In his life Gen Hemphill played ! many parts and iu them all he did well. The matter which drew the s Senatorial tire was contsiued in a paragraph headad "Conflicting L Jobs," in which the COUNTY Jtec-: j OKD laid emphasis upon the recorded fact that Tillman missed the opening, roll call of the Senate because on j ^ the dav Congress met he was attendli ing a meeting of the board of trus-, tees of Clcnison college, and com-! men ted thereon as follows: He should blame no one but himself fo: the disappointment he expe-;1 enced at not being able to auswer 0 two culls of duty simultaneously, j o The point is Senator Tillman has 0 ' tenaciously clung to the Clenison t college trusteeship in plain violation of the State constitution that he him- ^ ? self helped to frame, and he has been " permitted to do j;0 because?well, because he is Tillman. e The reply by Senator Tillman to v the criticism is sufficiently concise fc arc' of sufficient general interest to e warruit its reproduction in full. We c quote: s Ordinarily I pay no heed to such t squibs,but there is so much of malice t and of ignorance in this unjustifiable c article of yours that I take occasion, { to call vpur attention to some things i which you ought to know and which, c if you and the other papers which t copied your article will print,will,e prevent future misconception. t First. The meeting of the board of trustees of Clemson college is not y fixed by law and is subject to the judgment and convenience of the r , ' members. The last meeting was or- i lered in November bv the board, but j For some reason President Alan | Johnstone did not call the meeting ifntil December t>, and I am sure he t' was entirely innocent of any purpose 1 to make the conilict with my duties < u Washington. Every intelligent (] man knows or ought to know that j the annual session of congress begins ' ( tin the tirst Monday 111 December. ' There was, therefore, no necessity for a "conflict" and had the meeting : been either earlier or later I cow Id | have attended it without difficulty. ( In my judgment theClemson trustee meeting was of far more importance 1 than of mv answering the toll call ' beie. Had I attt-uded the meeting ot the senate ou the 7th 1 would have'i to have left immediately to attend I the meeting on the 8th. Second. Senator Tillman has not 1 "tenaciously clung to that Clemson college trusteeship in plain violation of the State constitution that he himself helped to frame." I am a ] trustee of Clemson college under Mr Ulemsou's will. I do not hold any ' commission as trustee of < lemsor. 1 from the State government. I was a trustee before the State constitution of 1895 was adopted and that consti tutiou could not and did uot attempt' to alter my status a', all. If you are innocent of intentional or unjust criticism of me, it must be attributed to your ignorance; if you were merely repeating what you have read in other papers without examination, it ought to be a warning to be better informed lest you be charged with malice, < Rnt SSanafrtr Tillman aicrnallv fails ? 0-?J to convict The Col ntv Record < either ignorance or malice, and he < ignores the kernel of the matter. The < Senator knows, or he ought to kuow, I that whether or not the several offices ( be!d by him are in actual "conflict" 1 s not an issue. It is as irrelevant us ( t is foolish, not to say disingenuous.; 1 :o prove that had the president of I' he board of trustees called the meet ng on some other day there would 1 lave been no "conflict." Had the * late been a week later, Senator 1 rillman could have answered to his 1 lame in the Senate on the opening >f Congress, but to have then at-1 ended the meeting of the Clemson j rustees would have required the ^ legleet of his duties in the Senate; or at least three days. Is there no y 'conflict" there? But the question,' * we premised, is not of "conflict/''1 t id of law. And the fundamental aw of South Carolina commands ? ha,: ' j? "Av person shall hold two office* i vnor or profit at the same time." The constitution makes no refer-j ^ | p nee to "conflicting" offices; anditjg lakes olIj this exception to its, weeping prohibition: "Provided, b hat any person holding another ofce may at the same time be an of-1 cer in the militia or a notary pub c." The important office of college j rustee is not excepted. Under the 6econd head of his let-! 1 ;r, Senator Tillman appears to as-[ iime that the trusteeship of Clem- B 3n college is outside the jurisdiction a f the State constitution because his ommission as trustee is not "from; u 1 ? he State government," but is by au-1 hority of Mr Clemson's will. The constitution; n orbids the holding of two offices of! a onor or profit at the same time, and t he supreme court has decreed that; d he uusalaried iutendant of a town,11 lowever inconsequential a village y hat "town" may be,caunot hold an- d ther office of profit or honor,that of. n f iutendant being deemed au office t f "trust," and so an hoaor. In endants, as Senator Tillman should f, now, do not get their commissions n from the State government." ; a Senator Tillman is in astonishing fc rror when lie holds that because he v las a trustee of Clemson before the v itate constitmion of 1805 was adopt- i J "that constitution could not aud lid not attempt to alter my (his)] tatns at all.*' If it be conceded hat the constitution did not force: he holder of two offices at the time; if its passage, to retire from one or j he other of them, it must also be a onceded that the term of Senator j hat Mr Tillman was then serving a xpired on March 4, 1S91, and that h he constitutional inhibition must;^ ipply to the second term. j The Kingstree County Recordja eminds the senior Senator that he, c ? -. . . . i - 3 also a trustee of Winthrop college, eceiving that office of honor directly "from the S'ate government," mil therefore if his argument held, in regard to th;i^ feature of his! Ulcin.suii commission, it would not [ iiold as to Winthrop. 15ut it holds j n neither case. The ruling of the | Supreme Court, under the consti- j tutiou, is that if a clerk of court! iccept the office of l n 11 n d a n 11 lie thereby vacates the office of clerk j of court. Now, it is Senator Tillman's judgment that* attendance' iiyuu 111 v v-icnivi i u uaicc j was of "far muiv importance" than being in'Washington when c-ongiess met, therefore the office of trusteed of Clemson and of Winthrop must be of importance, of trust and honor. The Supreme Court will so hold, and if it should be to the interest of any one to invalidate any notion by either of the boards of trustees of Winthrop ofClemson in which Senator Tillman participated it could be done. It is our opinion that Mr Tillman vacated the trusteeship of Clemson, March 4, 1895, that be has violated the letter and spirit of the constitution whenever acting as trustee of Winthrop college, and is not entiled to one cent of per diem or expenses that he may have received from either of those colleges during all these years.
