Sheriff i of Dillon county. The case arose ' under the statute of South Carolina, giving to any person damaged by an automobile the right to seize such automobile by attachment. In the j instant case, Y H Hyatt was injured by an automobile of M W Brigman. n Hyatt seized the automobile through Sheriff Lane, and the Merchants I and Planters Bank of Mulling, hav- i ing a chattel mortgage past due on the automobile, brought action to [ I take the automobile from the Sheriff.! The Sheriff resisted the action, but i the lower court gave judgment against the Sheriff and awarded the ! automobile to the Merchants and; Planters Bank on the ground that the act of the Legislature giving the right to seize an automobile was unconstitutional. The Sheriff appealed to the su- j pre me court and the judgment of 1 the lower court was reversed in a!, recent" opi ion by Associate Justice!
