the contest. The total amount of subscriptions se ( ured sh< uld be added to the total amount collected In reckoning tin points. By this method the Blues have 2,;:.:; points and the Reds 1,900 points. The Blues are therefor" the winners of the contest by 553 points. The cigars are on the Beds and they will hava to sit in tie- seats of the lowly at the big supper while the Blues will he seated at the head of the table and be the honor guests. The membership roll now shows a total membership of 332. Of these ten members are honorary, leaving 312 paying members. Last year there were 2 ?'?:'. paying members. Of these 220 (dd members have renewed their membership or 4 3 former mem? bers who have dropped out. Of these 4 3, two nave died, six have left the City, three have been dropped for refusal to pay their dues, nine have been suspended until their back dues have been paid and the remaining 23 while in good standing have not renewed their membership. Ninety three new members have been secured which with the 220 former members and nine honorary gives a total mem? bership for the coming year of 332. GRAND JURY DEFERS ACTION. Takes no Action on Magistrates' Dock, ets Matter, but Warns Officers. The grand jury, after the hearing of a number of persons on the mat? ter of the county turning over to the city of Bumter tin sum of $12,000 for increasing the county and city rail? road facilities and the matter was set? tled insofar as tiny were concerned by their passing i resolution advis? ing that the sum be paid as directed and authorised by the legislature, took up the matter of magis? trates n?u keeping their dockets prop? erly. All of the dockets of the magis? trates in the county were up before the grand jury for inspection and gom over thoroughly. After their in. veatlgatlon the grand jury decided not to take any active steps at this time, but to send a notice to each magis? trate in the county warning him that be must have his dockets kept regu I larly as proacrlbed by law or that i st' ps would be taken against him When the grand jury again convened. The decision reached by the grand jury was that it was best to warn the I magistrates once more before they took action, the matter being more for the purpoae of investigation, with a view of making recommendations at their next meeting than with a view of taking action. Manning, and sev? eral of the business men of the city of Bumter. After a full discussion of the Act, and after hearing the fin? ancial condition of the county dis? cussed, both by the Supervisor and Mr. Leiser, the grand jury passed unanimously the following resolution: Reaolved, That it is the opinion of the grand jury of Bumter County, that the County Board of Commissioners should at once pay over to the City of Bumter the $12,000 provided for in tin- Act of the legislature out of its ordinals' county fund! provided, that the fund of $4,650 remaining in the hands of the County Treasurer !><? not disturbed.
