Board of Health
OF THE CITY OF SUMTER,
Under and by authority of Act of
General Assembly "To establish j
local Boards of Health in the Cities
and Towns of the State," approved
January oth, 1895.
RULE 1.
Composition of Board.
Tbe Board of Health of the Citj of Sumter I
shall consist of 6ve persons, chosen aod con
stituted as provided in Section 1 oj the act
of the General Assembly authorizing tbe
establishment of the same: and when thus
chosen tbej sball severally take the oath
provided for city officers.
RULE 2.
Officers.
The Board of Health shall organize an
nually, at tbe Srst meeting in July ef each
year, by the selection of one of their number
as President, who shall serve for one year;
a Secretary, who may or may not be'cbosen
from among the members of the Board ; and
a Health Officer, as provided in tbe act ; and
said Secretary and Health Officer ?nall hold
their offices at the will of the Board.
RULE 3.

Section 1. Tbe regular meetings of the
Board of Health shall be held on tbe first
Wednesday of each month at o'clock p. m.,
unless otherwise ordered.
Sec. 2. Special meetings may be called at
any time by tbe Secretary when requested by
" the President or a majority of tbe members,
specifying tbe object of tbe meeting. No
notice shall be required for tbe meeting re
ferred to in Section 1, but due notice of:
special meetings shall be given personali) /
by mail.

RULE 5.
Duty of Officers.
PEES in EXT.
Section 1. Tbe President shall preside at
tbe meetings of tbe Board ; call extra meet-.
inge of tbe body, and perform all tbe duties
usually appertaining to his ofSce. And he
sball bave full power to administer oaths or
affirmations in any proceedings or investiga
tions touching tbe regulations of tbe Board ;.
but shall not be entitled to receive any fee:
therefor.
Sec. 2. In tbe absence of tbe President,
one of the other members of tbe Board may
be designated to perform tbe duties of his
office.
SECRETARY.
Section 1. The Secretary shall attend all
meetings and keep tbe minutes of the pro
ceedings of tbe Board ; be ertali keep all
papers, books and records entrusted to his
care to a safe aod convenient place in bis
office.
Sec. 2 He shall have full pover to ad
minister oaths or affirmations in any pro
ceedings or investigations touching tbe
regulations of the Bottrd ; but shall not be
entitled to receive any extra compensation
therefor.
Sec. 3. It ehall he his duty tc receive and
keep a record of all certificates ot biitbs and
deaths occuring within .the city of Sumter.
Sec. 4. It shall be his duty, in tbe month
of October of each year, to prepare a report j
in writing, to besub itttd to the City Coun-j
ctl (in accordance with tbe act), of the
operations cf tbe Board for tbe preceding
year, with the necessary statistics thereof,
together with euch information aod sugges
tions relative to 'he sanitary condition and :
requirements of the city as the Bourd may
deem proper. He sh:i!l also prepare a report,
to be submitted to tbe S:ate Bo-rd of Health
in the month of October, confair-iug notice
of its organization and membership, anrt
shall forward to them copies of all its reports j

information as may from time to time be j

Sec. 5. The Secretary shall issue all j
special permits granted by the Board, and he
sbali keep a record of tbe same and of ?1!
applications for permits in cases where per
mit8 have been refused ; and he shall ne re- '
quired to give bond in the gum of one bun ?
ared dollars ($100) for the faithful discharge !
of his duties, and he shtll receive a salary at !
tbe rate of five dollars (S3 CO) per month.
HEALTH OFFICER
Section!. The Health Officer shall keep!

be approved by the City Council, open fron;'
9 o'clock a. m. until 12 o'clock m. every j
day, Sundays and holidays excepted, for ?he |
convenience of the citizens; ami he shall;
keep a record book for complaints or notices j

shall prepare and publish weekly bilis of

which take place in the city ; inquire into j
the cause of all epidemical diseases, and re ?

state of public health when required, and ?
report to the Mayor or Board of Health. He j
shall submit to tbe Board of Health monthly
a fall report, showing the duties performed,
with such suggestions and recommendations j

such information in regard to the public

improvement or alterations in buildings or
Streets that in any wise affect the general j
health of tbe city. He shall grant burial j
permits and receive from the ?extons tbe j

