RULES AND REGULATION DULY MADE BY THE Board of Health OF THE CITY OF SUMTER, Under and by authority of Act General Assembly * ' To establi local Boards of Health in the Cit i and Towns of the State/' approv January oth. 1895. RULE 1. Composition cf Board. The Board of Health of the City of Sum: shill consist of five persons, enosen and cc stituted as provided in Section 1 o the t ot the General Assembly authorizing t establishment of the same; and wheo tb chosen they shall severally take the oa provided for city offieers. RULE 2. Officers. Section 1. The President shall preside the meetings of the Board : call ex'ra mee ings of the body, and perform all the duti usually appertaining to his office. And 1 shall have full power to administer oaths < affirmations in any proceedings or investis iion9 touching the regulations of the Boarc but shall not be entitled to receive any f therefor. Sec. 2. In the absence of the Presiden one of the other members of the Board ma be designated to perform the duties of b office. SECRETARY. Section 1. The Secretary ; sha ll attend a meetings and keep the minutes of the pr< ceedings of the Board; he shall keep a papers, books and records entrusted to h care in a safe, and convenient place in h office. Sec. 2. He shall have fall po*er to ac minister oaths or affirmations in any prc ceedings or investigations touching th regulations of the Board ; but shall not b entitled to receive any extra compensatio Therefor. Sec. 3. It shall be his duty to receive an keep a record of all certificates of births an deaths occuring within the city of Sumter. Sec. 4. ft shall be his duty, in the mont of October of each year, to prepare a repor io writing, to be submitted to the City Couti eil (in accordance with the act), of th operations of the Board for the .precedmi year, with the necessary statistics thereof together with such information and sugges tions relative to the sanitary condition am requirements of the city as the Board ma; deem proper. He shall also prepare a report to be submitted to the State Board of Healti in the month of October, containing notic of its organization and membership, ant shall forward to them copies^of all its report and publications, together with such sanit?r] information as may from time to time bt required by said State Board. Sec. 5. The Secretary" shall issue al special permits granted by the Board, and bi shall keep a record of the same and of al applications for permits in cases where per mits have been refused ; and be shall be re quired to give bond in the sum of one hun ?red dollars ($100) for the faithful discharge of his duties, and be shall receive a salary a the rate cf five dollars ($5.00) per month. HEALTH OFFICER. Section 1. The Health Officer shall keej bis office io the City Hall, pr io some com ventent p'ace in that immediate vicinity, tc be approved by the City Council, open fron: 9 o'clock a m. until 12 o'clock m. everv day, Sundays and holidays excepted, for th? convenience of the citizens; aid he shall keep a record book for complaints or notice* of nuisances to be attended to by him Hi shall prepare and publish weekly bills o? mortality ; keep a public register of all death which take place in the city ; inquire into the cause of all epidemical diseases, and re? port the same to the Board of Health or to the Mayor; make inquiries concerning the state of public health when required, and report to the Mayor or Board of Health. He shall submit to the Board of Health monthly a full report, showing the duties performed, with such suggestions and recommendations a3 he may deem expedient and proper. He shall furnish to the Board, when desired, such information in regard to the public health as may be necessary ; and report any improvement or alterations in buildings or streets that iu any wise affect the general health of the city. He shall grant burial permits and receive from the Sextons the burial certificates, keeping a record of the same; and report to the Board all violations of the ordinances concerning burials that come under his notice. He shall attend'the meetings of the Board of Health, and carry out ali orders of the Board or of* the Mayor in relation to the sanitary regulations of the city; and from time to time, and whenever ordered to do so by the Mayor or Board of Health, make a thorough and systematic examination of the city ; and he shall cart?e all nuisances to be abated with reasonable promptness. He shall keep a list of all per? sons "keeping hogs in the city, and shall note the size and location ot their enclosures, aud the number of hogs so kept. He shall exe? cute the orders of the Board, and for that purpose shall have and exercise the powers and authority of a policeman of the city. He shall collet 'all fees and pay them into the City Treasury monthly, together with all penalties which shall be recovered for the violation of any regulations of the Board. He shall accompany the Board of Health