?AN ORDINANCE."
An Ordir.xnce Entitled An Ordinance to fur
ther Regulate the Uze of Bicycle* in the City
of Sumter, S. C.
IT OBDAD?ED by the Major and
Aldermen of the City of Somier, in
Council assembled and-by authority of the
same,
Sec. % That it shall sot be lawful for any
person to use any Bicycle in the City of Sum
ter, not provided with a beH or whistle, nor
to use any Bicycle therein at night without a
lantern affixed to the front of the Bicycle.
Ssc. II. That the rate of speed of Bicycles
in tbe City of Sucnter. shall not exceed Six
Miles an hour, and at Street corners and
crossings tbe lowest rate of speed shall be
used, and on approaching the street corners
and crossings tbe Bicycle bell or whistle must
be sounded.
Sao HI. That on meeting or overtaking
pedestrians on sidewalks, persons using Bicy
cles must take the outside of the sidewalk.
Skc IY. That when not in conflict here
with, tbe Rules as now of force, or which
may be promulgated by tbe Sumter Bicycle
Club, shall have the full force and effect of
an Ordinance, and are hereby adopted as a
part of the laws of tbe City of Sumter, in re- j
lation to Bucles. "
Sac V. That any person who shall violate
any of tbe foregoing sections of this Ordi
nance, may upon conviction thereof, be fined
not more than five dollars, or be imprisoned ?
in tbe City prison not more than ten days for
eacboffeace.
Sac. y I. Ail Ordinances and parts of
Ordinances in conflict herewith are hereby
repealed.

or corporation engaged in, or intending to en
gage ? any calling* business, profession or
occupation, in whole or in part within the
limits of the City of Sumter, except those en
gaged in the calling or profession of Teachers,
and Minuten of the Gospel."

"City of Sem ter," it is provided, "Tbmt the j
said Town Council, t>e and they are hereby '
authorized annually to require th? payment
of such, reasonable sum or sums of money as-1
al icenee tax, by any person or persons or
corporation engaged, or intending to engage?
in any calling, business, profession or occupa
tion, in whole or in p?rt within tbe limits of
the town of Sumter, except those engaged in
the calling or profession of teachers and min
isters of th? Gospel. That tbe said Town
Council are hereby authorized to pass such
Ordinances as are necessary to carry tbe pur
poses ot this section into full effect and to
provide for the punishment of all delinquents
thereunder.
Now, therefore, in pursuance of the author
ity granted by tbe Acts of tbe General Assem
bly of said State,
Be It Ordianed by tbe Mayor and Alder
men of tbe City of Sumter, in Council
assembled and oy authority of tbe same :
Section I. That any person or persons or
corporation engaged in, or intending to en
gage in any calling, business, profession or
occupation in whole or in part, within the
limits of tbe City of Sumter, (except those
engaged in tbe calling or profession of teach
ers and ministers of tbe gospel) shall obtain
on or before tbe 1st day of September, 1894,
a license therefor in the manner hereinafter
prescribed. Any person or persons or corpo
ration, except teachers and ministers of tbe
gospel, commencing or intending to com
mence business in said City, after the said 1st
day of September, 1894, sball in like manner
obtain a license therefor, before entering upon
such calling, business, profession or occupa
tion.
Sac. II. That any person or persons or
corporation, requireu by this Ordinance to
obtain a license to engage in any calling,
business, profession or occupation for which a
license is required, shall apply to tbe Clerk and
Treasurer of tbe City of Sumter for tbe same,
?by whom all such licenses shall be issued?
and shall at the time of applying for such
license make in writing and sign a statement,
and file the same with said Clerk and Treas
urer setting forth
1st. Bis, her or its name or style ; and in
case of a firm or company the names of the
several persons constituting such firm or com
pany;
2d. Tbe calling, business, profession or
occupation for wbicb a license is required ;
3d. Tbe place where such calling, busi
ness, profession or occupation is to be car
ried oo, and,
4th. In those cases in which such infor
mation is requisite, the amount of business
of tbe preceding twelve months next before j
tbe time required for taking out such license, !
upon which amount tbe license tax shall be
assessed ; and in cases where tbe business bas j
not been carried on the previous year, then i
the amount of business expected to be carried
on during tbe year, for which such license is
required?all of which and answers to ques
tions relative thereto shall be given tinder
oath, mod for which purpose, the Clerk and
Treasorer of the City of Sumter, is author
ized and reqiured to administer such oath to
tbe applicant; whereupon the Clerk and
Treasurer shall assess tbe proper license tax,
and upon being paid tbe amount ol said
license tax, shall issue tbe proper license.
Nothing therein contained shall in any
manner effect any other requirements of law,
elsewhere enacted in regard to any calling,
business, profession or occupation.
Sec/III. If any person, or persons or corpo
ration, shall exercise or carry on any calling,
business, profession or occupation, for the
exercising, carrying on or doing of which a
license is required by this Ordinance, without
taking out a license as is id' that behalf re
quired, the said person or persons or corpora
tion, shall be liable for the payment of tbe
license tax, required by tbis Ordinance, and
in addition thereto, for each and every offence
shall be subject to a penalty of twenty per j
cent of tbe amount of such license tax, which
tax and penalty shall be recovered as is here- '
i:; belo w provided ; and if any person or per
sons or corporation required so to do, by the
terms of this Ordinance shall refuse or neg
lect to make out and deliver to the Clerk and
Treasurer of City of Sumter on or before the
time herein required, a statement as is requir- !
ed by the 2d Section of this Ordinance, or !
shall make a false statement or sball ret use or ;
neglect to take and subscribe an oath as to j
the truth of such stalemests, or any parti
thereof, or from any cause stall fail, to ?lake.j