S?me; and report to the Board all violations
of tbe ordinances concerning burials that j
come under bis notice. He shall attend the j
meetings of the Board of Health, and carry
out all orders of the Board or of the Mayor :
in relation to the saniury regulations of the
city ; ?nd from time to time, and whenever
ordered to do so by tbe Mayor or Board of
Health, make a thorough and systematic
examination of the city ; and he shall cnuse !
all nuisances to be abated with reasonable
promptness. He shall keep a list of all per- ?

He 3hall collect all fees and pay them into,

He shall accompany the Board of Health or a
Committee of the Board in their quarterly
visite to the schools and public buildings. It
shall be incumbent upon bim to visit every
lot and residence in the city at least once a
month and to report to tbe Board of Health
anyvbing be may find to endanger the public
health, and in the course of such inspection
to examine all privy vaulie, privies, and all
other placee likely to prove nuisances or
detrimental to the public health. It shall he
the duty of the Health Officer to risit daily
all green groceries, beef and fi^h markets, and
inspect all articles there kep' tor sa.r; nnd
should he find any meat?, fish, o\sters or
vegetables diseased or spoiled, or for any
reason unfit for food, he shall immediately
forbid the sale thereof and report the same
to the Board of Health.
Sec. 2. Any persoo so offering for sale
any diseased or spoiled meats, fish, oysters
or vegetable?, shall be punished by a fine of
not more than fifteen dollars ($15) nor less
than one dollar (Si), or by imprisonment for
not less than one (1) or not more than fifteen
(15) days for each offense
Sec. 3. The salary of the Health Officer
shall be at the rate of thirty-five dollars ($35)
per month. He shall be required to give
bond in the sum of one buudred dollars
($100) tor the faithful discbarge of bis
duties.
RULE 6.
Section 1. It snail not be lawful to bury
any dead person within the incorporate lim
its of the City of Sumter.
Sec. 2. Any person or persons who ,shall
bury any dead person or shall assist at such
burial within the limits aforesaid after the
time aforesaid, shall upon conviction thereof
be fined not more than fifty (S50 00) dollars
or imprisoned in the City prison not mor*
than thirty days.
Sec. 3. Should any dead person be buried
within the City of Sumter after the time
aforesaid the Mayor or the City Council
or the Board of Health shall cause the said
dead body to be taken up and removed, and
he or they may designate a place for the
burial of the same and it shall not be lawful
for any persons t? interfere with the Mayor
or Board of Health or their Agents in the
removal of said dead person, and any person
who shall so interfere shall upon conviction
thereof be fined not more than one hundred
($1?0.C0) doll?rt or imprisoned in the City
Prison not more than thirty d?ys.
PROVIDED, That this rule shall not ap
ply to burials within the grounds of the
Hebrew Benevolent Association and within
the grounds of the Surat r Cemetery Associ
ation as now located (or the Colored Ceme
tery) or Catholic Cemetery adjoining the
Protestant Cemetery.
RULE 7.
Ko new burying ground, cemetery, tomb or
vault fo-dead human bodies shall be estab
lished (cor shall the remains of any dead
body be placed in any existing burying
ground, vault, tomb or cemetery in the City
of Sumter, nor any of said receptacles be
opened, exposed or disturbed) except accord
ing to the terms of the permit therefor given
by the Board of Health.
RULE 8.
Every Association, Board of Trustees or
Corporation baviog charge of any cemetery,
burying ground or vault, shall be squired to
employ or appoint a Sexton or Superintend
ent who snail be required to register his
name with the Secretary of the Board of
Health, whose duty i: ^.lall ce to supervise
all interments in said cemetery, burial ground
c? vault. He shall not permit any dead body
to be interred in said cemetery, burying
ground or vault unti' he sball first hive re
ceived from the Searse- keeper or other person
in charge of the corpse such burial permit as
be, (the Hearse-keeper or person in charge)
is required by this rule to deliver with such
dead body, and it shall be the duty of such
Sexton or otfeer person in charge of any place
of burial to enter said burial permit or per
mits in a book to be furnished by him for that
purpose and to deliver the original certificate,
burial permit or permits to the said Health
Officer as these regulations require, and for
any and every violation hereof he shall for
feit and pay for the use of the City not more

more than 20 days
RULE 9.