or a Committee of the Board iu their quarterly Ivisits to the schools and puolic buildings. It shall be incumbent upon him to visit every lot and residence in the city at least once a mooth and to report to the Board of Health anything be may find to endanger tbe public health, and in the course of such inspect to examine all privy vaults, privies, ?nd I other places likely to prove nuisances detrimental to the public health. RULE 7. No new burying ground, cemetery, tomb vault for dead human bodies shall bo esta lished (nor shall the remains of any dei body be placed in nny existing buryh ground, vault, tomb or cemetery in the Ci of Sumter, nor any of said receptacles open?d, exposed or disturbed) except accor tug io the terms of thepetmit therefor givi by the Board of Health. RULE 8. RULE 10. The undertukT rr person in charge shall present the certificate of deith, properly made out and signed, to the Health Officer, and this shall be an order upon him [the Health OtScei] for a burial permit. The liurial permit .-hall be taren to the cemetery or burial ground along with the body and delivered to the Sesi?n or person in charge, and said burial permit shftll be an order on him [the Sexton or person in charge of the cemetery] to allow said body to be interred. Upon tnt? Monday martling following the interment the Sexton or t-erson in charge of the cemetery shall return said permit to the Health Officer, who shnll place it OH Ile. Within time days alter receiving a certif? icate of death the Health Officer shall file it with the Secretary of the Board of Health, who shall make a record of the same in a resister kept for the purpose. RULE 13. No other person than the Coroner or a physician or surgeon who bas a license to practice in accordance wiih the State law shall give the certificate herein required to be delivered to the Health Officer to obtain a burial permit. RULE 16 Births. Every Physician, Midwife or other person who may professionally assist or advise at any birth shall make and keep a r<gistry of every such birth and therein enter the time and place of such birth and the sex and color of every child boru and the names, color, occupation and residence of each of the paren ts so far as such facts can be ascertained; and ! t shall be the duty of every person men? tioned io this section to piee?nt to the Health officer a copy of such register signed by such person, or a written statement by him or ber signed, of all the facts required to be entered in such register within three days after the nirth of any person to whom such register may or should relate. RULE 17 Every person who shall omit to keep the register hereinbefore required, cr shall omit to report a written copy of the same to the Health Officer within three days after any birth, or shall wilfully make * false or ficti? tious entry in his or her record of births, or in the certified cony of such register delivered to the said health efficer, shall be subject for each and every omission or false entry to a fine of not more than twenty [$20.00J dollars, nnd in default of paying tbe same shall suffer imprisonment not exceeding 20 days. RULE 18. RULE 25. The Superintendent of Streets shall be quired to I.ive the dirt, filth, garbage and kinds of offal removed from the streets, lan nlley s and open courts of the ci ?y dailv ; a the said dirt, filth, garoage and offal shajl deposited by him at such place or places may be designated hy the . And tue Superintendent shall liaole to a fice of not more than five doll* for each and every ?ct of omission or defau to be imposed by the Mayor or the Board Health whenever io their opinion such ne !ect may be detrimental to the public healt or the Mayor may in his discretion have t work done at the expense and ruk of t sain Superintendent and have the sum pa therefor deducted from his pay. RULE 26. Low Lois. It shall not be lawful for any person permit any lot in bis possession or under b control in the city of Sumter to be kept : such a condition as to hold water in holes < pools after a rain, but all lots shall be ke] in such order that the water from rains sha easily and quickly flow therefrom: and ao person who may be convicted of a violatio of this section of this ordinance may be fine not more than ten dollars ($10) or in prisoned not more than ten days in the cit prison ; anti in addition thereto the Mayor c City Council may have and order any lot nc properly kept tn condition after no'ice, put i proper condition at the expense of the perso in possession or who has it under his contro md recover the expense thereof in any com of competent jurisdiction, in an actio brought in the name of said city. RULE 27. Dry Wells. It shall not be lawful for any person i the city of Sumter to permit any privy o cesspool to be kept in a filthy or unhealth, condition, but all such places must be cleanei sufficiently often to keep them from becomini offensive. Provided 'hat no privy or ress pool