nance tbe said Clerk and Treasurer of City of |
j Sumter. -bali proceed to ascertain as near as
possible, tbe business of sucb person or per
sons or coporation, for wbicb be, she, they or
it, sbali be subject to tbe payment of a
license tax, as provided in this Ordinance,
and in case of default, for the purposes
of sucb investigation, the said Clerk and
Treasurer sball notify the person or persons,
or corporation in default to appear before
bim at tbe Clerk and Treasurer's Office, at a
time fixed in said Notice ; and also such other
person or persons as said Clerk aod Treasurer
may desire to examine, and tbe party sought
to "be charged with said license tax, if he
shall attend, together with any witnesses
called as aforesaid, shall be examined by
said Clerk and Treasurer nnder oath, (which
oath tbe said Clerk and Treasurer is hereby
j authorized and directed to administer)
j touching the nature and amount, of the busi
ness of such party, and every thing which
may tend to evince the true amount of the
license t*tx, for which sucb party shall be
liable, under this Ordinance, and from the
information thus acquired by bim, the said
Clerk and Treasurer ehalt assess against sucb
person or persons or corporation, whether he,
she or it shall have attended such investiga
tion or not, such license tax, as upon the
facts ascertained by htm such person or per
so d? or corporation, is or are required to
obtain, adding thereto a penalty of twenty
per cent, thereof, and if tbe amount of such
license tax and penalty, shall not be paid
witbta ten days thereafter, tbe said Clerk and
Treasurer sball issue an execution therefor
nnder bis band and seal of his office, directed
to tbe Sheriff of Somier County, in said
State, and the said Sheriff shall proceed to
collect the said license tax and penalty by j
distress and sale, together with an additional
penalty of five per cent, on the whole
amount, which five per ceni., sfatali be for the
Sheriff, as bis compensation for making such j
collection, in addition to one dollar for!
making sucb distress, which shall be paid by
tbe delinquent without any fees for Entry or
Mileage; and the property of such delin
quent is hereby made liable for the payment
of such license tax, penalties aod costs, in
preference to all other debts or encumbrances,
except debts and taxes due to the State ; pro
vided, however that any person or persons or
corporation sball bave tbe right to appeal ;
nonce of such appeal having been given
within five days to the Clark and Treasurer,
from such Assessment of said ??cense tax and
penatties, to the City Council of City of
Sumter, and upon heaxiog such appeal, tbe
said City Council - shall make such order
thereon, as may seem just and proper ; and
provided further that in lieu of the remedy
herein above in this section provided, to en
force tbe payment of tbe license tax, and
penalty thereon, an action or actions may be
brought by tbe City of Sumter, in any Court
of competent jurisdiction for tbe recovery of
the said license tax and tbe penalty or penal
ties thereon ; and provided fortber, tbat any
person or persons or corporation, who shall
attempt to carry ou, or shall carry on, any
calling, business, profession or occupation,
without a license, as ii berein required, or
who Shall neglect or refuse to give the
information required, or to answer such
questions as may be propounded, or who
shall fail to attend before the said Clerk and
Treasurer, to be examined by him when so
required, as is provided in Sections 2 and 3 of
this Ordinance, eball be deemed guilty of
violation of this Ordinance, ?od upon con
viction thereof before the Mayor or City
Cou Dei 1 of the City of Sumter, may be fined
not more than one hundred dollars, or be
imprisoned in tbe City prison not more than
thirty days.
Sec. IV. That all licenses granted under
this Ordinance, shall be posted in a conspic
uous place in tbe premises of tbe holder of the
same, except in cases of vehicles for hire, or
bicycles used upon sidewalks of City, which
vehicles or bicycles shall have placed upon
them a metal badge, with the number of
badge and tbe license year affixed thereon,
such . badge to be furnished by tbe said
Clerk and Treasurer upon payment of tbe
license tax. Failure to keep such badge upon
the vehicle or bicycle of the person owning or
using the same shall snbject such person .to a
penalty of not more than five dollars, or
imprisonment in tbe City for not more than
ten days upon conviction thereof.
Tbe licenses granted under this ordi
nance sball be at ail times snbject to
inspection of any officer of the City of
Somter, and tbe calling, business, pro
fession or occupation shall oot be carried
on elsewhere than is provided in said license,
unless such authority be granted by the
Clerk and Treasurer endorsed thereon.
Sec. V. All licensee granted under this
Ordinance shall continue in force until tbe
31st day of August.. A. D., 1895, except
such as in this Ordinance are provided for by
limitation for a shorter period. Tbe form of
such license aod tbe oath to be administered
shall be prepared by the said Clerk and
Treasurer, and no exception shall be granted
except to Teachers and Ministers of the Gos
pel.
Sec. VI. All applications for licenses of
all kinds shall be made to tbe said Clerk and
Treasurer, and be shall keep a correct entry
thereof, of all licenses granted by bim, and
of all monies received therefor.
Sec. VII. The following sum or sums of

Sumter, (excepting Teachers and Ministers of

absence shall include any agent, clerk or
employee managing the calling, business,
profession or occupation, respectively referred
to, and generally where a license is herein
imposed for tbe carrying on of any calling,
business, profession or occupation, and tbe
same is carried on by any agent, clerk or
employee, such agent, clerk or employee shall
be subject to the penalties herein imposed,
should tbe said calling, business, profession
or occupation be carried on without taking
out such license in the same manner as if he,
she or they was or were tbe proprietor or
proprietors of tbe said calling, busioess,
profession or occupation.
Sbc. IX. Tbat all ordinances or parts
of ordinances inconsistent herewith be, and
the same are hereby repealed.
Skc. X. Tbat this Ordinance shall take
effect on and from the first day of September,