RULE 11.
It shall be the duty of the undertaker or j
person in charge of the corpse to deliver ;he
said burial permit, with >he deud body, ;o
the Sexton or other person in charge of the
burial ground in which it is proposed to i?tt-r
such dexd body whenever such burial ^rrund
is within the limits of this city ; and wh*n
evrr such burial ground is without the limita
of this city the said permit or duplicate
thereof shall be delivered by s ? id he?.r.-;e
keeper or other person in charge of the he?rse
to the Heaith Officer on 'he day of interment,
under a penalty of not more than twenty-five
dollars ($25) or be imprisoned not more than
twenty (20) days for each ?nd every failure
or negiect so Um do nnd for any and every
violation of the provisions of this section.
RULE 13.
Every physician and profession?! advisor
who has Mtteoded any person ata last illness,
or has been present by request at the death of
any person, shall make and preserve a registry
of such death, stating the cause thereof and
specifying the date, hour, and place of such
death. And the said Board sball furnish to
each practicing physician and to the Coroner
of Sumter County blank certificates in the
j form following :

RULE 13.
[And] When any person shall die in :he
city, the physician or surgeon who shall
have attended such person as physician or
surgeoo shall fill up the blanks in such death
certificate (O the best of bis knowledge and
sign the same with his name, and shall de
liver the s-irae to some member of the family
in the house where such person shall have
died. In casee where the interment is to
take puce without the limits of the city the
attending physician or surgeon shall deliver
as above a duplicate certificate, and in case
any person shall die in the city unattended
by any physician or surgeon, it shall be the
duty of the Coroner to furnish such certifi
cate ; and for each and every neglect of the
duty herein required each and every person
offending sball forfeit mid pay for tbe use of'!
the city ten dollars [$10] or be impris^ced ;
ten [10] days in the city prison.
RULE 14.
Manner of Procedure to Obtain Burial Permit.
The undertaker or person in charge shall
presetit the certificate of death, properly
made out and signed, to tbe Health Officer,
and thi* shall be an order upon him ['he
Health Officer] for a burial permit. The
burial permit shall be taken to tbe cemetery
or n..rial ground along with the body and
delivered to the Sexton or person in charge,
and said burial permit shall be an order on
him [the Sexton or person in charge of the
cemeiery] to allow said body to be interred.
Upon tno Monday morning following the
interment the Sexton or person in charge of
the cemetery shall return said permit to the
Health Officer, who shall place it on fiie.
Within three days after receiving a certifi
cate of death the Health Officer shall file it
with the Secretary of the Board of Health,
who shall make a record ?f tbe same in a
register kept for the purpose.
RULE 15.
No other person than the Coroner or a
physician or ?urgeon who bas a license to
practice in accordance with the State law
shall give the certificate herein required to he
delivered to the Health Officer to obtain a ;
burial permit.
RULE 16
Births.
Every Physician, Midwife or other person
who may professionally assist or advise at
any birth sha!? make and keep a registry of

