We, the grand jury for Sumter j county, beg to make this, our first, j presentment. j T?Ve have examined into and re j turned al! bills given us by the act ! ing solicitor. ! j We have, through our committees, ! visited the several county ?nices, j chaingang. 'alms house, jail and cis ! pensarles and find them all, without I exception in splendid and satisfactory i condition. Ed Tilt tn, co:: fined since October 0. 1.9,06, solely as ja witness in the case of the Stat: S against Spivens and McCoomer, said jcase being on appeal to the suprmc court, but not yet reached by that honorable body, and as tb.s witness has been used in the court we do not see the good end to be sei ved by thc further retention of this witness fox possibly six months or a year, thus depriving him of his liberty on a mere presumption of what the su? preme court will do in this case. Therefore we respectfully recommend that your Honor forthwith order the release of said Tilton. We are sorry to report that severa} of our former recommendations have not been carried out, notably the col? lection of the amount due the county by the Mayesville dispenser. Complaint has been made to u:> by one of the magistrates of the county that default has occurrred in 'a number of appearance bonds in the magistrates' courts and no action has been taken on same. We respectfully ask your Honor to instruct the prop? er officers to give this matter their at? tention. We respectfully call to your Hon? or's attention that a number of wit? nesses bound over for appearance a* court have failed to attend thus re? tarding the progress of the court, and entailing considerable expense to the county. We therefore ask that your Honor take such steps as are neces? sary to prevent a recurrence of the' same. There is confied in the county jail one Levi Henderson, held under a warrant issued by a magistrate of the' county charging assault with intent to ravish. We are informed that no indictement has been brought against this prisoner. After careful inquiry into and consideration of this case, we, the grand jury, believe that tho ends of justice will best be served by the release from custody of the said Levi Henderson, and we respectfully ask your Honor to effect the same. We desire to extend our thanks to his Honor, the Presiding Judge, the . Acting Solicitor, and all other officers of the court for courtesies shown us during the term. Dove, who was laid to rest in ! the cemetery here on Tuesday last. j. Mr. Dove, though not ? native of ! To his wife and children ho was the kind and affectionate husband and father, and by them he was almost idolized. When the war between the States was declared he hurried to the front and made a brave and faithful sol? dier, having seen a full share of fighting in the west. At one amelie was captured and placed in prison in Xew Orleans, where he was confined for months and the hardship he suf? fered and indignities to which he was subjected constituted a thrilling chapter in the history of his life. Chancing to be in Sumter at the time of Potter's raid near the close of the war, he took part in the fa? mous (locally) fight of Dingle's mill, and was in command of one of the two guns that were used with splen? did effect-though unsuccessful in the end-to keep the enemy from crossing ^the swamp. It is said htat he was the last man to leave the bat? tle ground and that he stood to his gun so doggedly, heedless of the near approach of the enemy that when he quitted the protection of breast works, there seemed scant hope of his escape from the hail of lead hat fell around him, but he came away unscathed. These old Confederate heroes are rapidly pass? ing away, but their memory shall al? ways be dear to the southern heart, and of them the loyal southerner will join in singing: "Hard sleep the brave who sink to rest, Ey all their country's wishes blessed! When spring, with dewy fingers cold, Returns to deck their hallowed mould, She then shall dress a sweeter sod Than fancy's feet have ever trod," etc., etc. A Friend. Sumter, April 4, 1907.
