Carlisle, former president of the
Newberry National Hank, who was
convicted last week on live counts of
an Indictment alleging misapplication
Of the funds of the institution.
The sentence was passed by Judge
Brawley when court convened this
morning, the motion for a new trial
having been argued and refused yes- ,
terday afternoon.

Notice of appeal was given by the
attorney for the defense. This appeal
is to the circuit court of appeals. I

Richmond, Va. It is not believed that

the appeal with be brought up until
the May session of that court:

court yesterday affirmed the judg
ment of the circuit court In a will ?
! case from Sumter county Involving
over $6,000. The case was that of j
R, E. McElveen as administrator of
the estate of Eunice Olivia King, de- i
ceased, against C. F. King. The opin- I
ion is by Chief Justice Jones.
The action was brought by the
administrator of the estate of Mrs.
E. O. K'ng, who died August 1906,
! against the husband of the deceased
j to recover certain money alleged to
j belong to the estate which was held
by the husband. The complainant de?
manded an accounting of all of the ,
funds In the hands of C. F. King.
Upon the report of the testimony
by master of Sumter county the j
case was heard by Judge Sease, who
made a decree that R. E. McElveen.
the administrator of the estate, re?
cover the sum of $6,102.49 from C.
F. King, with interest from February
16, 1909, the date of the letters of
administration.
There was a check for over $6,000
received by Mrs. King a few days be?
fore her death. This was indorsed in
1 blank and turned over to her hus
i band. He placed the check to his
j credit In the bank. It was the con?
tention of C. F. King that this was a
gift.
"The case depends." says the opin
? ion, "upon the question whether Mrs.
i King made a gift of the money to
j her husband or placed it in his hands .
as her agent or in trust. The circuit
ceurt held that the check was not a
j gift, but placed In trust, and this
I contention Is upheld by the supreme
court.