RULE 20?
When any child shall be Vi0rn, or there is a
stillbirth, in this city, the physician or mid
wife who shall bave attende^* at suco birth,
and if nooe were present tben.tQe parents or
nearest of kin, shall fill up the blanks in
such certificate and sign the sume with his or
her nume, und shall deliver the same to tbe
SecreUry of the Board within rive days after
the birth, and for each and every neglect of
the duties herein required each and every j
person offending shall forfeit or pay to the
use of the city ten dollars or be imprisoned
in the city prison ten days.
RULE 21. I
It shall not be lawful to keep any hops j
with' the incorporare limiti of tbe city of
Sumter, except in enclosures of such S'ze as \
may be approved by the Board of Health ; j
and for each and every violation of the ;
provisions of this rule the person offending
shall he fined five dollars [$5.00] or im- 1
prisoned iu tbe city prisoo five days.
RULE 22.
It shall not be lawful to slaughter any \
animili for market in the incorporate limits
of the city of Suroter; and for each nod
everv violation of trie provisions of this rule
the person offending shall be fined live dollars
[S5 00] or imprisoned in the city prison five
days.
RULE 23.
It shall not be lawful for any person to
permit a dead horse or any other animal that
may die within the limits of the city of Sum
ter in the possession, ownership or custody
of such person to remain within the city
limits for a longer period than is necessary to J
remove the same; and for each and every
violation of the provisions of this rule the
person offending snail be fiaed five dollars
[$5 00J or imprisoned in the city prison five
days
RULE 24.
It shall not be lawful for any person to
throw or piace in any street, or upon any
sidewalk or in any open lot in the city of
Sumter, any dead fowl or dead animal, or to
deposit nny watermelon rinds or rubbish
from yards or lots on the street or sidewalk,
unless the same be put in-boxes or barrels,
convenient to he handled by the city cart
drivers. It shall not be lawful to deposit
any liquid slops or refuse in any shape upon
the streets, sidewalks or open lots within the
limits of the city. Dead fowl3,
animals, rubbish etc., found upon sidewalks,
open lois, etc., in opposition to this rule j
shall be deemed as having heen there de- !
posited by the occupants ?f the nearest house j
or lot thereio, unless otherwise shown ; aod j
for each and every violation of the provisions .

RULE 25.

Tbe Superintendent cf Streets shall he re-I
quired to h->v? the dirt, filth, garbage and al!
kinds of offal removed from the streets, lanes, j
alleys and open courts of the ci y dailv ; and
the said dirt, filth, garnage nod offal shall oe
deposited by him at such place or places as
may be designated by the Mayor,
wirh the sanction of the City Council.
And the said Superintendent, in addition
to the foregoing, shall be required to keep
the streets, lanes, allpys acd open courts at
all limes free from filth; keep clean and
free from obstructions the openings of tbe
public drains aod the gutters along the side
walks. And the Superintendent shull be
liable to a fine of not more than five dollars
for each and every act of omission or default,
to be imposed by the Mayor or the Bo*rd of
Health whenever in their opinion such neg
lect may be detrimental to the public health,
or the Mayor may in his discretion have tne
work done at the expense and risk of the j
saia Superintendent aod have tbe sum paid
therefor deducted from bis pay.
RULE 26.
Low Lots.
it shall not be lawful for any person to
permit any lot tn his possession or under his ?
control in the city of Sumter to be kept in i
each a condition as to hold water in holes or
pools after a rain, but all lots shall be kept
in such order that the water from rains shall
easily and quickly flow therefrom; and any ;
person who may be convicted of a violation \
of this section of this ordinance may be fined ?
not more than ten dollars (.$10) or im- ?

prison ; and in addition thereio the Mayor or !
City Council may have and order any lot not
properly kept in condition after notice, put in !

RULE 27.
Dry Wells
Trenail not-ba lawful for any person tn
the city of Sumter to permit any privy or
cesspool to b- kept in a hi thy or unhealthy i
condition, but all such places must bee! 'aned

RULE 23.
Whenever ar.y vault or privy becomes of
f-r.sive tbe owner or occupant of the premises

RULE 23

persons to cenneel any vault, privy or water
closet upon ;(ny lot with any of the drains of j
the City, or to discharge or convey the con
tent* thereof into any such drain, and any
sucri person or persons offending herein. ;
whether he or they be owners or occupants of

every day that the said grievances, or any of .
them, shall continue after a written notice j
from the Mayor or Board of Health to abate

