HIGH COURT AFFIRMS VERDICT
Tom Ponton Loses Appeal for New
Hearing. e
The appeal of Tom Poston of this (
county was dismissed by the supreme t)
court at Columbia yesterday and the o
circuit court verdict upheld in opinion a
handed down by the appelate. e
Poston was convicted of man- s<
slaughter on a charge of the murder it
of J. P. Miller, an electrician of Kingstree,
and from this verdict he appealed
to the supreme court. Three main 0
grounds were set forward in the d
appeal?that the defendant wan not ^
allowed three day's inspection of the
indictment before trial, that a motion t
>f continuance should have been grant- p
ed and that a new trial should have
been granted. The court does not
sustain any of the three pleas and
affirms the lower court verdict.
Poston shot and killed Mr. Miller on *
the road from Lake City to Kings tree, 7
near Cades, following a collision between
the automobiles driven by
Poston and Miller. Mr. Miller's car
was standing on the side of the road jj
and the machine driven by Poston j p
crashed into it, according to the: a
evidence, and Poston was quoted as 0
having said that "Miller tried to get; hard
and I just shot hell out of him." 1
