The Case of Frank.
It is'hard to hang a man who has
influential friends and a plethoric
pocket-book. The case of Leo
Frank, convicted of the murder of
Marv Phagan, the little factory operative.
is strikingly demonstrative
of the many loop-holes in the net
work of the law when a big fish Incomes
entangled therein. Several
month- ago Leo Frank was brought
to trial in Atlanta for the murder
of a fourteen-year-old girl operative
of the factory of which Frank was
superintendent. Despite the fact
that he was defended by three of
the ablest criminal lawyers in the
State of Georgia, who spared no effort
in behalf of their client, Frank
was found guilty of murder in the

to the State supreme court for a new
trial, which was refused. Now, it is
said that, by various legal processes,
Frank's execution can be delayed
for one, or possibly two years. The
latest move on the part of Frank's
friends is the employing of William
J Burns,the head of the greatest detective
agency in the world, to hunt
up "after discovered evidence". Is
it any wonder that the poor man
chafes under a system that allows
such ;'iuggling with the decrees of
Justicf?the goddess personified as
even-handed and even blind?
"There should be some political
killing in South Carolina," says the
Honorable Senator Benjamin R Tillman.
If this had happened to be
the year when Senator Tillman stood
for re-election he would doubtless '
find his suggestion carried out with

himsel" as the victim of the political
assassination. ,

The Ex-Police Lieutenant May
Come Free.
New York, February 24:?The |
conviction of Charles Becker, former '
police lieutenant, of the murder of j
the gambler, Herman Rosenthal, was
annulled today by the court of ap- j
peals at Albany, the highest in the !
State. He is entitled to a new trial,
but it seemed probable tonight that;
he might go free without facing a
second ordeal. It was made known
that District Attorney Charles S
Whitman believes that under the
prevailing opinion handed down by j
the court conviction a second time

Appeals taken by the four gun-!
men, "Whitey" Lewis, "Lefty
Louie," "Gyp the Blood" and "Da-,
go Frank," convicted as actual mur- j
derers of Rosenthal, and whom
Becker was accused of having instigated
to commit the crime, was
not sustained and they will have to
die in the electric chair, probably in
March, except in the event of Execu
tive clemency.
"The District Attorney is the last
man in the world," said Mr Whitman
tonight, "who should want a
conviction to stand which is not
justifiable by law. This is all the
comment that I care to make."
The District Attorney had not received
the full text of the opinion
tonight, but it was learned that
forming his judgment on such of it
as was available, he had little hope
presenting sufficient evidence to
convict Becker at a second trial.
As Mr Whitman was said to have
interpreted the opinion the testimony
of the three chief witnesses
against Becker?John Rose, Bridgie
Webber and Harry Vallon, selfconfessed
accomplices?has not been j
held by the court to be credible. J
Although it is known that the District
Attorney has new evidence he
could bring forth, the testimony of 1
these three?the gamblers who said
they hired the gunmen to kill Rosenthal
at Becker's behest?was the
foundation of the case.
Mr Whitman also was under the
impression tonight that in effect the
court had held that Sam Schepps,
who corroborated the trio, also was
an accomplice.

Rev P B Ingraham filled his regular
appointment Sunday evening at
3:30 o'clock. His subject was from
the book of Genesis, Chapter 24, and
part of the 27th verse, the words of
the text being: "I being in the way
the Lord led me." Brother Ingraham
will commence a protracted
meeting at Prospect March 2 for
the benefit of the Prospect school
and will be assisted by Rev Mr A.rial,
pastor of Lake City charge.
Mr J Q Lyerly is having built a
large dwelling. Mr J E Weathersbee
af Johnsonville is the contractor.
Hon J Davis Carter has recently
bought a fine Overland car. Your
scribe had the pleasure of riding
svith Mr Carter from Florence to
Leo and it was a delightful trip.
We crossed Lynch's river at Cowird's
and saw much fine farming