shall be erected or maintained withii iwenty feet of any of the streets of the Cit; of Sumter. RULE 28. Whenever any vault or privy becomes of Tensive the owner or occupant of the premise: shall remove or cleanse within forry-eigh boure after notice in writing to that effec shall be given hy the Board of Health. Ir case of neglect or reiusal of the same thej shall be fined not more than $10.00 or in prisoned more than 10 days. RULE 23. It shall not be lawful for any person oi persons to connect any vault, privy or water closet upon any lot with any of the drains ol the City, or to discharge or convey the con? tents thereof into any such drain, and any such person or persons offending herein, whether be or they be owners or occupants cf 5ucb lot. shall be fined not more than fifty [$50 00] dollars, or imprisoned not more than 30 days for each and every offense, and also a further additional sum for each and every day that the said grievances, or any of them, shall continue after a written notice from the Mayor or Board of Health to abate or discontinue the same. And any person rt ho shall be concerned or engaged in the building or construction of any means ot con? veyance or connection for the purposes afore? said, or any of them, &ball foi feit and pay to the city for each and every offense the ?um of ten ($10.00) dollars. RULE 30. It shall be unlawful to dig any new ditch? 's or trenches for any purpose, or to open up my old ones so as to expose the upturned ?arth during the months of June, July, Au? gust and September, except in cases of small excavations, and then only alter special per? mit from the Board of Health, and any per? ron who may violate this rule may be lined r?y the Mayor or Board of Health on convie lion thereof, not more than twenty dollars >r he imprisoned in tho City prison not more t!-?an twenty days; Provided that this shall lot apply to persons cultivating the sci! in their yards, gardens or lots. RULE 31. RULE 32. Physicians to Report In fectious and Pestilential Diseases. It shall he the duty of every Physician or o'lier (fffdti who may be called noon to nt tend any person with any infectious, conta? gious or pestilential disease in the Citv of Sumter, to lei-ort to the Board of Health within twenty-four hours afterwards, the as ceriKir.ir.ent of such disease, the nature of lue ci.-ease and the premises on which the same may he. RULE 33. Sec. 1. RULE 34. There shall not be a public or church fun er? I of any person who hus died of small pox, diphtheria, scarlet fever, yellow fever, typhus fever, or Asiatic cholera; but the funeral of such person shall be private, arid it shall not be lawful to invite or permit at the funeral of an\ person who has died of any of the above diseases, or of any contagious or pes? tilential disease, or at any services connected therewith, any person whose attendance is not necessary or to whom there is danger of contagion thereby. For every violation of this rule tbs person so offending shall he fined not more than twenty-five dollars ($25) or be imprisoned not more than twenty days. RULE 35. The bringing of bodies of persons into Sumter who shall have died of any of the aforementioned diseases is strictly forbidden, under a penalty of fifty dollars ($50) fine or thirtv da\s imprisonment RULE ?6. In ali cases, railroad and transportation companies shall obtain permission to bring bodies of deceased persons, from the Health Officer or from regular physicians of the place from which the body is brought. RULE 37. No owner or driver, or any other person having charge of any carriage or other vehicle used as a public conveyance shall re ceive or permit to he placed, or convey in any manner in or upon said vehicle, any per? son sick or infected with small pox or other contagious disease, under a penalty of fifty dollars [S50] fine or imprisonment not ex? ceeding thirty days. RULE 33. The body of any person who dies of small pox shall be removed in a burial hearse and in no other conveyance. RULE 39. Glanders. Section 1. It shall not be lawful for any person to bring or Keep within the city limits of Sumter ?nj horse or other animal having a disea-- ? ? wn as "glanders" or "farcy." S c '? "?? "e owner, agent, or any other person m ? h -ge of an animal so affected, or who m 'i ?e knowledge of such animal, shall foil' >?i.h report the same to the Board of Health, together with the name of such owner and the place where the animal is kept, and it shall be disposed of under the directions of said Board. Any person, vio? lating any of the provisions of this ordi? nance shall be for each and every offense fined in a sum not less than ten nor more than fifty dollars, or imprisoned not less than ten nor more than thirty days. RULE 40. The Board of Health may enact any By Laws, rules and regulations as it may deem advisable, in harmony with the provisions and purposes of the act, and not inconsistent with the Constitution and laws of the State.
