Trying to Find Out
-
Wn?t tbe Term "Original
Package" Means.
Fron Tae Sute, July 16.
The absorbing issue still seems to
be "What is an original package ?"
bout the only light that has been
rown on the subject ia-contained in
statement givep the press a few
ays ago by Attorney General Bar
r, but as yet lhere is no way for a
an contemplating entering the busi
ess of selling original packages to
H what to do in order to come with
tbe pale of Judge Simonton's de
?3?ons and be safe from molestation
the constables. The State has
so far as to hold that separate
packages of liquor cannot be shipped
in a car packed in straw and be con
sidered original packages, but must
S - come each bottle in a case addressed
to the consignee. If a box contain?
ing bottles of liquors comes then the
box must not be broken On all
^ sides arrests of persons who are open
ing origin al package stores are being
made, and the result is that in the
absence of tho text of the governor's
?Q8trac?ons to bis constables, many
? who have been contemplating enter
J ing the business are holding -back
, waiting to seje if Jndge Siraonton
HNvill not.soon say what he m^.-ins by
Span original package in exact terms
T^e object in holding back the in?
structions to the constabulary is ?aid
tc be to frighten off as many would
K bo dealers as possible The State is
in no wise anxious, it is said, to have
the t?rm specifically defined
Yesterday another original package
Rstore was ' closed up, making the
fourth in the last three days This
one was in Greenville The exact
- canse is not known in this case
In Columbia Mr. W. B. Meetz pro
poses to open his place on Saturday
morning at the same time the dis?
pensaries open His liquor will
come put up in bottles packed in
pasteboard boxes. He has had the
half pint packages he proposes to use
treasured to see that they hold a half
pint. He does_ not propose to break
the packages he receives, but will
sell them in the original form He is
advised that such packages are origi?
nal packages in the eyes of the law,
and proposes to test the matter ic the
ccur?s immediately if the constables
make any attempt to interfere He
bas employed ex-Solicitor P.. H Nel?
son to represent bim in any proceed
ings that may follow the opening cf
his store The others in the city
who desire to enter the original pack?
age business will combine with Mr
Meetze to secare an immediate an?
swer to the question as to wha| con?
stitutes an ontginal package
It is said that the Florence and
Chester parties already arrested have
been, to Charleston to see Judge Si
mouton, bot could not find bim inas
mach as be is now* at his sommer
home at Flat Rock, jN C.
Already an original package beer
place is in operation in Colombia and
no effort bas been made to interfere.
It is being ran by ? E. Cartis k Co.
at 930 Gervais- street Mr Cortie is
acting as agent for the Georgia Brew
ing company and is selling beer in
crates of two dozen each. He does
not break the original crate He
sells at $1.80 a crate at first, but
parties continuing to parchase from
bim can secare the crates at $1 50
each.
From all over the State come re
ports of the opening of original pack?
age stores and they are jost begin?
ning to open so far In a few days,
no doubt, they will be springing up
on every side and soon their name
will be legion. Then the State dis?
pensary will begin to experience the
effects of competition No matter
w l-at answer, is given as to what con
8titutes an original package il is very
certain that at least until January the
dispensary system wiil have to.meet
very sharp competition all over the
State, for the packages will be sold
in one form or another. No doubt
the State will endeavor to make it as
troublesome as possible for those em?
barking in the business in opposition
to the State, bot it is doubted if this
will kill out the competition
A prominent official yesterday re?
marked that it looked to him that the
general assemply at its next session
would have to pass a prohibition law
In his opinion that would be the only
way to settle the issue. He appear
ed to have no confidence in the fu?
ture of the dispensary system. This
was said before the news came from
Washington that Senator Tillman had
secured the pa*sage of the diupen6ary
bill, about which so mach has been
said of late. The information came
in the shape of a telegram from the
senator himself to Governor Ellerbe
about 4 o'clock Governor Ellerbe
seemed to be very much pleased at

Special io The Si??e.
Charlearon. July 16.-Late last af
terc^on Mr B. A. Hagood appeared
before Judge Siraocton at Flat Rock,
N C.. and-petitioned foran injunction
in behalf -of S. Guckeobeimer & Sons,
of Savannah. Ga., restraining the
State constables from interfering with
any and all of their 'original package''
agencies throughout the State. The
prayer for relier and injunction is the
result of the raiding of Guckenheioaer's
agency, conducted by George Stackley
at Florence, several days ago The
complainants aver that they have suffer
ed damages to the amount of $5,000
and are threatened with damages to
the extent of J 10,000 or more. Upon
the reading of the bill of complaint
Judge Siroontoo issued a temporary in?
junction against the constables and a
rule compelling them to show cause, on
August 9?h, why they should not be
restrained as prayed for io tbe bill
It is said that Stackley is one of the
most prominent citizens of Florence.
3e opened his establishment and wa<r
oondncted it upon the advice of his at
toroevs, Messrs. Willcox & Willcox
The place was being ruo in strict con?
formity with the act and Judge Simon
ton's injunction, and the i-aiding of it
wa^ nothing bat the venting of spite
on the part of the constable.*, BO the
storv roos. They were unable to find
any irregularity in the manner of i's
conduct, t?o thoy set up the charge that.