the city for each and every offense the sum

RULE 30.
it shall be unlawful to dig any new ditch
es or trenches for any purpose, or to open up
any old ones so as to expose tbe upturned
earth during the months of June, July. Au
gust and September, except !n cases of small
excavations, and then only a?er special per
mit ?rom the Board of Health, end any per
son who may violate this rule tiny be fined
by the Mayor or Board of Health on convic
tion thereof", not more than twenty dollars
or oe imprisoned in the City prison not more
t - in twenty days - Provided that this <\\'>)\
not apply persons cultivating the soil in
their yards, gardens or lots.
HULK 31.
Inspection of Fuuds. Etc.
Any cattle, meat, birds, fowl, fish, fruit,
or vegetables found by any inspector or
officer of this department in a condition
: which is in his opinion unwholesome or unfit
' for use as human food shall upon the order of
: the Board of Health, be removed from any
j market, street, or public place, aod the owner
j or person in charge thereof, when sodirpcted
by the said Board, shall remove or cause tbe
? same to be removed to the place designated
by the Health Officer, ar:d shall not sell or '
offer to sell or dispose of the same for human
food, and when in the opinion of the Health
Officer auy such meat, 5sh, fruits or vegeta- ;
blesi shall be unfit for human food, or any ?
such cattle, sheep, swine or fowl or animals '
by reason of disease or exp'?suie to conta- I

animals or be kept alive, the Board of Health

moved by the inspector, police officer, or
agent of this department to be killed and

RULE 32.
Physicians to Report Infectious and Pestilential
Diseases.
It shall be the duty of every Physician or
other person who may be called upon to at
tend any person with any infectious, conta
gious or pestilential disease io the Citv of
Suinter, to report to the Beard of Health
within twenty-four hours afterwards, the as
certainment of such disease, the Dature of
the disease and the premises on which the
same may be.
PROVIDED, however, that if there should
be no atteoding Physician, it shall be the'
duty of the owner, occupant or lessee of apy
premises on which a case of infectious, con
tagious or pestilential disease shall occcur, to
report the same to the Board of Health
That any such Physician or other person
who shall violate any of the provisions,
of this Ordioar.ee shall ?>e subject to
a fine of not more than twenty-five
[S25.00J dollars, or imprisonment not
exceeding 20 days.
RULE 33.
Sec. 1. In order to prevent the spread of
contagious diseases, the Health Officer shall
notify the families of those sick with conta
gious diseases that the children of sucii fami
lies should not be allowed *o attend any
school.
Sec. 2. In giving said notice the following
circular shall be used :
''You are required to keep your children
from school during the time from the com
mencement of disease until the sick person
has passed thestn^e of desquema t ion (peeling
off of the skin) in roealses and scarlet fever;
and of dedication (falling off of scabs) in
variola (small pox) and in diptberia until the
physician states that the sick person is free
from the disease, and until the room occupied
and the clothing used has beer, in each cuse
disinfected."
RULE 34.
There shall not be a public or church fun
eral of any person who has died of small pox,
diphtheria, scarlet fever, yellow iever, typhus
fever, or Asiatic cholera; but the funeral of
such person shall be private, and it shall not
be lawful to invite or permit at the funeral
of any person who has died of any of the
above diseases, or of any contagious or pes
tilential disease, or at any services connected
therewith, any person whose attendance is
not necessary or to whom there is danger of
contagion thereby. For every violation of
this rule the person so offending shall be fined
not more than twenty-five dollars ($25) or
be imprisoned not more than twenty days.
RULE 35.
The bringing of bodies of persons into
Sumter who shall have died of any of the
aforementioned diseases is strictly forbidden,
ander a penalty of fifty dollars ($50) fine or
thirty days imprisonment
RULE 36.
In all cases, railroad and transportation
companies shall obtain permission to bring
bodies of. deceased persons, from the Health
Officer or from regular physicians of the
place from which the body is brought.
RULE 37.
No owner or driver, or any other person
having charge of any carnage or other
vehicle used as a punite conveyance shall re
ceive or permit to he placed, or convey in
any manner in or upon .-aid vehicle, any per
son sick or infected with small pox or other
contagious disease, under a penalty of fifty
dollars rSoO] fine or imprisonment cot ex
ceeding inirty da\s.
RULE 33.
The body of any person who dies of smail
pox shall be removed in ?i burini h?-irse and
in no n:h:r conveyance.
RULE 39.
