THAW WOULD BE BOSS.
Story of Row His Counsel Were Cho?
sen:-Senator Knox Rejected de?
tainer.
A Xew York dispatch says:
Light on the hidden perplexities of
Mrs. William Thaw in the matter of
dealing with the problem of counsel
for her son was obtained yesterday
from an authoritative source.
It was declared that it was Mrs.
William Thaw's original purpose to
have Harry Thaw declared insane
and committed to an asylum or sani?
tarium last summer, and thereby
avoid his trial for murder, with the
attendant disclosures.
All the data necessary for a suc?
cessful plea of insanity had been col?
lected within a few weeks after thc
killing of Stanford White, by Olcott,
?Gruber, Bonynge & McManus and
Daniel O'Reilly, the original counsel
in "the case. The night of the murder
O'Reilly started iii on his own re?
sponsibility on the insanity plea an i
rounded up the different policemen
^attached to the West 30th street po?
lice station, who subsequently testi?
fied to Thaw's irrational behavior the
first night of his incarceration.
The alienists whom ex-Judge. Ol?
dorfs firm immediately retained and
who saw Thaw soon after he was re?
moved to the Tombs and looked into
his family history all pronounced him
it is said, mentally irresponsible, and
?x-Judge Olcott's firm went ahead on
this theorv with the full .notion of
: rs. Thaw, senior, it is asserted.
These plans were all upset by
Thaw himself. After he had talked
with his two personal friends, Clif-,
ford W; Hartridge and John B. Glea?
son, Thaw, it is said, became convinc?
ed that an appeal to the higher or
unwritten law would result in his ac
c uittal and a complete, vindication of
his killing of White. He was confi?
dent not only of escaping the electric
-chair, but of_avoiding incarceration
. in an^yT??m or sanitarium. His wife,
,-it-is~said, took this view of the case
j ^ilso.
Mrs. William Thaw opposed any
.change in the original plans with the
.greatest determination, but was
powerless to shake her son's resolve.
He being of age and supposedly men?
tally competent, it was impossible for
"the mother to compel obedience to
her wishes. Most reluctantly she con?
sented zo the retirement of ex-Judge
Olcott's firm and the substitution of
the other lawyers.
Shortly before the trial began Mrs.
"William Thaw, greatly perturbed in
mind, made a hurried trip to Pitts-;
burg and held a series of conferences
with United States Senator Knox,
D. C. Watson and Charles F. Mc
Kenna* former United States dis?
trict attorney for Porto Rico. She
besought each one of them in turn to
take charge of her son's defense. It
is said "that she offered Senator Knox
and Mr. Watson $100,000 and Mr.
^.McKenna almost as much.
Each of the Pittsburg lawyers, it is
?aid, objected to entering the case on
the ground that the lawyers with
whom young Thaw had surrounded
"himself made harmonious co-opera?
tion impossible. Each one also in?
sisted that insanity was the only ten
-able plea which the defense had.
One of the Pittsburg lawyers told
Mrs. Thaw, it is said, that if she
.could eliminate certain of her son's
- counsel^and make him understand
that insanity" ^aust be the plea, her
--offer would be ^ giren consideration.
v
This lawyer told her it was his wish 1
that Daniel O'Reilly be continued in j
the case and that Delphin M. Dei- j
mas might remain, but only as as?
sistant advisory counsel. ;
Mrs. Thaw returned to this city, it
being arranged that Mr. Watson
..should follow in a few days and see
what progress had been made along
the lines indicated by the Pitts?
burg lawyers. Mr. Watson did come
here and, it is understood, had a con?
ference in which Mr. Hartridge was
the chief speaker. What happend
?could not be learned, but it is stated
that the conference '.erminated sud?
denly. Mr. Watson, much incensed,
-washed his hands of the whole mat?
ter, and when he returned to Pitts
"burg and related the hapenings to j
Senator Knox and Mr. McKenna,
they absolutely refused to have any?
thing to do with the case.
They explained to Mrs. William
Thaw that it would be utterly im?
possible for them to conduct the de?
fense along proper lines so tong as
Harry Thaw had one word to say
about its management, and that if
the course which the young man
wanted, to pursue were followed it
would simply mean the exhibition to
the public of family skeletons, while
the final outcome weald be the same
-young Thaw in an insane asylum.
It is stated that a peculiar shding
?scale system of compensation has
2>een arranged with Thaw's lawyers.
"Should young Thaw by any chance
go to the electric chair the lawyers
were to get $50.000. If he went *o
an asylum the fees were to aggregate
$200.000, and should he be acquitte'!,
it is said, the stupendous sum of
$500.000 would be paid.
One of Thaw's lawyers, when ask
.ed about this sliding scale of pay?
ment, said he did not know what ar?
rangements had been made by the
? ''ly with the other counsel.
He said he simply knew the arrange?
ment which had been made with
himself, and that his compensation
was not dependent upon any outcome
of the trial.
It was learned yesterday that when
Olcott, Gruber, Bonynge & McManus
were in charge of the defense, one
of the members of the firm, after a
lons: conference with Thaw in the
Tombs, failed utterly to get the pris?
oner to take a reasonable view of the
matter being discussed. Somewhat
exasperated* 'the lawyer finally said:
"See here, Mr. Thaw, you fail to
see this case in its proper light. We
are the doctors and you are the pa?
tient."
