The act is rather lengthy and requires a good deal of type-setting. However, we will comply with our friend's request and publish for the second time the new j law, which follows below. We hope that everyone having oc- j casion to refer to it again will cut out the article, as this is much easier for them to do than for u3 to have to ! print it over again. A BILL For the Protection of Game Fish in Berkeley,Bamberg, Colleton, Chesterfield,Clarendon, Dorchester,Orangeburg and Williamsburg Counties, and for the Repeal of Certain Laws Relating Thereto. Be it enacted by the General Assembly of the State of South Carolina: Section 1. That in the counties of Berkeley, Bamberg. Colleton, Chesterfield, Clarendon, Dorchester, Or mngeburg and Williamsburg, for the i purpose of classification, the follow- j ing fish shall be known as game fish( < viz: Jackfish or pickprel, pike, black j bass or pond trout, striped bass or rock fish.warmouth, red belly, robin, i bream, copper-face or bald-bream, < banded bream, yellow-belly perch, i sun perch, red fin trout or yellow < perch,rainbow trout, speckled trout, i flyer, crappin, rock bass, goggle-eye; < * * L and white perch. i ] Sec 2. That hereafter, during the i months of April,May, June and July, | no person or persons shall cast,draw, j fasten or otherwise make use of any seine or drift net, fyke net of any I j other description, or use any other ] appliances for the catching of game fish, except hook and line and ordin- j ary bait, or by spoon, or by artificial fly, or by phantom minnow,or by ar- ' tificial bait. For the violation of this ! section the party so violating shall be ( fined twenty ($20.00) dollars or be fso) Hnvs for each lmprisuucu umv; j offense: Provided, That this section j shall not apply to such person or per-1 sons as are catching game fish with a net or other appliance for the pur-1 pose of stocking a pond or other stream, and not for commercial purposes: Provided, also, that any or all 1 persons engaged in catching game , fish for the purpose of stocking a i pond or stream must notify the nearest magistrate of his or their purpose to so catch the fish. i Sec 3. It shall be unlawful to poi- J son the streams or waters in the ! caunties of Berkeley, Bamberg, Dor- ' Chester, Orangeburg, Colleton, Ches- ' terfield,Clarendon and Williamsburg in any manner whatsoever for the J purpose of taking fish. For violating this section, j i the person so violating shall be fined : ] five hundred ($500) dollars or be im prisoned six (6) months. Sec 4. No navigable stream in the : counties of Berkeley, Bamberg, Dor-1 j Chester, Orangeburg, Colleton, Ches- j tergeld, Clarendon and Williamsburg < shall be obstructed by dam or other- j wise unless there be provided a fish- ] way in same. For the violation of 1 this section the person or corpora- 1 tion so violating shall be fined not 1 less than twenty-five ($25.00) dollars i for each day that such obstruction t shall exist without said fishway in 1 same after having been notified in < writing by any person that such ob- 1 struction exists. 1 Sec 5. Any non-migratory fish.ex- < cept game fish,may be caught at any 1 time or in any manner not prohibited by this act. Migratory fish may be caught in accordance with such 1 laws as now exist or may hereafter be enacted. Sec 6. That for the violation of c any provisions of this act not other- ^ wise provided for, the violator shall, i upon conviction, be fined not less 1 than ten dollars nor more than j twenty-five dollars, or be imprisoned ( for not less than ten days nor more y than thirty days, and for the viola- [ tion of any provision of Section 4, t upon conviction, be fined not less ^ than one dollar nor more than twenty-five dollars, or be imprisoned for { not less than one day nor more than j thirty days. Sec 7. Such parts of Sections 524- } 525-532 and 535 of Volume II,of the , ' f Code,and such other acts or parts of * acts, as conflict with the several provisions of this act, are hereby re- * pealed. Sec 8. It shall be unlawful to throw, place or put dynamite or any explosive in any lake,stream or inland ^ f| water in Berkeley, Bamberg, Dor- ^ Chester, Orangeburg, Chesterfield, ? Colletop,Clarendon and Williamsburg counties for the purpose of taking ish. For the violation of this section the person so violating shall be fined five hundred ($500) dollars, or be imprisoned one year. Sec 9. That all acts or parts of acts inconsistent with this act are hereby repealed. Sec 10. That all fines collected for the violation of any of the sections of this act shall be turned into the eounty treasury to be disbursed the same as any ordinary county fund. Sec 11.
