SHIPP SAYS LIMIT RIGHT OF
APPEALS TO GOOD GROUTS"DS.
Circuit Judge Cites Possible Remedies
to Assure More Speedy
Justice.
"The right of appeal should be restricted
to good and sufficient grounds
?not open to every loophole and subterfuge
that is resorted to today to
delay justice," Judge S. W. G. Shipp,
of the twelth judicial circuit, said
when asked what remedies he had in
mind recently "\^hen he charged a i
grand jury in the court of general
sessions that the public is to blame !
for the long delay justice in criminal
cases in South Carolina and has the
remedy in its hands. "I would not
limit the right of a man's appeal but
that right should be restricted to
prima facie evidence that the appeal
is being taken on gooa ana prupei
grounds and is not merely a resort
to delay justice.
"Right of appeal is purely statutory
and therefore can be changed at will
by the people or their legislators.
In my judgment, such changes should
be made as will expedite the adminis<
tration of justice in South Carolina.
These changes should enable the
courts to reject, summarily, any appeal
which is evidently a move to
delay the sentence of justice.
"South Carolina formerly had a
rule which required that an attorney
had to get permission of the supreme
court to carry his case before that
body. This rule was nullified under
a decision of that court in a famous
case. Virginia has restricted the
right of appeal to bona fide evidence
, of sufficient grounds.
"In the federal courts, if an attorney
would appeal, he must get the
permission of the circuit judge?the
court official before whom the case
was tried. If he refuses, that ends
the matter. I am not in favor of this
responsibility being placed on the
trial judge in the state courts, but
I do favor a plan which would operate
to the same end in the state courts.
"Another law which the general assembly,
in my judgment should change
is that requiring a prisoner must be
brought back from the state penitentiary
for sentencing in the court for
trial. Once a man has been sentenced
to execution, and has been taken from
that county to the state penitentiary,
the supreme court should be delegated
the authority to name a date for execution.
He should not be brought
back to the county for resentencing.
Or let any circuit judge then sitting
in session, fix a date without having
the prisoner brought again from the
penitent ary into the court."

in Lincoln, Neb. Louise Osborne Ferson
and her sister, Grace Osborne,
want $120,000,000 from t forty-eight
of the largest corporations of the
nation. The sisters claim they invented
the "pork and bean biscuit."

1922, and lodged in my office on the
26th day of May, 1922, commanding
me to levy and collect out of the property
of the defendant, Harvin McDonald,
the sum of two hundred seventy-seven
and 58-100 ($277.58) dollars,
with interest from the 1st day of May, I
1922, and the further sum of twelve
and 50-100 ($12.50) dollars costs, I
have levied upon the following described
tracts of land as the property
of the defendant Harvin McDonald,
and will sell the same to the highest
bidder, for cash, before the court
house door in Kingctree, S. C-, during
the legal hours of sale on the first
Monday in July, 1922, the same being
the 5th day of said month, to-wit:
All those three tracts of land situate
in Williamsburg county, state of
South Carolina, described as follows:
One hundred fifty (150) acres, more
or less, bounded on the North by lands
of Umer Barr; on the East by lands
of Darby; on the South by lands of
West Pegues; and on the West by
lands of C. M. Hinds; also,
Thirty-two and one-half (321
acres, more or less, bounded on the
North by lands of' George and joe
Davis; on the East by lands of W.
R. (Ross) Chandler and by lands of
Joe Wilder; on the South by lands
known as Campbell lands and lands
of Robert Brown; on the West by
lands of C. M. Hinds; also,
Ninety-five (95) acres, more or less,
known as the estate of William Blakeley,
and bounded by lands of John
A. Kelley, Alex Lawrence, estate of
Lawrence Bennett, and C. W. Stoll.