"Oh, no," replied Thaw, haughtily,
"you misunderstand our relative po?
sitions. I am the general in com?
mand; you are merely my adjutants."
MADE A FIXE TRIP.
Mi*. T. B. Jenkins and Mr. Tow?es
Came Down From Sumter Wednes
ady in a Xew Reo. Car.
Mr. T. B. Jenkins, the enterprising
and popular president of the Charles?
ton Motor Company, made a trip
down from Sumter yesteday in a new
Reo car, bringing the purchaser, Mr.
Towles, over the roads and bridges
and ferries, just to show what the
car could do, and for the pleasure of
a cross-country spin. In speaking of
the trip last night" at the Charleston
Hotel Mr. Jenkins said that the dis?
tance covered was about one hundred
and fifty miles, it being necessary to
take a round-about course in order
to reach certain ferries, and that
the actual running time was seven
and a half hours. "This was more
than 50 per cent, of the time under
water," he said, "and, of course, you
eannot>rur* very fast with water and
. mud to the hubs of the wheels. We
made good time whenever the road
; was even tolerable, and got here with?
out accident. It consumed eleven gal?
lons of gasoline. The machine car- j
ries twelve gallons, so we came
through without replenishing."
Talking of roads and road build?
ing Mr. Jenkins said that it had been
two months since he had visted Sum?
ter and he found a stretch of road?
way leading out from that city about
ten miles that had since his last trip
been transformed from a sand bed
into a hard and well-drained road
i wav. The work had been done by
convict labor and had proven a great
success.--News and Courier.
CLARK WHISKEY ACCEPTED.
That is the Report at Columbia-In?
teresting Comment as to this Cele?
brated Purchase and its Probable
Disposition.
Columbia, April 17.-It is reported
here today that the commission to
wind up the State dispensary has
concluded to accept the celebrated
Clark purchase of whiskey, which
was mature of the last investiga?
tion >l the State dispensary by the
Ch^stensen committee. There are
about 900 barrels of whiskey remain?
ing of this lot.
The commission adjourned last week
and nothing at that time was given
out concerning the acceptance of the
Clark offer, which has been pending
for some time. CI rman W. J. Mur?
ray, of the commission, declined to?
day to say anything about the mat?
ter. Senator F. H. Weston, attorney
for Clark Brothers, also declined to
talk. Mr. Y?'. F. Stevenson, who is
attorney for the commission, is not
in the city. Attoreny General Lyon
knew nothing about it.
The commission has had a number
of calls from county boards within
the last few months for cheap c*;rn
whiskey, and the acceptance of the
whiskey may be defended on the
ground that it is needed though at
this time most of the county boards
are opening bids advertised for dur?
ing the last month, and will soon
make their own purchases, no longer 1
being confined to the stock within the
old State dispensary. There may be
other reasons, however, which will
justify the acceptance of this whis?
key in the eyes of the people when
the reasons of the commission are
made public.
It will be recalled that it was the
purchase of the Clark whiskey by the
old directors of the State dispensary
which was the principal ground upon
j which Governor Ansel was asked by
the legislature to remove that board,
aid upon which he did remove the
board. It was brought out by the
Christensen committee that 1,600
barrels of this whiskey was bought
from Clark Brothers, at Peoria, by
Mr. John Black in person; that a
purchase was also made at that time
from Lehman & Co., which is the
same firm as Clark, and of this Leh?
man purchase 300 barrels more were
shipped to the State dispensary; that
the "licuor thus purchased by Mr.
Black from Clark Brothers & Sons
at $1.50 to $1.75 per gallon is a v*-ry
inferior quality of liquor, being what
is known as high wine, and is not
worth more than $1.33 t-> $1.35 per
gallon, and can be bought in the
market at that price." The order to
Clark, it will be recalled, was held
up. but there are said to have been
on hand when the Clark proposition
was made to the commission at least
S05 barrels of the Clark whiskey and
100 barrels of the Lehman whiskey
The terms on which it has been ac
cepted have not been made public,
but it is understood that the whiskey
is now being dumped at the State dis?
pensary and bottled up.
Of course, if the county boards now
refuse to take any of this whiskey
(which upon good authority has been
pronounced by a legislative commit?
tee in formal report to be inferior,
as well as illegally bought,) the com?
mission may have some trouble in
disposing of it. but it is presumed
that the commission has thought out
the matter and knows what it is do?
ing. It may be said, however, with?
out prejudice and without desire to
criticise or injure the commission,
that the acceptance of this whiskey
has caused no little surprise among
those who are posted on dispensary
affairs.
As stated several days ago, the
commission has turned down about
$200,000 worth of whiskey, notifying
the houses from whom it was bought
by the old board that their goods
were here at their disposal and refus?
ing to pay their claims. It was not
stated at the time whether or not the
Clark whiskey was in this rejected lot
or not. The value of the Clrak whis?
key, as invoiced to the dispensary,
would .alone amount to about $60,000.