m
^There is an interesting little story
now h??ng told in counection with the
opening of Stack?ey's establishment.
It is said that when he accepted the
agency he visited Charleston and pur?
chased a number of styles of di?pen
sary liquor from the Charleston hotel.
These boVtles were of oourse emptied
of theis contents and then forwarded to
Guckeobeimer & Co , with the request
that they should bottle the 'liquor for the
Florence agency in similar styles of
bottles. The Savanah firm acted upon
the request of its agent, the bottles
were made in imitation of the dispen
sar? bottles, filled with liquor and sent
to Florence.
Now the question arises how caq the
State charge Stackley with violafiog
the law by selling less than one-half
pint packages, when it. is doing the
very same thing. It is probable that
when the ease comes to triai, the attor
ney genera! may be called upon to ex?
plain this inconsistency.
Tbe fact that the jojos, as the dispen?
sary flasks are familiarly called, do not
hold the measure they are said to con?
tain bas often been noted ia tba pa?
pers of the State, and cannot' be news
at chis -late day. However several,
well know citizens as a matter of curios?
ity procured a number of dispensary
bottles and flasks to-day, and measured
them. The measure of course fell
short, lt required eight dispensary
naif-pint flasks to make seven of the
standard size bottles, which ts equivalent
to saying that to every seven half pints
sold, the State makes a half-pint clear
profit The same proportion of short?
age is maintained in the quart bottles
and flasks In view of this shortage it
appears that the State will have some?
thing of a boomerang on irs bands

This interesting communication reach?

To the Editor of The State :
I observe in the proceedings of the
senatorial campaign reported from
Aiken that Candidate Irby io his ha?

j was a political corpse ; so Mayfield is
an orphan.*' in repiy,-{ will say, Mr.
Mayfield is not my "baby," but is the
distinguished son of a ooble sire, and
a gentleman in the truest sense.
The most that I have bad to do in
creating political misfortunes was the
part taken in advancing the possibilities
of a very unworthy blatherskite aud
fraud, who for six years misrepiesented
the people of Sou:b Carolina in the
United States Senate, and h?9 name is
John Laurens Manning Irby.
I may be a "political corpse.'' but.
thank God I I am not a moral mounte?

Toe senatorial primary in Laurens

i Governor TaJks About May
I field's Statement at Edge
field.
Governor Elierbe had something to
say about Mr. Mayfield's statement
on the stump at Edgefield quoting
the governor as saying he wished to
form a new party The Evening Rec?
ord thu? reports what the governor
had to say :
"Governor Ellerbe was asked this
morning about this statement. He
was very much surprised that May?
field should have made it and insisted
that Mayfield must have been mis?
quoted by the reporter.
"The facts of the matter, as stated
by the governor, a^e as follows :
"Mayfield came into his office and
gave information of his intention to
be a senatorial candidate. Mayfield
then asked he governor what course
he would pursue, desiring to know
if the governor, because of his ap
pointment of McLaurin, was going
to make any special effort to secure
his election.
"Governor Ellerbe replied that
while McLaurin was in the senate by
virtue of an texecutive appointment,
that would not bias him and he
would let the senatorial race run its
own course, provided, however,
none of the candidates assailed him
and his administration, in vrhich case
he would be obliged for self preserva?
tion to oppose the man who had
dragged him into a campaign in
which he had no part or parcel. To
this, of course, Mr Mayfield could
make no objection.
"In a iriendly and confidential
I way, the governor informed Mayfield
he had heard it was his intention to
make, the race as an old, or original
Reformer and attempt to draw the
factional lines in order to profit by a
bitter division of the people As a
frieno he advised him not to pursue
such a policy, stating his belief that
the besi people of the State were
getting together irrespective of past
factional differences and that public
sentiment would not approve an
effort to divide the white voters of
South Carolina into two hostile
; camps.
"And from that slender source, if
he be correctly feported, Mayfield
constructed a cock and bull story
about the governor trying to form a
new faction."
In speaking of Col. Irby's record as
a statesman the YorkviUe Enquirer is
reminded of the mother who told the
little 3 year old beforehand, not to re?
fer to the nose of the guest who was
expected ro be at dinner that day.
The little 3 year old sat through the
meal io silence, and at its conclusion
remarked, "Momma, what did you tell
me not to say anything about Mr. Scar
face's nose for wheo' he ain't got oo
nose?" So with the record business.
Where there is no protuberance, the
candidates will have to talk about the
corresponding vacuum
